My 35-year-old stepson was injured at work 2 weeks ago, got his hand caught in a machine, tore tendons and had to have surgery. This happened on a Wednesday with surgery Thursday morning. He asked his employer for vacation time the following week; the employer said, don't waste your vac time, work comp will cover your pay. On the 13th day, he had an appt with his doctor and as he was sitting in the waiting room his case worker showed up for the appt. The case worker asks in the doctor's office if he can go back to work and the doc said yes with one-handed duty. The case worker has him report to work that night - one day short of the required 14 days off for work comp to take effect, so in essence, he is out two weeks' pay that work comp will now not cover. This sounds very suspicious and underhanded to me. He tried to get the doc to release him earlier and the doc said absolutely not. Does he have any options to try to get the work comp to pay? He has been with the same employer 10+ years.
