(before Obama entered politics and was serving as Visiting Law and Government Fellow the University of Chicago) is being detained by ICE after a drunk driving arrest while immigration status is being determined. Exactly where are we trying to go with this? An aging inebriated man was uncooperative with police. Now there's a first. Being a distant in-law uncle of the president arrested while drunk, it is not all that surprising he would invoke the White House when asked about a phone call, for all the good THAT would do him.

SS CARDS are not typically given to immigrants who do not have some kind of work status. Whether his original status expired, changed or was modified is anybody's guess, but if he does have a previous standing order of deportation/removal, then he would fall into that new category of cases where administrative/judicial discretionary review will be applied to determine the course of enforcement vs nonenforcement, a policy which, by the way, was a direct result of substantial budget cuts to ICE and Homeland Security (both current and future) proposd by we-all-know-who.

I suspect he will receive his due process for the DD charge, then for the ICE process. If he is found deportable by previous order (assumming the removal order was not based on a criminal charge), then the question will focus on any mitigating circumstances to the DD charge (along with any prior record of such) and "public safety." We do not know if he is married, has kids born here, or any other details of his immediate family situation. What we do know is that his sister was granted asylum based on credible fears of persecution or threat to life upon return to Kenya. We also know that those same grounds exist for the uncle-in-law as well, given their common connection to the president and the political forces that contribute to the perceived threats as defined under long-standing existing immigration law.

The question before the court will be to weigh the degree of "threat" his DD charge poses to publc safety against the degree of threat to his life and persecution by Kenyan authorities that removal may impose.
