Age discrimination and employment rights

We have had some discussion about the chipping away of child labor laws.  Here is an example of the chipping away of age discrimination laws.  Some people here have made the argument there are laws to protect us.  My answer--not if the Republicans have their way and defund and deregulate the concerned agencies that do the protecting.  A chip here, and a chip there.

;

And these "concerned agencies" that do the - protecting...

[ In Reply To ..]
they are employed by the same government who keeps raising the retirement age to keep people from getting their benefits, right?

LOL. Please. All this is is political posturing. What the Republicans are trying to do is get us off the brink of bankruptcy.

The title is misleading and so is your post. In the article it tells how to get around age on an application because under current law they can't compel you to put it on there.

Again, much ado about nothing. You better watch out folks...next it will be the Republicans will be coming to eat your children.

Geez, when will the finger pointing STOP and people just get stuff DONE??? Like STOP Spending and get us out of this horrific mess we are in??? I know both parties had a hand in getting us here and they both should dang well be trying to get us OUT. And right now, the only politicians I see talking about CUTTING costs and not ADDING them are the Republicans.

We cannot, i repeat...CANNOT...spend our way out of this.

Are you able to distinguish between budget and discrimination issues? - Evidently not.

[ In Reply To ..]
Much ado about nothing, huh? Age discrimination is an equal opportunity offender and is blind to partisan affiliation. Its coming to a decade in your life sooner or later. There is no getting around this practice which, by the way, is against the law. If retirement age is raised, all the more reason to protect the law and to enforce it against those who choose to break it.

Your budget rant is totally irrevelant to this subject except in the sense that your attempt to avoid a direct reply indicates you have no excuses to offer on behalf of the regressives who would just as soon set workers rights back a century or two in the name of balancing the budget. Where were you when they were extending those deficit-ballooning Bush tax cuts?

You totally ignore the fact that the agency who - you say protects is part

[ In Reply To ..]
of the federal government, and it is the federal government who raised the retirement age for social security....so you are saying I should trust the government to protect me from the government? Give me a break!!

I am probably much closer to this than you are, and would have liked to retire before I was 70, but if the government keeps raising retirement age for full benefits I darned well may be 70 before I CAN retire.

What I CAN tell you is that our country is WAY past balancing a budget. Our country is to the point that we have to STOP SPENDING. Period. And those "deficit ballooning" tax cuts don't hold a candle to the money this administration has spent and continues to WANT to spend (Obama's budget is ridiculous). Where were you when that was happening? Where were you in the GM bailout? Where were you when the promise to bring all the troops home in 90 days didn't happen? Now THERE would be some cost savings.

You should really stop talking down to people, friend. You would get a lot more attention paid to your points if you did.
You are still not addressing the subject. - sm

The subject of this thread is pubs interested in weakening laws protecting age discrimination in the workforce (along with child labor laws), not whether or not you TRUST the government to enforce those laws or to keep their hands off retirement age determinations (decidedly NOT the topic). If you want to direct your frustration over all that toward the monolithic entity of the government, that is your right of course, but at least narrow it down to which party attacks SS (and age discrmination laws) and which one defends same.

The last time retirement age was jacked with was when? Who was president? Which party was responsible for enacting the change? Which one would like to attack it again? Which one would be likely to defend it?

Your assumption about my age...wrong. I qualify for early retirement and am 3 years shy of full retirement. I am also on unemployment and have been since November 2009. I lost my last job due to a "hostile environment" at the workplace based on age-related issues (I was the oldest employee) that had to do with a supervisor half my age who evidently felt intimidated by my skills and experience. I had no problem establishing a viable unemployment claim without an appeal...thanks to an enlightened approach to anti-discrimination legal codes. I have worked short term temp jobs in the interim and have helped my husband build up his business, but would much prefer landing a job of my own.

Toward that end, I have sent out an average of 10 resumes per week since that time. Out of all those resumes, I have had (count 'em) ONE...that's right, ONE call to interview, despite the fact that my skills and experience qualify me for the jobs I am applying for. I have tried all those so-called tricks (including lowering my pay expectations) you think are so effective to hide my age, a ruse that cannot be sustained the moment you walk into a face-to-face interview, which became apparent at the conclusion of the only one I was offered.

Hiring is not the only arena where this plays out. These laws are applied to firing, promotion, layoff, discipline, raises, pay, fringe benefits, and similar decisions employers make based on age. Discrimination cases based on all protected classes share common elements. Confronting them head-on is American as apple pie.

If we all adopted your attitude, not only seniors, but women (including pregnant women) and men, whites, blacks, Native-Americans, Asians, Pacific Islanders, Hispanics/Latinos, the disabled, Jews, Moslems, Buddhists, Hindus, Bahai, Sikhs, atheists, etc. should all just throw in the towel and say, "Oh well, whoa is me, we are helpless, nobody cares, let's just roll over and accept our fate."

Are discrimination cases difficult to litigate? Most definitely. Does this mean we should reverse the laws on which they are based? NOT. Let us not ignore the 800-pound gorilla. The GOP, emboldened by recent gains in the elections, are exerting transparent and highly organized efforts to undermine workers rights at all levels. They have picked the wrong fight, energized their opposition's base and inflammed middle class independents, a scenario we see being played out all over the country.

Wow. Dial it back a notch, will you? - You would get better results

if you did not talk down to people and just TO people.

As to the child labor laws, I have seen where one "pub" introduced a bill in one state that has not been debated or voted on, certainly not passed. I saw a quote from one other "pub" generally talking about child labor laws. I have seen ONE governer in ONE state that is BROKE ASK the union to frogeo collective bargaining for public employees (just ONE union, no more in that state and certainly not nationwide)until the state was solvent again, which they flatly refused to do at first (the other taxpayers in Wisconsin did not even enter into the union's thinking)...so he sought to legally do it...that hardly constitutes the "GOP in a concentrated effort to undermine workers rights at all levels." That statement is exaggerated and simply not true. And I would say the same thing if you were accusing Democrats with so little evidence.

I feel sure both Republicans and Democrats have been involved in upping the retirement age...and that, of course, was brought on by the Democrats being the first ones to raid the Social Security trust fund. Thank the Democrats so much, for that. It would not be insolvent today if they had not unlocked the box.

I can tell you what energized this middle class independent, and that is the seeming inability of the Democrats to understand that when you are broke, you stop spending and you make spending cuts. Common sense should tell anyone it is time to STOP SPENDING and START CUTTING. Bush started in his last year or so spent like a drunken sailor, Obama picked up the baton and spent more in 2 years than Bush did in 8 (he was the entire fleet). That takes some doing. And his budget he just sent to Congress...are you kidding me????

As far as saying woe is me...don't know where you got that. I am far from saying woe is me. I am working real hard for a NEW administration come 2012. We can't stand another 4 years of this bunch. And most of the inflamed middle class independents, inflamed middle class "pubs" as you call them, and even several inflamed Democrats who cannot understand where the heck their party has gone are of the same mind.

And yes, I am sure the unions will be rabble rousing and saying basically the same things you are that the "pubs" want to destroy "all the unions" yada yada...and will be pouring huge amounts of their members' dues into the DNC coffers (more than usual probably...and there are a lot of union members who don't like that if they don't support the recipient's candidacy, although the union hierarchy could care not care less who the rank-and-file members support.

I will be very surprised if the shellacking in 2012 is not worse than the one in 2010. After all, there is a Republican sitting in Teddy Kennedy's seat. We shall see.

I am not sure the Republicans are going to be any better....yet. But at least they are trying to cut spending which puts them light years ahead of the Democrats so far.

I would like to say it has been nice chatting with you....but for some reason I don't enjoy being railed at..lol. Sooo...if you have another union rant about how the "pubs" are out to bust all the unions and will be coming to eat the children...don't bother. :-)

Take those blinders off. - sm

midterms shellacking. I just don't buy the hype and much ado about nothing anymore. I have lived long enough to watch what they do and not what they say...as the two are rarely the same.

The major issue with this country remains we are in a debt hole and if we do not do something to change that, age discrimination is going to be the LAST thing we need to worry about.

So yeah, I tend not to take seriously someone who is tunnel-visioned on one issue that will not fix what is wrong with this government. All it does is take attention away from the issue at hand...which, of course, it is designed to do.

Take you own advice and WAKE UP.

And my answer is there have never been laws to - Backwards Typist

protect against age discrimination. Been there, done that. The companies CAN'T use it as an excuse not to hire someone because of age, but have you ever heard the term "over-qualified" or under-qualified?" I've heard it a few times. After the golden age of 35-40, you're over the hill where jobs are concerned.

Age discrimination is very hard to prove. Look it up and see all the hoops you have to go through to prove your case.

The New October Employment FiguresNov 05, 2010
U.S. employment increased more than expected last month as private companies hired workers at the fastest pace since April, offering more signs of an up-tick in a sluggish economy.  Employment in October was supported by the private service-providing employment, which jumped 154,000. Temporary help services, a harbinger of permanent hiring, increased 34,900 from 23,800 in September.   2010 has had more private job creation than during the entire 8 year tenure of George W. Gay Discrimination Legislation In A RepublicanFeb 27, 2014
Will the Republican Right win the anti-gay battles in Missouri, Kansas, Ohio, Mississippi, Idaho, South Dakota, Tennessee, and Oklahoma? We know that is what the Republicans really want, or will it crumble from the pressure of Big Business or the bean/vote counters? In Georgia, two versions of a similar bill in the state House and Senate are ...
