HELP CHANGE EMINENT DOMAIN LAWS

Hello fellow MTs!

My family needs your help!  We are putting together a petition in Alabama in order to address the state's eminent domain laws.  To make a long story short, the government took our home and several other properties through eminent domain. 

PLEASE (I'm begging) go to our petition link and read our story under the "blog" tab.  Help us get these laws changed so that the government can't take homes away from hardworking American citizens.  Help us spread the word!  We are desperate for signatures and need as many as we can get!

No one thinks about eminent domain until it happens to them; trust me, I never thought twice about it until it happened to my family.  PLEASE SIGN!

Here is a short version of the story under the "blog" tab in the petition link:  In 2009, the government sent us a letter saying they were taking our home under eminent domain.  They claimed it was because it was close to an airstrip and this airstrip needed to be up-to-date with FAA guidelines, or else the county would lose all past and future funds the FAA provided.  However, the FAA came forward and said that since it was only an airSTRIP and not an airPORT, it was not mandatory that it follow the guidelines, and it would not affect past or future funds provided to the county.  Well, by this time, the government had already taken our property, demolished some of the other homes, and sold our home for 7 thousand dollars (after they told us we could not sell the home ourselves).  We have not even gotten to our court date yet, and we have not reached a settlement for just compensation, yet the government has already taken everything and moved the house from the property.  There is NOTHING right about that.

I looked at some of the signature comments and there was a huge rant about the federal government, Marxism, Socialism, etc. It sounded very familiar. I then did a little Googling and saw that it is the County government using eminent domain--not the federal government. It also said that they are projecting $2 million bucks will be paid on 8 parcels of land and that the appraisals had been made by a certified appraiser. We had a similar situation here where eminent domain was used to facilitate the building of a new school. The owner of some undeveloped land held out for a huge amount of money--which I found just crazy and greedy of the landowner.

The county got an appraiser and they greatly low-balled the appraisal. We hired our own appraiser, and now we are trying to agree on an amount in the middle, and it's surely not anywhere close to $2,000,000.

We know we aren't getting just compensation for the property. Our main concern is that apparently the government can take the land, sell the home for $7000 (after they told us we were not allowed to sell it or move it ourselves), and move the house off the property, all BEFORE we have even reached a settlement, we haven't even had our court date yet. The petition is to try and change state laws. (I know a few people are ranting about the federal government, but our main focus is the state at this current point in time).

There is more to a home than it's monetary value. This is a place with many memories and I might just not want to deal with the trouble of moving. I don't think that the government should be able to confiscate my personal property (compensated or not) if I don't care to part with it. As far as holding out for a huge payment--Why not? If somebody has something that the government wants or needs, why should they not pay a premium for it, especially if the person who owns it was not looking to get rid of it in the first place?

If anything, we would choose to keep our house on our land and have it stay there forever! So many memories...50+ years of family, friends, and good times...

The link is to a nice picture of Bobby Jindahl getting his gimme while condemning the stimulus. The metaphor is the people who complain the most about the government wasting taxpayer money are the first ones who want double or more of the appraised compensation.

I hope other people find similar stories.  These people bend over to appease the TGOP, yet when it's all said and done, all they do is pretend to be against any stimulus, loan, etc., yet they wind up getting the money, anyway.


I'm looking for an honest politician.  I realize this is an oxymoron, but if my legislator (state or federal or county, etc.) states to be for or against something and then DOES the opposite thing, then I want to know.  I won't knowingly support a liar, regardless of party affiliation.

I did sign it, not that I think that it will really make - a difference, unfortunately.

I live in East Mississippi, so I do most of my shopping in Mobile and have been to Dauphin Island, so I know what you are talking about and it is ridiculous. Maybe some of these people who think you are out of line should take a trip down there to see what exactly is being stolen in the name of public interest.

I was glad to sign your petition, though I probably live nowhere near you, and I therefore wonder how much help my signature actually is.

When you have a citizenry like ours, a citizenry that would prefer that a 30-year-old just die instead of helping him out, then you have a citizenry that isn't going to care about helping you or anyone else. Unfortunately, we've reached a new low in humanity.

Years ago, our city govt tried to use eminent domain to demolish a street full of lovely older homes for new condos and a shopping center (!) which they claimed was for the public good as it would increase the city's tax base. There was a huge public outcry and national attention (60 minutes TV show). A special election was held and the eminent domain issue defeated. (Will certainly sign your petition against eminent domain abuse, but you might consider contacting as much media as will listen.)

Dauphin Island, you would know that MAYBE a couple of recreational planes land there each week. There is no control tower and there are no employees.

If the airstrip was really the problem, they would have just extended the runway a few more feet out into the water, NOT take property and demolish homes. More homes are going to be taken, this is just the first phase.

I'm having a hard time believing that anyone would side with the government on this...

Citizens' homes are being taken away and the gov't is lying about the reasons. Please sign our petition so we can get these laws changed.
