Shorted on paycheck

My boss shorted my paycheck 2 1/2 days. 2 days, he said he "forgot I worked those days", and the half, he said I didn't clock in so he didn't have to pay me. (I submitted notice as soon as I realized that error, same day, within the hour)

I've never had pay withheld for forgetting a time punch. Can he do that? Does anyone have any infomation about the legality of that?  I mean, I was there, did a WHOLE bunch of work and can absolutely prove that I was there! The computer shows me logged in for the whole day! 

I did get a check, but true to his word, he only paid me 2 days, not the half. I don't make a lot of money by any means, and that half is 85 bucks I could sure use. As it is, because of the error, I incurred late fees on a couple of payments, because I had to wait until today for the rest of my money.

I am so upset I can't even speak to him...

to pay you for the work done will result in DOL report and investigation. What a complete jerk!

If he says he doesn't care about he DOL then I'd let him know that your lawyer will be in contact then. Show him that he is not the one in control!

What this doctor did is not right, but simmer down. I agree with the poster who said to have a frank discussion with him first. Being a bully going in with all barrels is immature, not to mention can get your butt fired.

If you have to take action after this frank discussion, then do it in a professional manner. Firm, but professional, and don't back down.

I would have a frank talk with him and let him know this is unethical. Tell him since you did not get paid, would he like it if you "un-do" the work that you did. DO NOT LET THIS GO. State directly that you earned pay for that half day and you expect to be paid for it. If he says you did not follow the rules, I would get a little angrier, but I would not let it go. Ask him how much money he saves by doing this to people. State what this is doing to your working relationship, and that he is basically cheating. I would use those words before I made any forceful threats. What a scumbag.

He is very well aware that I was there. I told him that I was very upset, that I had every intention of leaving then and there if he refused to pay me. I actually had to step out for a bit to cool down and told him I was taking that time (off clock!) to compose myself. In that time I checked with the DOL, submitted just an inquiry, and was advised that if I could indeed prove that I worked (logged on system, had co-workers as witnesses…) that he DOES HAVE TO PAY ME!

He came into the lobby after a bit and insisted still that he was right and was going to "write me up" for leaving my station and speaking rudely to him. I told him what I found out and he very rudely again, told me to "cool my heels" and that he had already decided to pay me, but I needed to get back to my desk.
It was laughable to say the least.

It's been very uncomfortable since that time, I think he's crossed that trust/reliability/professional threshold for me. I've been job hunting and plan to leave as soon as find another job, or sooner.

He's been bullying EVERYONE at work since that time, being ugly and trying to assert his I AM A GOD status. I apologized to my gals for being the thorn in his side, the cause of his wrath, but ultimately it's on him. He's even taken attitude with some of our patients!

I may or may not have handled it well, I just did it my own way and got my little check. (which was 58 bucks, not 85 by the way. I miss typed on the OP. Can't remember the last time I earned a decent wage even after 35 years experience)

Anyway, I thank you for the input. It's not right that in this day and age someone be so darn harsh that they aren't willing to pay you for work done. And that's the bottom line. I WORK for my pay, I'm not a volunteer. I earn and demand respect in the workplace too. It is his private practice, but I'm not a slave.

The words you used in your post: he crossed the line of trust, professionalism, and respect, as well as the fact that you work for this pay, earn it, and you are not a volunteer. Remember these words. I think you are going to need them again. The DOL is a good idea if you have no other choice, but do not threaten him with a lawyer over $58. That is ridiculous. No lawyer would even bother with it.

I have found that most workplace bullies like this (even though it is a private practice) tend to back down when confronted with their actions, etc. Note that I said confronted, not confrontational. You have to maintain a sense of professionalism even when others do not. This wrath and attitude of his should be addressed directly and professionally. If he says something totally out of line, do not be intimidated. Say something like, "Was that really necessary," or "I am sorry you feel that way, but ....." If he is rude ask him, "Is there a problem you need to address." STAY CALM no matter what. If you do this several times and let him know you are not intimidated, you are there to work, and it is he who is making the workplace uncomfortable, he will probably stop.

When I worked in-house, there was a doctor who had the god complex. He would get me to do personal typing for him. I had to drop whatever I was doing for him. One was rather lengthy, and when I told him one of the pages would not fit all on 1 page, to do so and so, forget, he insisted on his way. It looked awful. He asked me to do it over differently. I said, "The way I originally discussed with you?" He said very sternly, "Hey, it's called a JOB." I said, "I am well aware of that. I work by the hour, it's your dime, and I will do it as many times as you want all day long." He busted out laughing and said "touché."
