There is no 3rd term in the sense of having filled out 2 prior terms--he is looking for a 2nd term, which is prohibited by constitution, but he was not elected to 1st so there is the controversy.

Members of the opposition say that under the Constitution, presidents are allowed only one renewal of a five-year term, so Mr. Nkurunziza is barred from running again. A former rebel leader, Mr. Nkurunziza took office in 2005.

His supporters counter that his first term does not count toward the limit because he was not directly elected by voters in 2005.

My only reasoning for Fox was the utter ridiculousness of the comment-- which apparently was not Fox inspired nor NY Times inspired, so I don't really know where it came from---but conspiracy theory nonetheless.
