Any legal transcriptionists know how to get a wrongful death suit for Kalee going?

Posted: Jul 7, 2011

Who is going to bring a wrongful death lawsuit against these people, do not need unanimous for that!! I live in FL could I do it????  I think all the citizens who paid tax dollars should get in on this lawsuit.  I certainly do not want my tax dollars going for this trial.  Any money Casey and the Anthony family think they are going to make on this little girls death should be tied up in a wrongful death lawsuit and pay the taxes, the jury, and then some.   Anyone have any background on how to go about this?   See what happens when you work the late shift, you come up with these kind of ideas!!!

;

I don't have the answer for you, but your post - reminds me

of the conversation I had with DH tonight. He said he heard some juror talk about it and he/she said something to the effect of they knew 100% she was lying. There was no doubt about it, but the actual murder itself there was no way to prove she did it. Nothing at all to tie her to it. They think what happened was Casey was not watching her daughter and the girl drowned accidentally and they panicked. I guess all the jurors felt sick about the decision, but they had to do it. I can understand that. What IF the beautiful little girl drown, it would not be murder. However...if they can prove that without a doubt then I would think they could charge her with something like wrongful death, or trying to cover up a crime scene and accusing others of murder.

On another note I heard some lady Casey wrongfully accused is filing a law suit against her.

I will admit, I can't be for certain that she actually did the crime (as much as I despite this girl), but on the other hand you can't sentence someone to jail/death if they really did not commit the crime.

wonderfully stated!! - anon

I totally agree, they did not prove it. You can not mix emotions into the law. I really think that it was either an accident and she was young and scared or that if her father really did molest her as a young girl, maybe he did something to Caylee and when she started to scream, he covered her mouth and sufficated her. Both of these possibilities float back and forth in my mind. When she was in jail talking to her parents, she said she was not saying anything to protect a family member, so I think it is really possible that her father was involved. Either way, you have to go off of facts and the fact is, the evidence was not there. I have always been against the death penalty because of that one time you put someone innocent to death. Also it does not right a wrong by committing another wrong. I think this is the first post I have read that is well thought out and not just mean spirited crap. This girl was convicted in the media before she ever had a chance to stand trial, so I am glad to see the jury do the right thing and go by the evidence.

Or maybe it was a UFO probing that went really wrong. - just_as_likely. nm

re: panicked - crow

[ In Reply To ..]
While that sounds plausible, I just do not buy into the "panic" thing. If they panicked, that's one thing. If that is what indeed happened, ONE OF THEM shold have eventually come forward or at least said so during the trial.

Also, when you panic, you rarely go out partying and pull names out of the air to divert attention from you.

I hope someone files a civil suit against her. Maybe the state will against the WHOLE family!

Anthony verdict - mt1347

The only problem I have with the OP's rationale is that the state did charge her with aggravated child abuse and the jury had the option of convicting her on that and they let her go. That child did not put the duct tape on herself and we know the little heart sticker that was there came from the same roll of stickers in the Anthony home. I think it was unintentional, Caylee's death, but I do believe Casey did it. She had a history of knocking the kid out with Xanax - her brother Lee and a few other friends said that. That is where the "Zannie the nanny" came from - the Xanax is the nanny when Casey wanted to party. The state of FL spent millions on this narcissistic chick and I'm sure they will put a lien on any book, public appearance or movie deal she makes. She won't see a penny for years. Personally, I don't think she'll live that long. OJ had wealthy friends who protected him with security guards - Casey doesn't have that - at least not yet. Maybe Michael Moore or the ACLU or someone will step in and take care of her. She has no skills or education and now no reputation, and she has convictions for 3rd degree felonies for writing bad checks. She's a mess already and she's only 25.

The FBI lab did not photograph the heart imprint - on the duct tape, unfortunately..

I'm not sure, but the grandparents might be able to, but I'm thinking that's not going to happen. The unnamed baby daddy would I believe be able to, and possibly his parents. I don't think it's anything that just random people have standing to do.

And, frankly, if we all simply ignored at this point anything money-making for the Anthonys and those that let her free- i.e. the jurors that didn't want to make payment free statements, but are slowly but are trickling out to the morning talk shows. Don't know if they get paid for those or not, if they get a free trip to NYC, or if it's none gratis via satellite.

Frankly, the publishing industry is in such a free fall anyway that I can't imagine them paying too much to Killa as it would be a losing proposition (they did learn something from OJ et al). Controversy does not necessarily translate into profit after all. Make loud and clear the fact that you won't pay a dime to see the movie. She might make a couple thousand for an initial interview but that's not going to last long, especially the way that beach parties, and then she's got nada. She doesn't even have the fascination of John Bobbett's winkie going for her, so porn wouldn't even be an career choice because while she ain't ugly, she ain't all that.

George and Cindy might be able to file a wrongful-death suit against Casey. Beyond a reasonable doubt does not apply in a civil trial, only a preponderance of evidence (at least 50.1%). Casey would have to take the stand.

I'm "boycotting" CA movies and books, as well as interviews. There are exceptions: if she's hooked up to a polygraph or injected with Sodium Pentothal (truth serum).

I agree with a psychotherapist. The Anthony's have a narcissistic family dynamic. I think Casey is Cindy's Frankenstein. I also agree with Tim Miller from Texas EquuSearch: The Anthonys should go to Hollywood. Jesse Grund, Casey's ex-fiance, is an insightful young man who has also been sucked into the Anthony vortex; he'll be interviewed by Dr. Drew on July 7th.

I disagree with the circulated jury's theory that Caylee accidentally drowned and the Anthony's covered it up. I don't recall hearing evidence to support that. I don't understand the deductive reasoning of that jury.

They've been obstructing justice for their granddaughter ever since they opened that smelly trunk...more concerned about protecting Casey.

Father of Caylee reportedly was a one-night-stand and died in an MVA when Caylee was 1 or 2. This is loosely based on info Casey gave her mom.

Supposedly jurors are being offered 5-figure amounts for just simple interviews/statements. I'm sure Mr. Ashton is also getting a few pennies from his multiple recent appearances.

Lastly, interesting you mentioned porn. The people who originally offered her money for a triple-X withdrew their offer, stating, "We were ready to make an offer to Casey to star in one of our feature films. It's clear to me now, however, that there has been an overwhelmingly negative response to our offer and so we've decided to withdraw it. We now believe that we underestimated the emotional response that people are having to the verdict. A movie starring Casey Anthony is not what people want to see."

The State of Florida - not an expert

[ In Reply To ..]
I'm not sure, but I think either the State of Florida or Orange County can try to sue Casey Anthony. Also, the agency that set up camp to try to find Caylee is also considering trying to get back over $100,000 they invested in the search, with at least one of four of the Anthony clan knowing the child was already dead.

But I want to ask you this. If Casey was found guilty of first degree murder, would you still not want your tax dollars going toward her trial and her imminant execution?

It's interesting how some embrace our justice system only when it goes the way they "think" it should.

TAX DOLLARS - FL MLS

[ In Reply To ..]
If I had a choice where my tax dollars were spent I would not go for any of this corrupt court stuff or government. My tax dollars would be spent on the poor, the military, the environment, global warming, cleaning up the ocean, should I go on or do you get the just of where I am heading.

the point is you don't have a choice - not an expert

[ In Reply To ..]
unless you want to live in a country where the government chooses an accused's fate.

That's what everyone misses, and I know this falls on deaf ears, but AGAIN, my question is, if she was GUILTY, would you have a problem with your tax money going toward her trial?

I'm sorry, but I have just one more point to make - not an expert

[ In Reply To ..]
I might agree with you on the corrupt government. Had the government not been so bent on executing Casey, they may have charged her of what she could have been found guilty of.

Statistics show that Orange County is famous for overcharging and not getting convictions because it makes it impossible for a jury to go as far as they want them to on the evidence they offer.

Statistics from other counties in Florida that choose the low road when bringing a charge have a much higher conviction rates.

So I agree with you on this count. Orange County government does seem corrupt in that they make it nearly impossible for juries to put the guilty behind bars.

Tax dollars - mt1347

[ In Reply To ..]
I completely agree with you, FL MLS. I live in Florida as well and there are lots of places that could have used the money spent on that case. We have thousands of kids down here whose parents can't afford to feed and we feed them year round in our schools. Every month there are more mouths to feed as people lose their jobs and the price of everything goes up. The US Constitution says every accused is entitled to a trial and the Supreme Court ruled in Gideon that indigent prisoners are entitled to have their legal fees paid by the government. So, I never had a say in this use of my tax dollars. The state of FL is entitled to and probably will put a lien on Anthony's future earnings. She has felony convictions for writing bad checks on her friend's account, remember? If they prosecute her mother for perjury, that will be another Anthony they can put a lien on if they get a conviction. You can be sure that Lee and George will be getting scrutinized - this isn't over. It will drag out for years, just like the OJ thing. The people who put up money for Casey's bail, the ones who searched for Caylee - all of them are going to file lawsuits, whether they get anything back or not. I don't know if any man who ever marries this woman, Casey, would be liable for her legal mess or not, but it would take one strange guy to hook up with her.
but feeding children has nothing to do with - apples and oranges
[ In Reply To ..]
Feeding hungry children has nothing to do with every citizen of the US having the right to a fair trial. You can't just pick and choose who you think deserves a trial. Our constitution dictates this. This is one of many things that makes our country great.

Obviously the system doesn't always work. Some get away with crimes and others are executed for crimes they never committed, but it's better than any other justice system out there.

Regarding who's paying: The taxpayers of Florida did not pay for her lawyers (2 of which worked pro bono -- Baez has/will receive money from Casey -- she received over $200,000 for licensing rights from ABC for pics). Taxpayers did, however, pay for investigators, expert witnesses, etc., but she could be responsible for some of those costs and court costs (since she was found guilty of something) to later be determined.

I live in Florida also and am aware of the problems that exist here oh so well, but it's just not a fair comparison or argument to make that the money spent on a citizen's constitutional right can be magically shifted into a social program. I totally understand where you're coming from, though. This whole case is very sad.

Look at it this way... at least the taxpayers will no longer have to support her!! She has to do that herself and as you pointed out so well, it may not be so easy for her.

If you read my post, I didn't object to her getting a fair trial. I am well aware what the Constitution calls for - I have a graduate degree in political science and have taught Am National Govt to college students. I have a feeling it is a waste to respond to your post since you didn't understand my first one, but I hate when people inject their own assumptions into what others say. She is indigent and Baez was in fact paid thousands of dollars for legal expenses and the people of FLorida paid all her filing expenses, which add up, if you've never been involved in a lawsuit. We paid for all the prosecutors salaries, office expenses, expert witnesses, etc., and we paid for the police guarding all the people in this case, not just Casey Anthony herself. her parents alone have requires 10s of thousands of dollars in police protection in the last 3 years. Please do not put my words in my mouth. You can have any opinion you want, but don't twist mine to suit your purposes.
wow that was pretty harsh! - apples and oranges
[ In Reply To ..]
I didn't say you objected to a fair trial, I just said you really can't compare an alleged criminal getting a fair trial to feeding children. I could say you are trying to put words in my mouth, but maybe you just misunderstood my post.

You wrote: "I live in Florida as well and there are lots of places that could have used the money spent on that case."

I profusely apologize if you think I put words in your mouth, but the above statement implied to me that instead of the trial, the money could have gone somewhere else. I just don't get what one has to do with the other.

Again, my genuine apology. I obviously misunderstood your statement.

I also said basically what you did about who paid for what, except we differ a little on who paid for Jose. I only know what I read from a relable news source.

Please understand it was not my intention to disrespect you. Since you cited a case, it was clear you have legal knowledge.

My daughter graduated last year with a major in history (only because she was WAY too pationate about political science -- that was her first choice) and is entering a graduate program in the fall to teach history in a university atmosphere, so I respect your education and understand the challenges of meeting standards to teach on a college level.

Again, it was not my intention to put words in your mouth.

Your last sentence, "It's interesting how some embrace our justice system only when it goes the way they "think" it should." is so spot on.

I'm already so tired of the fake outrage. Take the EMOTION out of this. It's based on FACTS not FEELINGS.

The FACT is no one knows how the baby died. And the FACT is, you don't go to jail because you suck as a mom any more than you go to jail because you generally suck as a human.

Our court system is what it is. She was not found guilty for killing her daughter- NO ONE on this forum knows who killed her daughter or how the child died. Casey has served nearly 3 years in jail.

There are innocent people found guilty way too often. Our system is one of checks and balances. We have to respect the verdict and move on.

I copied/pasted this from www.BostonHerald.com:

In letters Anthony wrote to a fellow inmate, she mused about the money she could make once out of jail and plans for what she called a “partial memoir/comedy advice book for those not in the know. It’s a way to settle many rumors and to share my insight about love, life and most important, God.”

She actually wrote that.

She also said she dreams of being pregnant again and of adopting a child, “which even sounds weird to me saying it, but there are so many children that deserve to be loved.”

Jay Paul Deratany, who once represented a family in a wrongful death suit against CNN’s Nancy Grace, said Casey could be sued as well for Caylee’s wrongful death — either by her parents, Caylee’s biological father or a representative of Caylee’s estate. Because the standard of guilt in civil court is lower than in criminal cases, “There is a high likelihood in my opinion that a wrongful death lawsuit could win,” Deratany said, “and prevent Casey from recovering money from book deals, etc.”

Caylee's father might be the boyfriend who died in a car
