Elizabeth Warren Introduces Bill to Prevent Employers

Posted: Dec 18, 2013

I can't for the life of me understand why this was ever legal in the first place. If you have bad credit, you really need a job, right? No brainer. Also, what business is it of your employer's if you have a bad credit rating and why would it make any difference to what kind of job you do? Craziness and another example of stuff that happened when Bush was in office.

Witness the drug companies benevolently deciding they will not pay doctors to push their drugs anymore. How the heck was that legal in the first place? Is it legal anywhere else, except maybe third world countries illicitly?

The wealthy think it's none of our business what taxes they pay (if any) or anything about their personal lives, but they get to know, judge and regulate everything about ours? I think it's time for poor people to have some rights too, especially now that so many of us are joining those ranks through no fault of our own.

In many situations people have bad credit ratings because they lost their jobs because the companies sent the work to other countries. Our government is now in the midst of creating yet another NAFTA-type agreement where I am sure we will lose more jobs. It is called the TPP or Trans-Pacific Partners agreement. I'm sure many of you are aware that we lost millions of jobs due to NAFTA and like agreements. This newest agreement is being done secretly with the public kept away from the details and 1000 businesses are included in creating it. Protesters are referring to this agreement as NAFTA on steroids. It was on my local news this morning that a large American company is shutting down a plant where 600 people will lose their jobs. The company had 60-billion dollars in sales last year and has plants all over the world, with a large amount in China, yet they are closing a US plant. This stuff has to stop. I find it ridiculous that companies can use your credit history to decide if you are worthy of them, though they are the ones that have caused bad credit for a lot of people. We need to get involved and write our representatives with our concerns. Many don't think it will do any good but they are wrong. This lack of involvement is a big part of why we are all facing what we are.

Sounds like conjecture - sm

If the negotiations are being held in secret, how do you know this information? I do know that while talks are going on between interested parties (say salary negotiations) you do not have them in public as then it gets to be a free for all. There is a site you can visit to get more information on this trade agreement and even submit comments: http://www.ustr.gov/tpp/comment

"I do know that while talks are going on between interested parties (say salary negotiations) you do not have them in public as then it gets to be a free for all."

This is OUR ELECTED GOVERNMENT that is doing the negotiating - everything should be out in the open and crystal clear! Too bad if they don't want us to know the details - OBVIOUSLY if they don't want us to know, it's because the agreement will cost jobs in US, create low-paying oppressive jobs in other countries, be damaging to the environment, and will shield companies from stricter laws in the US and/or other countries.

We don't have to just "submit comments" - that's not representative government. Representative government does the PEOPLE'S BUSINESS - but with trade agreements kept on the hush-hush they're NOT doing that - they're doing the MULTINATIONAL CORPORATIONS business. Who's running this planet? The majority of people? Or the teeny-tiny minority at the tippy-top.
What are the rules about ratifying a treaty? - ??

The way I understand it is there is a negotiating team and then congress has to approve the treaty? I do not think all laundry, clean or dirty, needs to be aired while in process. Otherwise, it starts to look like a Republican primary.

negotiating team includes big business. If the president has his way it will be fast-tracked through which gives congress a quick yes or no and not a complete review and debate. Maybe you don't think it should be aired, but I do and so do many others, including some members of congress. I would rather know what is going on with this than the nonsense news on what celebrity is sleeping with who that we are bombarded with.

did a research paper on this topic. I have also been to that website and they only tell you what they want to tell you. They say they have reached several agreements on issues, did you actually see what they agreed to? You are getting the details on how wonderful it is yet you don't seem to understand the talks are going on in secret with businesses included and not us. Even many of our Senators are questioning this agreement and being left out of the details. This has nothing to do with company salaries but our jobs, which we have lost millions to with these trade agreements. Do you know also through these trade agreements what constitutes being Made in America has gone from 67.5% of the product being made here during NAFTA to 35% of the product being made here with Australia's agreement. Do you know that companies can sue host countries for costs of following their environmental regulations or can even have a country change its regulations if it causes the company to lose money by having to follow the regulations. America has bullied many countries into dropping regulations and countries have had to pay for loss of profits. This can happen here too. Guess who gets stuck with the costs of these lawsuits? That would be taxpayers. Guess who profits from this? Big businesses. TRA is paid for by taxpayers due to companies sending work overseas because of these agreements. They are not put together with the interest of our country. They are being put together to benefit the top 1%. Yes we do need to write our representatives and also place comments on the website you listed.

not about "poor" or "wealthy;" it's just common sense.

if the job is for a bank teller, accountant, etc., i get it. people in debt often do things they shouldn't do.

makes no sense to run a check on someone whose job doesn't involve money or valuables.

They used to have bonding for that - do they still do that?

[ In Reply To ..]
I still don't think it should be legal for an employer to make that judgment call, no matter what the job is. That is predicating a hiring decision based on assumptions that are not proven statistically and which they don't have to justify. It is discrimination.

I imagine there are many people who are bank tellers who are in debt and wouldn't dream about doing anything illegal, and we have seen many, many people who have plenty of money doing shameful things just because they could. Sadly, they get away with it and the poor people never do.

I doubt that bank tellers are earning very - Libby

People with great credit steal too.

It also affects insurance rates, which is just dumb. My credit score goes down because I'm using 50% of my available credit and my car insurance rates go up because I'm now a bad driver? =P

Not only that, but if you finance your car (sm) - Libby

[ In Reply To ..]
you're getting a lousy rate, once again making the poor even more so, while the corporations sit very comfortably on the cushion the higher interest rates you're paying is providing.

0 down? 0 interest? Not for an entire class of people that's growing each and every day.

It's all part of the plan to make the poor even more poor. (SM) - Libby

This has been happening for a long time, and it's been particularly continuing when GOP/TP are involved.

Thank God for people like Elizabeth Warren. I'd vote for her for President in a heartbeat. She talked the talk when campaigning, and now she's walking the walk on behalf of the 47% many of you would just as soon be GONE (by ANY method possible) from this country.

I would vote for Elizabeth Warren in a heartbeat too.

But it's not just the GOP/TP involved with making the poorer poorer (if that is possible). But when the dems/progs are involved their goal is to make the middle income poor.

class poor. Why aren't corporations hiring AMERICAN people to work in AMERICA? Once again, those with the big bucks are the puppet masters who have bought and paid for our congress, and we're the puppets, since the politicians (both D, R & TP) are beholden to those who are the richest. The TP is bought and paid for by the Koch brothers, for example.

At least the dems don't want to see people penniless in today's economy, and are trying to save the safety net programs while people like Ryan, Cruz, Issa, etc. want to give more corporate welfare as they literally take food out of the mouths of the most vulnerable in our "great society."

In a perhaps unrelated statement, I've never had much respect for the Catholic church (my own personal reasons that affected my family in a very negative way), but I LOVE this current Pope and the morals he stands by.

You certainly have your right to disagree with me about anything and everything, and I'm glad you agree with me about Elizabeth Warren, even if it's only "partly."

When it comes down to it, maybe you and I aren't so far apart in our views, but sometimes anger, frustration, name-calling, and all the other negative things that prevent a civil discussion from being held keep us from getting that far. (And I'm not referring to you personally, just generally on the board.)

In any event, it's been a pleasure having this "intercourse" with you. (Go ahead, look up the definition of "intercourse," and I hope you get the same chuckle I got when I did.)

Most of all, thank you for being respectful to me.

I agree/disagree with you - Poster you replied to
[ In Reply To ..]
I agree totally with your first paragraph.

I disagree with your second paragraph. Not that dems don't want to see people penniless, but the fact that neither do republicans. Corporations under democrat rule are taking food out of the mouths of the vulnerable. It's just not the republican party, its EVERYONE.

There are good and bad people in both parties. I have recently switched my party to democrat, not because I hate the republican party and not because I agree with everything the democrat party does, but I agree more with the social issues of the democrat party, even though I find them at fault for the shut down. But McCain, Romney, Palin, Rush and a lot of other republicans I don't want to be in their party. I also don't want to be in the party of Obama, Hillary, Biden, Gore or some other democrats, but I have to draw the line somewhere.

I think you and I agree on a lot of things. The one thing I don't think we agree on at all is blaming the republicans for everything, even the stuff that is the democrats fault.

Okay, I'm afraid to go look up the definition of "intercourse" LOL

I think it is very important for us as American citizens to be respectful towards each other even if we disagree. Should have seen the heated debates my mom and I used to have. I voted for Clinton, she voted for Bush Sr., but one thing she taught me is people are the same. They basically want the same things, good education, jobs, a future. No reason to be disrespectful just because you don't agree on issues.

Look forward to more discussions. I just don't want to get into bashing republicans and blaming them for things that are the democrats fault.
Thanks for the response. (SM) - Libby

I enjoyed reading your post and agree with most of it.

The only thing I disagree with is it seems every time someone wants to take food out of the mouths of the poor, it's a Republican that I hear wanting that to happen. I can't think of one Democrat that wants to remove the "safety net" for the poor.

The Democrats also want to increase the minimum wage so that it's actually a living wage where people can actually rent an apartment and feed their family with the money they earn from their job.

By the way, I'm a registered "Independent" and have voted for Republicans during my lifetime, as well.

Oh, and, as far as looking up the word "intercourse," I'm pretty sure you'd get a chuckle from it. (I was speaking with one of my best friends on the phone one time about a year ago, and as we were about to hang up, he informed me that it was very nice having intercourse with me. Of course, I was totally flabbergasted by what he said, and he just laughed and told me to look it up in the dictionary. I did, and I got a pretty good laugh from it. So it's "safe," I promise! LOL!

In all seriousness, though, it's been a real pleasure reading your posts. Thanks for that!

Am I missing something here? A bill to prevent employers from looking at credit reports. I understand that employers can check a credit report, but how do we know if they "do not hire" based on a poor credit report or "do hire" based on a poor credit report. I would think we need to know that before we create again more government regulation. Maybe we are adding to the problem?

Well, actually, the existing law now says they have to - tell you if the decision is based on bad credit

[ In Reply To ..]
An article from Forbes (link below) details to what extent companies use these checks.

"Today, credit history checks are legal under the the Fair Credit Reporting Act. It requires employers to notify prospective hires of their decision to deny them employment if such a decision is based on his or her credit. The job applicant is then given three to five days to fix any errors on his or her credit report before the employer can take action."

Have you ever tried to do this, though? Ever tried to get the credit people to "fix" your credit report when it is not your fault? It would take a lot longer than 3-5 days and in some cases proves impossible.

I think it's an invasion of privacy that is unnecessary. Why should employers have access to personal information except that pertinent to the job? I cannot think of any reason why they would need access to credit reports and the proposed bill does exclude national security jobs.

I imagine if you are going to be a CEO or in a big job where you have access to a lot of people's money, that is perhaps a reason, in which case I imagine you would be respectfully asked for that and give your consent. However, this seems to be being used as just a tool for excluding an applicant which in no way reflects on their ability to do the job, a job which they might be very good at and need desperately. I would like to know one good reason why a company would need to look at a credit report for an MT job or a bank teller.
