Advice on applying for disability...l/m

I will try to be brief here.  It is hard to put details of an extremely complicated life situation into words.  My sister and I are in our 50s.  In September, my neice committed suicide.  Oh my, even typing that makes me cry.  She was one week short of 27 years old.  Not sure why this happened but that's another discussion.  My sister was absolutely shattered.  Got a call today that my sister collapsed at her job and is now in the psych ward, under sedation. 

I live about 12 hours from my sister, two states away.  I talked to my other niece, aged 21, who asked if she and her mother could move over here.  My niece is working full time and in college to be a surgical tech.  She stopped school because her mother is basically needing so much.  My niece wants to move here so that I can help them out.  What a blessing this young lady is.  She wants to return to college and support her mother all at the same time.

My sister's health is not all that great - she has bilateral knee replacements and von Willebrand's disease.  I think this will also be long term mental health treatment.  I would lke to get Sis on disability with SSI.  Her employer has basically tried to be kind, but they have basically told my sister that she is not doing her job.  And now after this collapse, I can imagine that my sister will not be employed long.  My sister used to be an RN but can physically no longer do the job, so she was working the front office at a doctor's office.

I need advice on how to apply for disability or if this is even doable.  My neice wants to rent an apartment near me, so she and her mom can live near me.  It would be nice for my sister to have an income without worrying about working for a while.  She has no assets, little savings, no house, no car.  Basically, she spent every dime she has made.

Any advice is greatly appreciated.

First let me say I am so very sorry for your loss, and for your sister's state of health. I can't even imagine her heartbreak.

I applied for disability July 2009. I was approved January 2010. I decided to get an attorney to file for me. I have heard the majority of people are denied the first time around without an attorney. It is easier to win a claim after the age of 50, and the older you are after the age of 50 the better. I did a lot of research, and you can get much information from the social security website about filing for disability. You can also call the toll free number for social security and after you answer a few automated questions you speak someone who can answer any and all questions. They have always been extremely nice to me. I pray for peace and healing in your family. Your sister is blessed to have a loving supportive family.

I appreciate the tip on a lawyer. I was hoping someone on this board had gone through this process so could advise me. I have been reading about the process on the website - makes my head spin. I think I will definitely pursue the lawyer aspect. There is an organization here that uses paralegals for people with low income; maybe they could help my sister. Glad that your case was approved.

For the poster, about unemployment, my sister I think will claim unemployment while she is trying to get disability. I sincerely doubt her ability to work now for a while until her thought processes normalize. They plan to move here in Feb. I talked to my niece tonight and her mother is now coherent.

Unemployment while filing for disability - See Message

Please make sure she can file for unemployment. My legal group told me I should not collect unemployment while filing for disability. I know here in PA when you file for unemployment you are saying you are able and ready to work. When filing a claim for disability you are saying you are not able to work. I did not take unemployment after I quit my job. My friend collected unemployment while she filed and her disability claim was approved. I would hate to see your sister have to pay back any money she receives from unemployment. Just be sure about this. I did some research on line before I filed for disability, and some websites said you could file for both at the same time, but most said you could not. I hope this was not too confusing. You'll be better off hiring either a Social Security disability consultant or a lawyer who specializes in disability claims rather than relying on paralegals. The way the system is set up you don't pay anything unless your claim is approved, and even then the 30% maxiumum payment to the consultant or lawyer is deducting from the back pay that was awarded, so there should never be any money due out of pocket.

I agree that it is a good idea to hire someone though. My son filed for SSDI in March 2009 and was approved in late August 2009. It's not unheard of to get approved on the first try, but many people do have to appeal or go to a hearing. I had heard also that those whose first application is sent in by a lawyer or consultant have a higher initial approval rate. Not sure if that's true, but it does make sense since what's in the paperwork would definitly impact the decision.

Disability is not something that can be done quickly; it takes a lot of meticulous paperwork and documentation. There are some excellent sites on the Net if you google Filing for Social Security Disability. Also, she will not be eligible for Medicare health insurance until 2 years after filing for SSDI (unless healthcare reform has changed that rule).

If she is not an IC and loses her job involuntarily and not for a bad \"cause\" (theft, etc.), she will probably be eligible for Unemployment in a matter of weeks, and might even get more than if she had SSDI. I believe it is possible to file for Unemployment in a different state if she moves. She still needs to be available for some type of work if it\'s offered.

Once she is unemployed, she is eligible to keep her insurance for 18 months through COBRA, but the premium is likely to be close to $500 a month for her alone.

Good luck with all this. I\'d definitely start researching the Net and start gathering paperwork ASAP.

Oh, and the social worker at the hospital can give - useful info on SSDI, as well. nm

This isn't about applying for disability, but my 19-year-old son died by suicide three years ago in November. I know how hard it is. There is a wonderful organization called American Foundation for Suicide Prevention, afsp.org. On their website they have a lot of resources as well as information on support groups and suicide prevention (Out of the Darkness) walks. I found a support group that helped me a great deal. I will keep your sister and your family in my prayers.

Thank you for your kind words and please know that I am also sorry for the loss of your son. I do know about this organization; not sure if my sister does. She has been going to a support group for the past month but is still not accepting of help or support, IMO. She is shattered and angry and stunned; not sure how to describe it. I can honestly say no one in the family saw any indication in my niece so when it happened we were all shocked. Just to clear up the acronyms, SSI stands for Supplemental Security Income and it is for people who have never worked much in their life and don't have enough credits with the Social Security people to get SSDI, which is Social Security Disability Income.

Since your friend was a nurse and working, she probably will want to file for SSDI. I think the way you apply for both is similar, though.

I recently had the experience of helping my friend apply for SSI and he got approved without an attorney. First you have to go online and fill out an extensive application. It will help if you are as concise and accurate as possible. You have to document a lot of stuff, so be sure to block out a couple of hours to get this done. The SS office will then call you for an appointment. Try to bring in copies of your medical records to show them. After that, your friend will be called for a physical with a medical doctor and probably a psychologist. Oh and be sure to document any other illnesses like diabetes, arthritis, etc., as these can also be factors in limiting someone's work.

My friend got unemployment while he was waiting for his SSI to be approved. When he finally was awarded the SSI, he got a settlement and they didn't pay him for the months he got unemployment.

It's a long process and can be frustrating at times. If she gets turned down the first time, I'd go ahead and get a lawyer.
