To those of you who are single and filed chapter 13

I am a soon to be single mother with 2 kids. I can't do it anymore, I have to file bankrupcy. Just curious if you filed how much you had to pay back each month

Credit is ruined with either one. With the wages we receive, I could not afford to "pay back" every month. Not proud of myself but I had no other choice.

but i'm afraid wage garnishments will start soon. Plus like I said I won't have a car payment. I hate to be in this spot!

Divorced with 5 kids. The attorney was great. It was not easy as I had not been late on anything...I almost always paid on time and still had decent credit, but with the divorce, I could not do it.
I felt better when I was in court and another guy was there for the second time....
You will start getting letters and offers immediately to start re-establishing credit. I have one credit card with 700$ limit. I also kept my cars and house. I get offers for car loans almost daily.
Your attorney should be able to tell you which way to go.

Bankruptcy as you probably know stays on your credit report for at least 7 years. My advice, do Chapter 7; you will be fighting a losing battle with Chapter 13.

The first 4 years not a problem. Income was stable and able to pay the 525 a month (up from 475 after nearly the first year). However, with job changes etc.., I am now struggling to pay the very last 6 months. Almost got kicked out but managed to pull some strings (which put me in more debt in all actuality). In Chapter 13, just hope there are no income changes in 5 years because apparently it will not change your payment no matter what.. You are just stuck..

Do some research and think about what is important for you and family. Then get an attorney. Research them thoroughly on the internet, read their blogs and many will give you a free consult. Please do not feel ashamed. All who have gone through this feel that for awhile, but you have to survive. If you do not want to keep a house, do a 7. We were forced into BK 5 years ago by cuts in his hours and especially my loss of income (i.e., that fabulous income that we in this field used to have that is no longer) and horrid house that wouldn't sell for multiple years due to RE and economy crash. Tried a 13 first, thinking to try and keep the house, and when we realized the house was the "root of all our evil," converted to 7 and surrendered the house. Best thing we ever could have done. Re-established credit as soon as case was closed. If you have any 401Ks or IRAs, they will not take from you. It is better to do the 7 sooner than to allow your credit to be hit month after month with late pays or collections. We have a much better life now than before, having learned to live with less and are happier now than before. I was able to stop struggling to continue making it in this losing trade and find another type of employment. Please do not let anyone make you feel bad about your decision. You must do what works for you and your family, I.e., food on the table and a roof over your head. God bless and go to it!!

With a 7, you don't have to give up anything, it's really up to you as long as you can pay for it. I kept my house even though it was listed on my bankruptcy, but as long as I pay the mortgage I can stay. When I stop paying, they will simply foreclose. I've been living in my house for 3 years now since bankruptcy. You'll get offers to start rebuilding your credit. Whatever you keep after 7, no longer gets reported on your credit reports so even when I do get behind in my mortgage it doesn't affect my credit, but it is important that whatever credit card you get that you keep it paid on time and that will help rebuild your credit. I got one credit card after bankruptcy, have kept it paid on time, and it has helped me bring my credit from below 500 to 700 (last I checked). Took 3 years though.

I was not in that much debt, listened to an ex-husband. Having said that everything wiped clear, did cash only for years and when I finally decided to try credit again was like I never had the bankruptcy in the first place. I now have excellent credit and have no problems buying on time (if I want) anything. I no longer even put down I ever went that route, no use because the slate wiped clean after so many years.

and they said I could keep car and house in either case, 7 or 13. I just am nervous about my husband moving out soon and taking his income that's why I asked what the repayment would be. I know when we were married and his income counted it was over $300 a month and that included my car but I will be done paying it off in a couple of years. I'm just afraid I will have wage garnishments soon if I don't do something.
