Health care law saves consumers over $1 billion Health care law provides rebates to more than 12 million consumers Today, Health and Human Services (HHS) Secretary Kathleen Sebelius announced that 12.8 million Americans will benefit from $1.1 billion in rebates from insurance companies this summer, because of the Affordable Care Act’s 80/20 rule. These rebates will be an average of $151 for each family covered by a policy. The health care law generally requires insurance companies to spend at least 80 percent of consumers’ premium dollars on medical care and quality improvement. Insurers can spend the remaining 20 percent on administrative costs, such as salaries, sales, and advertising. Beginning this year, insurers must notify customers how much of their premiums have been actually spent on medical care and quality improvement. Insurance companies that do not meet the 80/20 standard must provide their policyholders a rebate for the difference no later than Aug. 1, 2012. The 80/20 rule is also known as the Medical Loss Ratio (MLR) standard. "The 80/20 rule helps ensure consumers get fair value for their health care dollar," Secretary Sebelius said. Consumers owed a rebate will see their value reflected in one of the following ways: •a rebate check in the mail; •a lump-sum reimbursement to the same account that they used to pay the premium if by credit card or debit card; •a reduction in their future premiums; or •their employer providing one of the above, or applying the rebate in a manner that benefits its employees. Insurance companies that do not meet the 80/20 standard will send their policyholders a rebate for the difference no later than Aug. 1, 2012. Consumers in every state will also receive a notice from their insurance company informing them of the 80/20 rule, whether their company met the standard, and, if not, how much of difference between what the insurer did or did not spend on medical care and quality improvement will be returned to them. For the first time, all of this information will be publicly posted on HealthCare.gov this summer, allowing consumers to learn what value they are getting for their premium dollars in their health plan. For many consumers, the 80/20 rule motivated their plans to lower prices or improve their coverage to meet the standard. This is one of the ways the 80/20 rule is bringing value to consumers for their health care dollars. ;

I went to this web site and since I have been turned down for health insurance due to a preexisting condition, I did the "policy finder." It said my new health insurance monthly rate would be about $300 a month. I am in tears from happiness. Really.

I didn't get a dollar and 74 cents back, no. I did have lower premiums by more than 100.00 and my copays were smaller too. That I do miss. Oh, and my job.

at an increase of 131% your 2009 family coverage would cost you almost $700. The 10 years after 2009, the trajectory (trend) of health insurance increase was on track to increase by around 160%, so in 2019, your family coverage would be projected to be about $1800 per month. I will not be able to afford that then. I am very encouraged that the cost actually will be going down or staying the same.

I don't get paid much, but my line count is okay, as is my accurancy, and my company does have health insurance--so I just keep pounding the keyboard just for the health insurance access. I now have eye problems, arthritis and high blood pressure. When I tried to get private insurance, I was refused. When ObamaCare is fully implemented in 2014, I am quitting because insurance companies will not be able to turn me down based on pre-existing conditions. I can't wait. 1-1/2 more years. Counting down.

Clear you have no idea that the "hidden taxes" affect 77% of those making between $ 25,000 to approximately $150,000. Better hope your income drops to LESS THAN $9500.00 and stays there. Otherwise, you'll need more than fingernails to hang on by.

the 80/20 ACA provision requiring health insurance companies to spend no less than 80% of premium payments on medical care and no more than 20% on administative expenses, salaries, CEO bonuses, etc. The requirement for large group plans with more than 50 employees is 85%/15%. Any amount that falls short of this goal must be returned as a rebate.

The rebate is not intended to be a stimulus of any kind and it is not a reward for buying health insurance. It is a consumer protection and transparency tool that requires disclosure of how premium monies are being used. If your employer is contributing to your health insurance expenses, they receive part of the rebate as well. The carrier determines how rebates are disbursed, i.e. direct refund, discount against future premiums, and what proportion is returned to the employer vs employee.

This year 12.8 million policy holders will receive $1.1 billion.

who plan on refusing to expand Medicaid or set up exchanges. They're sulking and pouting while waiting for the GOP takeover, like a bunch of spoiled brats. Ask employers who will refuse to insure their employees and choose to pay the penalty since it's cheaper. Nothing's stopping you from doing the same. If you can afford insurance and refuse to accept responsiblity for your own health care, you can opt for the slacker's tax instead. If you can't afford it, you won't owe the penalty.

While mulling this over, ask yourself how it feels for a driver who complies with the law by carrying auto liability coverage gets slammed by a drunk driver who thinks the law doesn't apply to them. Your car is totalled, you or one of your family members is all banged up, gets whiplash or breaks a couple of limbs, maybe suffers a significant head injury, etc, is laid up for months, not able to work. You have the pleasure of doing all the uninsured motorist claim work, that is of course, if you bought that coverage, hassle around with rental cars (or not, if you didn't buy that coverage) car repairs or buying a new car, and on top of all that, you get to go through a bunch of legal expense, perhaps file a law suit for damages...on and on and on. Now imagine that happening to hundreds or thousands in your auto insurance risk pool. Lo and behold! They have to raise the premiums to keep the profits coming in, keep the shareholders happy, and pay their CEOs huge bonuses.

Yeah, that's the ticket. Join those GOP govs and tell Obama and the rest of us to "shove it!" Just become one of the uninsured slackers, and take your place with all the other moochers living on the margin while the rest of us reap the benefits of our health care policies, some for the first time in their lives.

any time the government decides what you get is considered socialism. In the case of Medicare and/or Medicaid, the government decides what drugs you get, what treatment you get, and how much will be paid - no negotiations. And no, this is not like private insurance where if you're not happy with the coverage you recieve, you're free to buy from a different company and if you're turned down for something, you can appeal that decision. Not so with government-controlled Medicare/Medicaid.

To talk about this it is necessary to put the word "tax" and OTC meds in the same sentence. Other than that, the claim that aspirin or any other OTCs will be taxed is false.

Prior to ACA, money spent on OTCs was exluded from DEDUCTIBLE medical expenses. The new rule only applies to those who have health savings accounts (HSAs), flexible spending arrangements (FSAs) and health reimbursement arrangements (HRAs). The allowance for OTCs to be purchased with PRE-TAX dollars has been eliminated, simply making the OTC exclusion from medical expense deductions universal. Even this miniscule change can be dodged by having your MD write a prescription for your OTCs. None of the changes apply to the purchase of insulin.

Whether or not OTCs are taxed varies from state to state, but there is no new federal tax rule on OTCs in ACA.

Clearly, their understanding of what constitutes a deductible medical expense and what doesn't is far superior to argumentative, uninformed Obama haters who rely on chain emails and the media outlets that give birth to them for their information. It's concise explanation is uncomplicated and leaves no room for doubt that there is no tax on OTCs and that FSAs and HSAs are no longer allowed to use pre-tax dollars to cover those expenses....just like any other taxpayer.

First Wave:
Expiration of 2001 and 2003 Tax Relief
In 2001 and 2003, the GOP Congress enacted several tax cuts for investors, small business owners, and families. These will all expire on January 1, 2011:

Personal income tax rates will rise.
The top income tax rate will rise from 35 to 39.6 percent (this is also the rate at which two-thirds of small business profits are taxed). The lowest rate will rise from 10 to 15 percent. All the rates in between will also rise. Itemized deductions and personal exemptions will again phase out, which has the same mathematical effect as higher marginal tax rates. The full list of marginal rate hikes is below:

- The 10% bracket rises to an expanded 15%

- The 25% bracket rises to 28%

- The 28% bracket rises to 31%

- The 33% bracket rises to 36%

- The 35% bracket rises to 39.6%

Higher taxes on marriage and family.
The "marriage penalty" (narrower tax brackets for married couples) will return from the first dollar of income. The child tax credit will be cut in half from $1000 to $500 per child. The standard deduction will no longer be doubled for married couples relative to the single level. The dependent care and adoption tax credits will be cut.
The return of the Death Tax.
This year, there is no death tax. For those dying on or after January 1 2011, there is a 55 percent
top death tax rate on estates over $1 million. A person leaving behind two homes and a retirement
account could easily pass along a death tax bill to their loved ones.

Higher tax rates on savers and investors.
The capital gains tax will rise from 15 percent this year to 20 percent in 2011. The dividends tax will rise from 15 percent this year to 39.6 percent in 2011. These rates will rise another 3.8 percent in 2013.

Second Wave:
Obamacare

There are over twenty new or higher taxes in Obamacare. Several will first go into effect on January 1, 2011. They include:
The "Medicine Cabinet Tax"
Thanks to Obamacare, Americans will no longer be able to use health savings account (HSA), flexible spending account (FSA), or health reimbursement (HRA) pre-tax dollars to purchase non-prescription, over-the-counter medicines (except insulin).

The "Special Needs Kids Tax"
This provision of Obamacare imposes a cap on flexible spending accounts (FSAs) of $2500 (Currently, there is no federal government limit). There is one group of FSA owners for whom this new cap will be particularly cruel and onerous: parents of special needs children. There are thousands of families with special needs children in the United States, and many of them use FSAs to pay for special needs education. Tuition rates at one leading school that teaches special needs children in Washington , D.C. ( National Child Research Center ) can easily exceed $14,000 per year. Under tax rules, FSA dollars can not be used to pay for this type of special needs education.

The HSA Withdrawal Tax Hike.
This provision of Obamacare increases the additional tax on non-medical early withdrawals from an HSA from 10 to 20 percent, disadvantaging them relative to IRAs and other tax-advantaged accounts, which remain at 10 percent.


Third Wave:
The Alternative Minimum Tax and Employer Tax Hikes
When Americans prepare to file their tax returns in January of 2011, they'll be in for a nasty surprise-the AMT won't be held harmless, and many tax relief provisions will have expired.
The major items include:

The AMT will ensnare over 28 million families, up from 4 million last year.
According to the left-leaning Tax Policy Center, Congress' failure to index the AMT will lead to an explosion of AMT taxpaying families-rising from 4 million last year to 28.5 million. These families will have to calculate their tax burdens twice, and pay taxes at the higher level. The AMT was created in 1969 to ensnare a handful of taxpayers.

Small business expensing will be slashed and 50% expensing will disappear.
Small businesses can normally expense (rather than slowly-deduct, or "depreciate") equipment purchases up to $250,000. This will be cut all the way down to $25,000. Larger businesses can expense half of all of it will have to be "depreciated."

Taxes will be raised on all types of businesses.
There are literally scores of tax hikes on business that will take place. The biggest is the loss of the "research and experimentation tax credit," but there are many, many others. Combining high marginal tax rates with the loss of this tax relief will cost jobs.

Tax Benefits for Education and Teaching Reduced.
The deduction for tuition and fees will not be available. Tax credits for education will be limited. Teachers will no longer be able to deduct classroom expenses. Coverdell Education Savings Accounts will be cut. Employer-provided educational assistance is curtailed. The student loan interest deduction will be disallowed for hundreds of thousands of families.

Charitable Contributions from IRAs no longer allowed.
Under current law, a retired person with an IRA can contribute up to $100,000 per year directly to a charity from their IRA. This contribution also counts toward an annual "required minimum distribution." This ability will no longer be there.

Now your insurance is INCOME on your W2's......

One of the surprises we'll find come next year, is what follows - - a little "surprise" that 99% of us had no idea was included in the "new and improved" healthcare legislation . . . the dupes, er, dopes, who backed this administration will be astonished!

Starting in 2011, (next year folks), your W-2 tax form sent by your employer will be increased to show the value of whatever health insurance you are given by the company. It does not matter if that's a private concern or governmental body of some sort. If you're retired? So what; your gross will go up by the amount of insurance you get.

You will be required to pay taxes on a large sum of money that you have never seen. Take your tax form you just finished and see what $15,000 or $20,000 additional gross does to your tax debt. That's what you'll pay next year. For many, it also puts you into a new higher bracket so it's even worse.

here are some key points, from FactCheck.org:

â�â The penalty/tax will be phased in from 2014 to 2016.
â�â The minimum penalty/tax in 2016 will be $695 per person and up to 3-times that per family. After 2016, these amounts will increase at the rate of inflation.
â�â The minimum penalty/tax per person will start at $95 in 2014 (and then increase through 2016)
â�â No family will ever pay more than 3X the per-person penalty, regardless of how many people are in the family.
â�â The $695 per-person penalty is only for those who make between $9,500 and ~$37,000 per year. If you make less than ~$9.500, you're exempt. If you make more than ~$37,000, your penalty is calculated by the following formula...
â�â The penalty is 2.5% of any household income above the level at which you are required to file a tax return. That level is currently $9,500 per person and $19,000 per couple. The penalty on any income above that is 2.5%. So the penalty can get expensive quickly if you make a lot of money.
â�â However, the penalty can never be more than the cost of a "Bronze" heath insurance plan purchased through one of the state "exchanges" that will be created as part of Obamacare. The CBO estimates that these policies will cost $4,500-$5,000 per person and $12,000-$12,500 per family in 2016, with the costs rising thereafter.
So, basically, you're looking at penalties of approximately the following at the following income levels:
â�â Less than $9,500 income = $0
â�â $9,500 - $37,000 income = $695
â�â $50,000 income = $1,000
â�â $75,000 income = $1,600
â�â $100,000 income = $2,250
â�â $125,000 income = $2,900
â�â $150,000 income = $3,500
â�â $175,000 income = $4,100
â�â $200,000 income = $4,700
â�â Over $200,000 = The cost of a "bronze" health-insurance plan
The IRS will collect the penalty-tax, a fact that will no doubt further enrage those who hate Obamacare.
But here's some more good news for those folks:
The IRS will not have the power to charge you criminally or seize your assets if you refuse to pay. The IRS will only have the ability to sue you. And the most the IRS can collect from you if it wins the suit is 2X the amount you owe. So if you want to thumb your nose at the penalty-tax, the IRS won't be able to do as much to you as they could if you refused to pay, say, income tax.
By the way, the following folks will be exempt from the penalty-tax:
â�â Those who make less than $9,500
â�â Employees whose employers only offer plans that cost more than 8% of the employee's income
â�â Those with "hardships"
â�â Members of Indian tribes
â�â Members of certain religions that don't pay Social Security tax, such as Amish, Hutterites or Mennonites.

BTW - BEFORE YOU GET 1 dime of Federal subsidy, you have to PROVE you purchased insurance, the least expensive comes to approximately $1500.00 for a family of 4 with an income of $ 30,000 (monthly income approximately $2500.00 less paid insurance for family of 4, $ 125.00 monthly = GROSS monthly drops to $2375 - now deduct ALL the other payroll taxes (some increases due to Obamacare), rent/mortgage, homeowners insurance, car insurance, out-of-pocket medical expneses not covered by Obamare which are substantially increased, medical copays, prescriptions, food, gas, electric, phone, sewage, repairs...what do you have left? And the hits don't stop there. Betcha those Hutterite colonies are looking pretty good right about now.
