Anyone out there have a child with a disability and recieved child support from their ex after the age of 18?  Both of my boys have Asperger's syndrome, high functioning autism.  My older son is turning 21 in May and his dad had stopped the child support after he graduated from high school (about two weeks after he turned 18).  Now my younger son is turning 18 in May and his dad told me today that he is cutting off that child support at the end of May.  Neither boy is able to go out in the world and function on their own yet and it will probably be many more years.  My older son is having a hard time getting a job at all.  He had one for about four or five months but was fired.  How can I tell him to go live on his own when he is probably only functioning as a 16 or 17 years old would?  Do I have a legal right to child support?  The only thing he is willing to do is leave the boys on his insurance, as he pays the same rate for insurance whether or not they are on it or not.  Any advised greatly appreciated.  TIA

Having near-adult age children with the problems your boys do is not easy. It is easy enough to get specialized services when they are in school, but once they are older that help stops. It is though our society thinks the children should no longer have the diagnoses past school age.

The only thought I have is to fight hard to get them on Social Security Disability. I have several friends with children in your situation that have been able to get SSD for their young adults. For most of them, it was a hard fought battle and took up to 4 years to get the approval, which I know doesn't help you in the short run. Perhaps you can contact your state's job training program that can help with placement and supportive programs like medication and transportation.

and have not acted on that yet. I can not find the phone number to the Social Security Office anywhere but am going to stop in one day and ask how to make an appt. I did try to get them SSI when they were younger as a supplement to the child support to help cover all their medical expenses, which their father would not help with. He said he only had to supply the insurance, not pay the doctor bills (even when he got the check from the insurance company and cashed it and kept it without sending the payment to the pediatrician). I was told then, that I made too much money for them to qualify for SSI. Now that he is over 18 and the other is ready to turn 18 next week, I will look into it again but have been told by other parents with children with Asperger's that they have been turned down over and over. I have been fighting for their rights and advocating for them since they were really little and I am just worn out. I just do not know how much 'calm' fight left in me. I know the last time I was at Social Security Admin. I was on the verge of cussing them out, I was so furious.

One of my friends has a son with Asperger's syndrome as well as Tourette's. Her son has been receiving benefits for many years and is now 35 years old. He works part-time at McDonald's every morning. He has a small apartment and has a person through an agency to help him with things. Please look into it again. My friend's son takes medication, and I know the Tourette's is very well controlled. He still was awarded benefits. I will speak to her, and if there is anything she can add to help you I will relay that in a post. Good luck to you.

The web address below might help. Most people get turned down the first 2 times, then you need to get a lawyer. They take up to a certain percentage because you get back benefits lump sum once you're approved (they don't take more than $3500 I think it is). Just don't give up.
