There is no such thing as a hit and run on this board. People are still here and nobody left the scene of the accident. Hit and run is a term associated with a motor vehicle accident, not a poster who posts messages. We can post whatever we want. As my momma used to say, if you don't like it don't look.

Nobody should be on this board thinking they are here to "teach a lesson" to those they don't agree with. To continually post like that is a juvenile response. I've been reading up on this. It is not what Reid and others stated. Here's what I found ( - Backwards Typist

Granted, it in high-falutin' text, not my words except for the last paragraph. The document was 26 pages long and there were over 3,000 comments/letters mostly against allowing the EPA to have the more authority. The first is a bill introduced back in 2009:

To limit the applicability of a certain judicial ruling to sources regulated under section 202 of the Clean Air Act.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
This Act may be cited as the `Clean Air Protection Act'.

SEC. 2. ESTABLISHMENT OF STANDARDS.
Notwithstanding any other provision of law, the decision and holding of the Supreme Court of the United States in Massachusetts v. Environmental Protection Agency, 549 U.S. 497 (2007), and any establishment of standards resulting from the proposed rule published by the Administrator of the Environmental Protection Agency entitled `Proposed Endangerment and Cause or Contribute Findings for Greenhouse Gases Under Section 202(a) of the Clean Air Act' (74 Fed. Reg. 18886 (April 24, 2009)) or any similar or subsequent proposed or final rule or other action relying on that decision or holding, shall apply only to sources regulated as of the date of enactment of this Act under section 202 of the Clean Air Act (42 U.S.C. 7521).

Now we have the jist of what authority the EPA would have:

This rule (Sec. 202) is to give the EPA decision-making ability to rule on Green House Gases with regards to carbon dioxide, methane, nitrous oxide, and hydrofluorocarbons. In Massachuesetts vs. EPA, the court ruled that the EPA didn’t have the authority to control these gases because it would mean they would control fuel economy and that is part of the Dept. of Transportation’s job, plus they showed nothing to back up their argument that GHGs contributed to climate change. Plus this rule would allow the EPA to judge ahead of time if GHGs in certain vehicles would be a detriment to the environment and public health. (My note: i.e., using a crystal ball to determine and rule) by stating “may reasonably be anticipated” and “endanger” would authorize, if not REQUIRE, the administrator of the EPA to act to prevent harm even in conditions of uncertainty (My Note: if GHG findings were found not to harm the atmosphere in the future). Their solution is permits for to control the fuel economy and GHGs.

At 250 tons per year, a permit could be required for an enormous number of businesses and trigger massive regulation of the entire economy. For businesses that use highways, such as trucking, bus companies, construction, farming, auto dealing, etc. the permitting requirements would be unreasonable and have enormous economic impacts. Simply waiting for permits would be intolerable. PSD permits are therefore inappropriate for GHGs and EPA should avoid these permit requirements.

Title V reaches an even broader segment of society, because it applies to all sources that emit over 100 tons per year of an air pollutant, regardless of source categories. Congress recently increased corporate average fuel economy (CAFE) standards through legislation. If the CAA were applied to GHGs, EPA staff could set entirely different standards than Congress specifically designated into law. This would be an inappropriate action that would clearly be contrary to Congressional intent.

New Source Performance Standards (NSPS) and other requirements such as Prevention of Significant Deterioration (PSD) and Title V operating permits. If EPA’s reaction to the Supreme Court case is to find an endangerment for vehicles, this could easily lead to vast regulation of building and other stationary sources. Under the ANPR, EPA considers regulations for all sources of greenhouse gas emissions, which could include cars, trucks, office buildings, refineries, manufacturing plants, tractors, motorcycles, farms, and countless other sources. EPA details in the ANPR the methods it could use not only to regulate the specific emissions for those sources, but also to set radical new standards for the design and operation of those sources.

Title V also includes a citizen suit provision that, if exploited, could have severe consequences because each permit application could be challenged by any citizen. For these reasons, operating permit requirements under Title V are inappropriate for GHGs and EPA should avoid these requirements.

Congress recently increased corporate average fuel economy (CAFE) standards through legislation. If the CAA (Clean Air Act) were applied to GHGs, EPA staff could set entirely different standards than Congress specifically designated into law. This would be an inappropriate action that would clearly be contrary to Congressional intent.

If EPA decides to regulate GHGs under the CAA, it could have serious consequences that create regulatory gridlock and threaten the people and economy of the United States. Although the most problematic consequences of regulation may not be intended by EPA staff, we are concerned that the CAA does not give staff the discretion needed to avoid triggering the most serious problems discussed above.

In other words, giving the EPA more authority to regulate these gases could be detrimental to every business and every citizen, causing the economy to become more nonproductive by forcing businesses to apply for permits (My Note: Which we all know the government is good at dragging their feet on that), more production costs, higher prices for consumers in not just clothing or fuel, but also food; and, if the EPA considers farm tractors or other engines to be part of causing climate change, then they would have the right to BAN those vehicles/engines, and force everyone to buy EPA-recommended vehicles/engines, which would be nonproductive and costly.
