Navy Seals being put on trial?

Just caught a bit of this story. They arrested a terrorist and he's claiming they punched him? Now they are on trial????? Where's the justice??? This is the type of lop-sided politics that is killing our country.

As for the Gitmo trials, they don't belong in NY. They weren't arrested in NY. They were arrested in another country by the military. U.S. Law does not cover this. Military law does. They are being held in a military prison  Read up on it. They should go to trial in the miltary system, not civil court. I'm hoping the 911 victim families protests scheduled for 12/05 wake up the jerk that decided to rub salt in the wounds of those families. The terrosists WANT to be executed so they can become a martyr (sp) and so their family and their government (Taliban, Al Quaida [sp]) can state we didn't give them a fair trial, even if they are aquitted. That's my worst fear...if they are tried in this country. It just sets NYC up for another terrorist attack. Where's Holder's mind? Or is he hoping this would happen? Is our government setting us up for another and even worse attack? I want answers - WHY?

Lastly, as for the below posters arguing between each other, stop the nastiness. I've read some of the messages and felt like posting a reply but decided against it. This board is for DISCUSSION. There is no reason to call people names, no matter how peeved you get. Keep it clean. Dregs, venom-mouth, etc. doesn't belong here. If you hate the post, don't take it out on the poster, just don't comment....this is why I don't post as often as I would like.

NJ, Nikki, etc. try to hold discussions (even though I don't agree with them three-quarters of the time), but there have been "new" posters on this board that don't care what they say.  It's not necessary. Keep it clean. Keep it on the message. Don't answer the nasty posters. They just try to start arguments.

If these SEALS were following orders from superiors if and when they did this, it's their superiors who should be on trial - NOT the soldiers - and that blame should go all the way up the ladder to the TOP! If punching someone is against military conduct, then maybe they should take a second look at their military conduct policy.

As far as the Gitmo trials, I have really mixed feelings on this one.

It seems that they're going to try these guys as any other criminal trial for murder would be held. On the one hand, I will never understand why foreigners who aren't Americans should receive Miranda warnings, hearings, trials and all the rights an American citizen should have. For that reason, I agree with you that the trials shouldn't be held in New York. I also agree with your fear of our being set up for another terror attack, only I'm not sure who the perpetrator would be. It's not out of the realm of possibility, in my mind, that it could be a home-grown terrorist, though I also believe al Qaeda would be capable of carrying out another attack, as well.

If they give them military trials, it would appear that they're trying them for war crimes. So, on the other hand, even though we're at war, we're at war with a group (Al Qaeda), not with another country. We're in Afghanistan supposedly to get bin Laden, but we're not in war against the Afghanistan people. We're just wrecking their country in order to get bin Laden. So if the crime happened in the United States (as it did), then it should be tried in the jurisdiction of the crime.

I think Eric Holder made a huge mistake in stating the these people WILL be found guilty. They're supposed to have the presumption of innocence going into an American criminal trial. He made it pretty clear that, one way or the other, they will eventually be found guilty and punished. Statements like that taint a jury pool, and I can't think of one AMERICAN, let alone one New Yorker, who wouldn't jump to convict a terrorist.

Sorry for the length of this, and I apologize for rambling, but it's hard to get my brain around this one because it's such a complicated issue: American law versus military law. If I were forced to answer now, though, I think I would have to say they should be tried under military law, given the definition of "citizen" in the Constitution. Again, it's a very complex issue that I'm not smart enough to really address.

Lastly, I want to thank you for addressing the nastiness on this board. I freely admit that I'm part of that from time to time, but I'm trying my best to not be that way. On the other side of every monitor is a person with feelings. I believe everyone who posts on this board loves his/her country, be they Republican, Democratic, Independent or anywhere in between. I enjoy reading posts like yours because I can sometimes learn things I didn't know before. I realize that Politics is a heated subject for discussion, but drive-by name-calling just doesn't add anything to the debate.

Thanks for providing your point of view without bashing liberals. I fully respect your view as a conservative. You seem like a nice person. If we met in person, we just might be friends with different views. We may disagree on the issues, and that's fine. That's why this board is here, and I still believe we can do it without being disagreeable.

I tried to post a message yesterday, but MTStars must have been working on the site, as the message got lost.

I don't think the SEALS were ordered to do this. I think it's just a matter of stress. They were looking for this guy for 4 months and he probably said something that ticked the SEALS off highly. Anyway, the trial is supposed to be held Dec. 7. If you don't like Fox News, I don't know if any other news are reporting it. More research is necessary.

As for Gitmo, I believe they should be tried by a military court. The were fighting our troops and they were captured by the military and were held in a military prison. They are not American citizens and should not be afforded the same civil rights our citizens receive.

To hold civil trials in NY just a few blocks from the 911 site is, in my opinion, heartless.

I just don't know what Holder has in mind by making this crazy decision. He already tainted the trial by stating they will be found guilty. No American will be able to judge this case fairly. That's probably what he had in mind...which brings up the point "innocent until proven guilty." These men certainly are not innocent.

Does he plan on be bringing a jury in from another country? That's the only way these guys will get a fair trial.

Could it be that Holder doesn't believe these terrorists would be found guilty in a military trial? Is he just grandstanding? Does he expect the court system to give them the death penalty? Is he listening to the ACLU? If so, he's just playing into the hands of the terrorists. That's exactly what they want...to become a martyr for the cause.

Lots of questions and no real answers except that this decision will divide the country even more, as protesters for both sides will be out in force. Transparency does not seem to be the government's high point. I don't trust Holder and I trust Rahm even less.

Maybe you will be able to find something else on this story. I only found Fox, American Thinker, and the Examiner reports of the SEALS. Fox seems to have the most "calm" report. Another example of mainstream media falling down on the job?

questions. I especially agree with you that Holder and the jury pool. When I heard him say pretty much that the guys WILL be found guilty, I wondered then if they could get a fair trial.

Secondly, like you said, if they're going to follow the law on this (instead of a military trial), how are these guys going to get a jury of their peers?

I also want to apologize because I think I misunderstood you about the SEALS. I thought you were referring to torture and Gitmo and all that.

I'd like to know more of the story, as well, and maybe I'll research it some time later today.

Right now, though, I think I'm going back to bed. Too much bird yesterday and not enough sleep last night. LOL!

I've been reading pieces on whether to have military tribunals or civilian trials for months. No one is hiding anything that I'm aware of. Maybe it was just in the news so much it's not being rehashed until a decision is made, but that's far from a lack of transparency.
