Hi everyone - Anyone have any ideas about what to do with a bad mortgage, other than foreclosure I mean.  We got sold to a servicing company some time ago.  My DH decided to ask, just ask, about getting a loan modification and they automatically went ahead and did this without us filling out any paperwork.  Can you believe it!?  We tried calling and talking with them about this but got no where to say the least.  We decided to just keep paying our regular mortgage amount since we obvious were not going along with the modification.  Now they are messing with our credit by saying we are not paying the whole thing.  We tried financing with someone else and they said we were "red flagged" because of the credit issue.  We are totally at our wit's end.  Cannot afford a lawyer to sue and don't think it would do any good anyhow.  Talk about a rock and a hard place.  All I do is cry.

I'm confused about a couple of things. You said they did loan modification without you filling out any paperwork. I didn't think that was possible without some sort of signature on your end. Plus, now it seems as if you have a larger amount that is due.

Get a copy of your credit report from Experian or Equifax. You can get one for about $30 from Equifax. That will give you a starting point as to what is on there that other lenders are seeing. Then, I would try the BBB. You might also find some info tht could be useful here: http://www.hopenow.com/

Send a certified letter to the lender asking for copies of any and all paperwork regarding your mortgage. If, indeed, there are changes to the mortgage agreement itself that have been made without your signature, then you might need to talk to an attorney.

A modification is not that simple as far as not even needing a signature.

We applied for a modification and there is so much paperwork that they need before they even attempt to modify you loan such as W2s, tax filings, pay stubs, etc.

With all the mortgage changes that have been going on the industry, legal and otherwise, I think I would be inclined to contact my district repesentative for the House of Representatives and go from there. They often have resources and information that "we" have never heard about. They also have amazing clout sometimes with just a phone call or two to the right person. Can't hurt to try. If you are sure, and I am sure you know, that you didn't sign any paperwork of any kind then I would shout it from the rooftops. Call your local newspaper, TV stations, anyone who will put it out there for you.

Does anyone else have the problem of certain outside noise frequencies causing their eardrums to vibrate or pulse really fast? This only happens when I wear my headphones. This may be too much info for some of you guys, so sorry in advance!
