2 N.J. teens labeled sex offenders for life after 'horseplay' incident

SOMERSET COUNTY — Call it bullying or call it horseplay. Either way, a state appellate court panel says roughhousing with a sexual connotation by a pair of 14-year-old Somerset County boys was a crime that requires them to register as sex offenders for the rest of their lives.

In a decision handed down Monday, the three-judge panel acknowledged the severity of its decision, but said it was bound to uphold the law.

"We are keenly aware that our decision may have profound lifelong ramifications for these two boys as well as others similarly situated," Judge Jose Fuentes wrote.

One of the boys, whose case went to trial, said he had sat on the faces of a pair of 12-year-old schoolmates with his bare buttocks in November 2008 "cause I thought it was funny and I was trying to get my friends to laugh," he told a family court judge.
But an act is considered criminal sexual contact if it is done for sexual gratification or to degrade or humiliate the victim, and punishable by lifetime registration — even for juveniles — under Megan’s Law, which requires a person convicted of a sex crime against a child to notify police of changes of address or employment.

The trial judge concluded the teenager intended to humiliate or degrade his victims and found him guilty of criminal sexual contact. The second teenager who was implicated pleaded guilty to criminal sexual contact, and received the same penalty.

The convictions were appealed, and the attorneys for the teenagers argued that their behavior amounted to horseplay, which other appellate court panels had exempted from Megan’s Law. David Fassett, an attorney for the boy who pleaded guilty, argued that the court should not take such a literal view of the law.

"I think the Appellate Division was simply offended by the conduct here and just couldn’t get past that issue,’’ he said.

The appeal did not challenge the application of Megan’s Law to the 14-year-old youths since courts have already ruled the law applies to offenders as young as 13, but on the ground that the offense was not severe enough to carry a lifelong stigma.

SOME VIEW RULING AS 'HARSH' PUNISHMENT
Ronald Chen, the state’s former public advocate who is vice dean at Rutgers-Newark Law School, said in an interview that the ruling highlights the "collateral" consequences of Megan’s Law.

He said that although the boys’ convictions for criminal sexual contact met the law’s requirements, "I don’t think lifelong registration is a proportionate response.’’

Chen said that is something the Legislature has to take up.

"It is a very harsh result and maybe the Legislature should take a look at it,’’ he said. "But for now, it is what it is.’’

The panel, which also included Judges Victor Ashrafi and William Nugent, noted its constraints under the law.

"Although we are not unsympathetic to the arguments criticizing the application of the lifelong registration requirements in (Megan’s Law) to 14-year-old offenders, we are bound to uphold such application because that outcome is mandated by the Legislature,’’ the court said in its ruling.

The Somerset County prosecutor, Geoffrey Soriano, and Robert Wilson, a lawyer for the teenager who was tried, both declined to comment.

For the boys, who are now 16, there is still a possibility of having their convictions overturned. The appellate panel sent their cases back to Superior Court, where one youth will have a hearing on whether he understood the ramifications of pleading guilty, and the other will get to argue that his trial attorney was ineffective.

Make them do community service... stand up in front of their fellow students at school and talk about what idiots they are... but sex offenders for life? No. That sounds like something my brothers and even my sons might have done at one time... but I don't think any of them are sex offenders.

how do you figure the punishment fits the crime?? For one thing it did not even say it was girls whose faces it was. And it is not fair to put a lifelong stigma on a couple of kids who have no idea the ramifications of what they are doing. Next thing you know just plain mooning will be a sexual offence. They need to calm down a little and stop with the overreacting. This makes me think of the case where a boy kissed a girl who didn't want to be kissed and was prosecuted and he was 7 years old!!! What is up with the zero tolerance???

No. What I do know is, inappropriate behavior escalates without swift, firm intervention. What next? Penile contact with schoolmates' faces? Maybe appropriate punishment would be disallowing the boys to be in the company of a minor(s) without adult supervision, until the boys are 18 years old.

We live in a society that condones sexual behavior that brings disease. In fact, we celebrate it by allowing those who engage in it to "marry." Our children are learning that any sexual conduct should be condoned and, not only condoned but, given preference. It comes as no surprise to me...not with the way our society has become so accepting of perverse sexual behavior. Being labeled as a sex offender is a bit harsh but these boys certainly need some serious counseling. Then again, so do a lot of the adults in our society. So, what else is new??

so what, are you saying that people getting married teaches kids that sexual conduct should be condoned and given preference?? Give me a break- that makes no sense whatsoever. And this was hardly sexual behavior, which is why it is ridiculous to label them sex offenders- this obviously had everything to do with being 'gross' because boys that age think gross is hilarious. This was a bit too gross, but the punishment nowhere near fits the crime.

I believe that is deserved. Often times sexual assaults, including but not limited to actual rape, have little to do with sex and much to do with power and dominance. It sounds like that is exactly what the accused was engaging in. Such behavior should not be tolerated.

Sounds like extremely poor judgment on the part of these kids. I wonder how I'd feel if one of the victims belonged to me. I'd be furious, of course. It does seem that labeling them sex offenders for life is a bit harsh, though. They definitely need a harsh punishment, but I believe that was a bit much.

imagine it was one of your own children who made this poor choice- they are 14, too young to even imagine being an adult let alone to understand consequences like that. And this means you can no longer do things as a family that you used to, because your child can no longer be within a certain distance from children. No more going out to dinner, to movies, to amusement parks. I would understand the punishment if these boys were trying to force themselves sexually on another person but it sounds like they were just horsing around and not knowing the ramifications of the behavior. I think it is a travesty that the court systems do not take into consideration the circumstances any more, they just claim they are 'bound' to this course of action which is BS. This zero tolerance has invaded our society and now nobody seems to have common sense any more. Kids who have aspirin at school are expelled, a 7 year old boy who chases and kisses a girl is prosecuted- it is just insane. It is like some kind of bizzarro world.
