Republicans Block Paycheck Fairness Act

Posted: Nov 17, 2010

WASHINGTON -- Senate Democrats were unable to overcome a Republican filibuster of the Paycheck Fairness Act on Tuesday, with the chamber falling two votes short of the 60 needed to end debate and proceed to a vote on the measure that would help combat wage discrimination on the basis of gender.

LOL...now why would they do that?? ya think they are mean?? An even better question is, why do you insist on only posting HALF the story so slantedly instead of laying it all out there?

Fair pay is not a bad thing. However.... - sam

I am going to do the due diligence and find out what the contents of the bill are to see if there are any other items that someone might wish pushed through on the "fair pay" skirt tails. I don't take anything at face value. Sometimes it would behoove members of Congress on both sides to just put one thing they would like passed in a bill instead of trying to tack unpopular things onto popular things so they will pass. Sometimes all that accomplishes is the bill does not get passed and then they start screaming that the opposite side is against fair pay...which may not be the case at all. I just like to get the whole story before I make up my mind.

That procedure of tacking bad stuff on good stuff to pass it is not owned just by Democrats...both sides do it and it stinks.

The jury is out on the bill until I can find it and read it.

One might well ask ... - anon

[ In Reply To ..]
What was the purpose of the law? Was it to provide for equal pay or was to enrich lawyers? If the purpose of the law was to ensure equal pay then it would have been far better to pass a law even with caps on lawsuits. Certainly, there needs to be punishment for those who do not comply, but that is not the overriding purpose of the law. The Democrats chose not to present such a law, prefering one they knew would not pass. For independents like me, it makes me wonder whether they are more concerned with winning brownie points with their supporters or actually righting a wrong.

Good point. Well we already know where this administration... - sam

stands on trial lawyers. Hence the missing tort reform from the health care bill (trial lawyers have a powerful lobby and they are big time donors to the DNC...one of them was a politician until his dirty laundry fell out of the bag..think we all remember him).

Tort reform would be a big step in controlling health care costs, so if that was REALLY this administration's goal (other than insuring 30 million people who largely were are uninsured because they choose to be), why not put it in the bill? The good ol' boy you scratch my back and I'll scratch yours.

Yet again, the people get hosed.
You believe it is bad to actually enforce laws - as you know, we choose our problems
[ In Reply To ..]
The only thing left to say to you is please be happy with what you get with your Republican House.

"30 million people who largely are uninsured because they choose to be." That is sooo a Republican talking point. You haven't noticed the people who have gotten sick and can't work and make their insurance payments? You apparently have no idea how much the "Cobra" payments are. You apparently have no idea what the cost of private health insurance is--you obviously are not an MT. Really. 30 million "choose" not to have health insurance?

So, I also "choose" to work for 75 cents on the dollar of what a man makes for similar work. (If I made that much!) and then have no recourse to stop the practice?

Your beloved Republicans are already stalling and digging in their heels with the new session. Is it because they are so confused? Maybe just lazy? Or like I have said before--more interested in playing politics then solving problems? You complain about the Speaker, but you still have the same old, same old for the leadership; McConnell, who has said his goal is that Obama be a one term president. Gosh, is that patriotic of your side? We were supposed to sit back and support Bush through all those painful, over-the-cliff years, and your side cannot be patriotic enough to support the president for 2 years, much less 4. Shame on you and your bunch.

Let me address your points one by one... - sam
[ In Reply To ..]
First...they are not my beloved Republicans. I don't know why you Democrats cannot get it through your heads that just because someone does not agree with you they are Republicans. I have said things on this board not flattering to Republicans, but they don't automatically assume I am a Democrat. You really think only Republicans have a problem with this current administration? Did the mid-terms not tell you anything either?

Now with that out of the way...you said don't I believe in enforcing the law. Yes I do. Trial lawyers suing for every little thing in CIVIL not criminal court and making millionaires out of themselves to me is not enforcing the law. Tell me why YOU would oppose tort reform...meaning putting a limit on how much you can sue for. There are millions of lawsuits every year that ruin lives and businesses that should never have even been filed. And then you have the frivilous ones filed to make a point which cost the taxpayers untold millions. I see absolutely NO reason NOT to cap how much you can sue for. I cannot understand why you would be FOR that. THAT is a major component to the bill. Take THAT out, and the Fair Pay bill would then be the Fair Pay Bill.

You said: "30 million people who largely are uninsured because they choose to be." That is sooo a Republican talking point. (Not a Republican talking point? Have you researched it? Obama administration admitted it. That is why they added the clause to the health care law that carrying health insurance was mandatory. Because they knew that those 30 million STILL would not carry insurance if not forced to. You really need to research before jumping people).

You haven't noticed the people who have gotten sick and can't work and make their insurance payments? (Obamacare is not going to help you there...you still have to pay insurance premiums. It is not a freebie. They took out the public option).

You apparently have no idea how much the "Cobra" payments are. (oh yes I do, I paid COBRA payments between my last job and this one).

You apparently have no idea what the cost of private health insurance is--you obviously are not an MT. (oh yes I am an MT, and oh yes I know the cost of private health insurance. I budget for it. It is a fact of life. Yes, I have to give up things to be able to pay for it. I do NOT expect YOU or anyone else in this country to pay for it FOR ME. How terrible is that???).

Really. 30 million "choose" not to have health insurance? (yes, they do. Again, Obama Admin admitted this from their own studies. Most of the 30 million are the 20-somethings into the early 30-somethings who prefer to "roll the dice" that they will not get a catastrophic injury or illness because they, like you apparently, want to spend that money on something else. Again, that is why the health care bill was made to contain making carrying insurance mandatory).

You said: So, I also "choose" to work for 75 cents on the dollar of what a man makes for similar work. (If I made that much!) and then have no recourse to stop the practice? (Again, you need to do your research before jumping all over people. Number one, there are already discrimination laws in place to prevent that. This one only expounds on it, for the sole purpose of making the amount you can sue for limitless. That on the face of it is just cronyism with trial lawyers in payback for the big DNC contributions. Same reason they left tort reform OUT of the health care bill. To appease trial lawyers. That's what politicians do, unfortunately, on both sides. There are already laws in place about discrimination. And last time I looked, male MTs do not make more than female MTs).

YOU SAID: Your beloved Republicans are already stalling and digging in their heels with the new session.
ANSWER: Hard to know where to begin on this one....you accused me of Republican talking points and every bit of this paragraph is Democratic talking points. #1...I frankly don't see the Republicans digging in their heels. I see them as, so far, having listened to the people who spoke loud and clear in the mid-terms, and trying to do what the majority of people who elected them want. Isn't that what a Democracy is? You no longer believe in Democracy? It is only working if Democrats win? Now how patriotic is THAT idea? #2: If when you say "we" you mean the Democratic party, they did NOT sit back and be patriotic and supportive of Bush. They never were. It was mean, ugly, cruel and PERSONAL. One thing I have NOT seen from the conservatives and Republicans posting here is personal attacks on OBama or his family. I have seen malicious, cruel, horrible things said about Bush, about Sarah Palin and her family and she is not even in public office anymore. Sorry, friend, but your "we" at least on this board have absolutely no moral high ground to stand on in that issue. Yes, things have been said about Obama's job as President. And right now that pretty much sucks. In my estimation, I took him at his word that he was going to unite us and be a President for ALL of us. Sadly, his attitude is just like yours. My way or the highway. He completely ignored what over half the country wanted and pushed through Obamacare anyway, and "your" party paid for it mightily in the mid-terms. Do YOU think that is what a President should do? Ignore the wishes of the majority of the people (again, that is what a democracy IS) and push through what only HIS PARTY wants? Well, a good deal of the American voting public finally woke up and said we don't give a dang about parties anymore and a bunch of Democrats (the conservative and moderate ones) agree with that, otherwise "your" party would not have taken the shellacking it did.
#3: Honestly, Mitch McConnell only spoke what political parties always think. It is always the goal of the party that is out to make the party that is in one-term. That is why I HATE political parties. He just said what they all THINK, on BOTH sides. The thing that people don't like about Nancy Pelosi is the same thing they don't like about Barack Obama. Its that in your face arrogance and not listening to the majority. The majority is tired of it, that's all.
#4: Republicans don't support Obama for 2 years much less 4. Well, let me see. He did inherit some of the debt from Bush. No doubt about it. However, no one twisted his arm and made him add trillions to it in his first year and 9 months, and his budget is set to show he will be the biggest spender in history. In a time when we are more in debt than we ever have been and China holds more of that debt than they ever have. Why on earth should that not alarm you as an AMERICAN CITIZEN (if can think independently for one single moment outside the Democrat mindset)? The fact that Obamacare will add 3 trillion plus MORE to that deficit over the next TEN years? That is not a Republican/Democrat thing, that is common sense. NO! It needs to stop. Have you even thought about the consequences for your kids, and their kids?

You need to stop being so invested in a political party and get invested in your COUNTRY. Can you honestly say that you think adding 3 trillion to debt that is already crippling your own country is a good idea? Why? Because the DNC says so? Honestly??
Sam, that was beautiful!! - I have always

hoped that I would never get so caught up in a party that I would lose sight between right/wrong and common sense. I am mostly Republican, but I have voted Democratic for people that I really thought would work for the people and not be clouded by parties. My Democratic governor (one of whom I did vote for) has been a wonderful governor and is totally against healthcare reform and has stood up against it. It is nice when you see people who can cross parties lines for what the people who voted them in want.

I view myself as conservative, but am a registered Independent. A party does not get my vote, a man or a woman gets my vote. And no matter what party they are affiliated with, if they put the will of their constituents above the will of the party if it comes to that, I have the greatest respect for that person. I long for the day when politicians will again view public service as an honor and not a highway to power.

back in the '70s. It was against the law back then to pay women less than a man for doing the same job. We women found out the men were getting $1 to do what we were doing and WE TOOK THEM TO COURT AND GOT ALL OUR BACK PAY.

Why is this being rehashed again when there is already a law on the books about equal pay?

I really don't understand why a law already in place is ignored and the lawmakers make up new bills that are a mirror image of the old law. Surely, there are better things to do.
The point of this bill...no cap on the amount they could sue for.... - sam
[ In Reply To ..]
is included in this "Fair Pay Act." Typical Washington...attach the stinky part to a positive part, knowing it proabbly won't pass, but so you can, in 2012, say Republicans are against Fair Pay...when all the while Fair Pay was not the issue. They think this tac still works.

It is a win-win for the Democrats in their eyes. If it DID pass, the trial lawyers reward them with even larger contributions to the DNC and Dem candidates. If it fails (which it did) the Dems have their talking points for 2012.

What they don't seem to realize was another message of the mid-terms: We don't want to hear what the other guys did or didn't do, we want to hear what YOU are going to do.

They don't give a darn about getting anything done this session other than ammo for 2012. And they honestly think we are not onto them.

for more than what we were owed in back wages. We were given exactly what we were owed and not one cent more. It was equal pay for equal work. We didn't use a lawyer. We went through the DOL (I think, can't remember).

This is the way it should have been and this is the way it should be now. Why should they make another law for one that is already in place?

Laws on top of laws just makes everything unworkable. Let's look at the laws we have now and work with those laws before wasting time making new ones. Repeal the ones that don't work and replace those with new ones.

That's how I feel.
Agreed. I take the same approach to runaway govt spending... - sam

there's an explanation. It is mainly to protect small businesses from excessive litigation. The bill put no caps on punitive damages. It's akin to tort reform for doctors. The more they have to pay to protect their butts the higher the cost for all of us in the end.

Don't get me wrong....I support equal pay for equal jobs. I'm just not sure this was the way to accomplish that. The left will use this to paint Pubs in a bad light. The shoe's on the other foot now and they'll take every opportunity to make the Pubs look like heartless, chauvinistic pigs who don't care about women.

From the article at the Hotair Post.....

"I support equal pay for equal work. I voted in favor of the Lilly Ledbetter Fair Pay Act last year because I believed the Supreme Court decision in the Ledbetter v. Goodyear Tire and Rubber Company case placed an unreasonable burden on a worker's ability to seek recourse in wage discrimination cases because it did not take into account the realities of the workplace. However, I am concerned that this particular legislation would unnecessarily impose increased costs and restrictions on small businesses in an already difficult economic climate. By eliminating caps on punitive and compensatory damages, this bill would expose the small business community to excessive litigation, force employers to devote significantly more resources toward legal protections, and could stunt job creation, ultimately hurting those its supporters say they're trying to protect.
In addition, this bill would require businesses to disclose previously confidential salary information to the government, and it relies upon faulty methods for identifying wage discrimination. That is why many business groups oppose this legislation, including the National Federation of Independent Businesses, our nation's largest small business advocacy group, and the U.S. Chamber of Commerce."

It is simple--if you don't discriminate you won't - be sued. Good law.

[ In Reply To ..]
I can see where companies would try to decrease men's wages to downward equalize, though. Same thing US Chamber of Commerce trying to do with offshoring of jobs.

See above for different perspective on offshoring. - sam

[ In Reply To ..]
there are always 2 sides to every story.

"If you don't discriminate you won't be sued." That is kind of a broad generalization, don't you think? I thought we already had legislation relating to equal pay for equal work that was passed back in...2008?

All this one is for is to squeeze in the no limits on lawsuits. It doesn't say they can't be sued...it just limits the amount they can obtain by suing. I guess you think they should be able to sue for millions, bankrupt the company, and all those people lose their jobs, and somehow that is justified?

Try thinking of the BIG picture instead of just how it will benefit YOU. :)

The bill does contain the no caps on lawsuits addition... - sam

[ In Reply To ..]
so the name of the bill on the face of it is misleading. That is why you always need to look below the surface to get the whole story.

I smell the trial lawyers up to their elbows in this one. Explains why the Democrats tacked that provision in and called it Paycheck Fairness. Again, they hope that people will just react to buzzwords and not check to see what really is in the bill.

It seems pretty evident now they really don't care whether it passes or not so they use defeat of it in 2012 against the Republicans. Here we go again with the we're good they're bad and here are all the reasons they're bad. Sigh.

The problem is...common folk are onto that trick now of burying the stinkers in an otherwise okay bill and will be watching any bill, whether brought to the floor by a Republican or a Democrat.

Geez. I think all congresspeople ought to have one term, no more, and they should not have a retirement package that the rest of us will never come close to seeing. But that's another story.
