Indiana's 4th Amendment Rights Taken Away

Posted: May 17, 2011

Check out this link.  Apparently, it is now okay in Indiana for police officers to illegally enter someone's residence and the homeowner is not allowed to resist.  Gov. Mitch Daniels of Indiana is thinking about running for President.  It will be interesting to see if this comes up in debates if he does run.  Indiana is a very conservative state.  Who's next?

...this was not something Mitch Daniels did.

I know Mitch didn't do it, but he'll still be held for it because he is the governor - amazed

Right or wrong, it's his state and he'll probably be held to task for it. If nothing else, his thoughts about it should be asked. I am hoping this goes all the way to the US Supreme Court. I feel if it is appealed that far, it should be overturned.

They are getting threatening letters and - sm

phone calls about this. I live in Indiana and I totally disagree with the ruling on this. I like Mitch Daniels but I did hear that the person who made the ruling was appointed by Daniels...I need to verify that. So all in all...I'd like to see what Mitch has to say on this issue.
My mother-in-law is a cop - amazed

And she sees the folly in this ruling. She even said that sometimes cops will be out dressed like ninjas in all black. How is one supposed to know they are a cop? Or what if it's the middle of the night and one is trying to come in? You wouldn't know who they are, and if you own a gun you are going to be ready to use it to protect self, family, and property. This has so many ways it can go bad. I know if someone breaks into my house, I'm not going to take the time to ask to see their badge. Just not good. There are circusmstances allowed by law, such as exigent or probably cause, but there was a law in Indiana that specifically stated if a cop was coming in illegally, you had a right to resist and protect yourself. The actual ruling states in the last paragraph that this new ruling is the law of the state and the previous is not in effect anymore. I'll attach the actual ruling again in case it was missed.

part of Homeland Security and the Patriot Act that went into effect after 9/11. It's not just Indiana....it's all over the country, just some officers have not chosen to use it in all cases.....yet.

Bush for the Patriot Act and Obama for extending it, huh? Once again...another example of both pubs and crats being dillholes!

Standing with my hands in the air, totally supporting your view! The politicians should just go home and try to make a living like the rest of us poor stiffs, let us go back to living by common sense (if there's still any left!), and Andy Taylor can handle all the domestic crap with a sage word and a shake of his finger :-) (don't I wish!)

I agree with you whole heartedly, though!

That Patriot Act is one of the worst things that ever happened to our country - Proud American

You couldn't think up something more harmful to our country if you tried.

I'm confused. So did Mitch McDaniels pass this law against the 4th amendment - Help me understand please

[ In Reply To ..]
Was he involved in getting this illegal entry, which is against the 4th amendment passed in Indiana?

So anyone who has this happen to them can take it to the Supreme Court and I suspect they will win, won't they?

No, this was an activist court with Mitch appointing one of the justices - amazed

[ In Reply To ..]
After reading the ruling, the only thing I could agree with is if they made this the case in alleged domestic violence. But this does it across the board, so anyone can have this happen.
Here's the actual ruling.

In my state there is an underground movement prepared to take over, just waiting for the state government to fail. I know we're not the only state that has people making those kinds of scary plans for the rest of us. They say they are non-violent. Well, maybe they are...now. There is no accountability with these groups.
I've seen stuff like this - amazed

There are a lot of crazies out there. That's for sure. And as long as they feel their rights are being abandoned, they will get crazier.

No Tax Increases, Huh? This Is Just For Indiana.May 13, 2010
In a new study, actuaries have concluded that ObamaCare could cost Indiana taxpayers an additional $3.5 billion.  The bulk of the additional costs will come from Medicaid expansion.  ObamaCare expands Medicaid eligibility to 138 percent of federal poverty level. Since the mid-‘90s, Tennessee has had an expanded Medicaid program, called TennCare.  Gov. Bredesen (D-TN) has called TennCare the “clear and present danger to the state’s financial stability.”  ...

Legionairre's Disease In Indiana HospitalApr 04, 2016
This is the hospital I worked in for years. I also was a patient over the years. Sometimes our little hospital has to send people there if they cannot provide the right services (ours a little hospital). Latest on this is that the person got Legionnaire's from the hospital. They were not at all sure of how he acquired it. On the local news, they said no one would say the condition of the man, but that he had been extremely sick. Said the tests won't come back for at least 10 days, ...

Trump Is Going To Beat Cruz In Indiana According To PollsMay 01, 2016

Why Religious Freedom Laws Like Indiana's Are A Bad Idea For Left AND Right, Christian Or NotApr 01, 2015
Let me first say, again, I strongly believe in protecting civil liberties, but not promoting them. This means regardless of whether I agree or disagree morally, I do NOT agree with extremists, right or left, hellbent on forcing opinion into law. Recently, this has been done by both sides, either by enacting deceptive state law that "pretends" it doesn't discriminate, or by filing deceptive lawsuits that "pretend" they're with whomever refused them, rather than finding the perfect sit ...

An Interesting Article On The 2nd AmendmentMay 20, 2014
I think the key to the 2nd amendment is "well-regulated," though I assume none of us by any means represent a militia.  I also find it interesting that the original included an exception for conscientious objectors: In fact, the original version passed by the House included a conscientious objector provision. “A well regulated militia,” it explained, “composed of the body of the people, being the best security of a free state, the right of the people to keep and bear arm ...
