Not getting child support ??

Dtr owed over 8,000 in child support now and the sperm donor apparently has no intention of working. Child support enforcement will try to do "address verification" when we give them a new address but that's as far as that goes. Has anyone ever tried one of those companies that are supposed to help get your back owed money for a percentage? Do you know what the percentage is?

They just get your money. What you need to do, and it will take a little time but so worth it, file a motion for contempt (that he is not paying child support), claim you are indigent so you dont have to pay for the forms, and then have a friend serve him (fill out an form called affidavit of service as proof), then bring the affidavit of service to the court hearing.

If he does not show up, request jail time if he has not paid up in 10 days. If he does show up, do the same. If he does not pay, then go back, file another contempt motion and they will put him in jail.

Then, in order for him to get out, he will have to come up with the money before they release him. If he doesnt come up with it, they can put him on a work release where they force him to get a job and they pay you what you are owed and they take the rest for "rent."

That will fix him.

I don't know what state you live it, but the DCSE (Dept of CS Enforcement) is there for the very reason you describe. They want YOU to do the address verification? Do they not have his SS#?

In my state, VA, they use a person's SS# and their last tax return to track them down. They are hauled in. There is a garnishment for the CS amount put on their wages, plus 37% if there is back pay until it is caught up. They will also withhold CS from any tax returns. The CS can be handled through DCSE permanently. They collect it an dpay it to you, and when he is 30 days late, they issue a summons and they go to court. You do not even have to show up. This happened to my ex and I did not even know it. He called ME to ask me not to take him to court, and I had no idea what he was talking about. DCSE told him 30 days late and WE take you to court. It was very effective in receiving payments on time.

I think I would investigate your DCSE a little further. This is their job. Perhaps they work differently in different states, but where I come from, they do not mess around. If this is not going to work for you, you should definite petition the courts as the other posters have suggested. Yes, it is going to take a while. Just realize that and try not to get too frustrated or expect instant results, but keep working on it. DO NOT give up on it.

I filled out the papers at the court to have him served with "show cause" order. He had to show proof of income as to why he wasn't paying support. He didn't show up for that. The judge referred me to DCSE. The court handled all of the paperwork involved. They took his tax returns before he ever saw them. They garnished his pay. They took him to court when he screwed up. I got ever last penny he owed me over time. DCSE is the way to go.
