Clinton comment on immigration law riles Ariz. gov

Posted: Jun 19, 2010

By AMANDA LEE MYERS, Associated Press Writer Amanda Lee Myers, Associated Press Writer – Fri Jun 18, 2:45 am ET

PHOENIX – Arizona Gov. Jan Brewer said Thursday she's angry over comments by Secretary of State Hillary Rodham Clinton that the Obama administration will sue the state over its new immigration law.

In a June 8 media interview in Ecuador that began circulating Thursday in the U.S., Clinton said President Barack Obama thinks the federal government should determine immigration policy and that the Justice Department "will be bringing a lawsuit against the act."

Justice spokeswoman Tracy Schmaler on Thursday declined to say whether the department would sue and that "the department continues to review the law."

The department has been looking at the law for weeks for possible civil rights violations, with an eye toward a possible court challenge.

It's unclear why Clinton made the comment since it's not her area. She couldn't be reached Thursday for comment.

State Department spokesman P.J. Crowley said Obama and Clinton have both made it clear that the administration opposes the law.

"I will defer to the Justice Department on the legal steps that are available and where they stand on the review of the law," Crowley said. "The secretary believes that comprehensive immigration reform is a better course of action."

Brewer, a Republican, said in a statement that "this is no way to treat the people of Arizona."

"To learn of this lawsuit through an Ecuadorean interview with the secretary of state is just outrageous," she said. "If our own government intends to sue our state to prevent illegal immigration enforcement, the least it can do is inform us before it informs the citizens of another nation."

Brewer spokesman Paul Senseman said the governor was "outraged" and that Clinton's comments make it appear that the Justice Department has decided to file suit.

"But she's confident that in the end, the state of Arizona, the citizens, will prevail," he said.

On April 23, Brewer signed what is considered the toughest legislation in the nation targeting illegal immigrants. It is set to go into effect July 29 pending multiple legal challenges and the Justice Department's review.

The law requires police investigating another incident or crime to ask people about their immigration status if there's a "reasonable suspicion" they're in the country illegally. It also makes being in Arizona illegally a misdemeanor, and it prohibits seeking day-labor work along the state's streets.

The law's stated intention is to drive illegal immigrants out of Arizona and discourage them from coming in the first place. It has outraged civil rights groups, drawn criticism from Obama and led to marches and protests organized by people on both sides of the issue.

The law's backers say Congress isn't doing anything meaningful about illegal immigration, so it's the state's duty to address the issue. Critics say it will lead to racial profiling and discrimination against Hispanics, and damage ties between police and minority communities.

Brewer met with Obama in the Oval Office about the law on June 3, telling him: "We want our border secured." Obama reiterated his objections to the law. Neither side appeared to give ground although both talked about seeking a bipartisan solution.

Other Arizona politicians, political candidates and activist groups were quick to weigh in on Clinton's remarks. U.S. Senate candidate J.D. Hayworth, who is challenging Sen. John McCain, called them appalling; attorney general candidates Tom Horne and Andrew Thomas also denounced them.

Joanne Lin, legislative counsel for the American Civil Liberties Union, urged the administration to take swift action against the law.

AZ bill is that it is actually nicer than the federal law regarding illegal immigration....so why are the libs getting their panties all in a bunch here? Illegal immigration is...well...ILLEGAL!!! If our gov't is not going to enforce the federal law regarding illegal immigration, the state has a right to. Libs don't care about Hispanics...they care about getting them amnesty so they can get their vote.

I agree. Each state should be allowed to - sm

handle it on its own, since not every state has teh same problem with illegal immigrants. Border states have more illegal immigrant problems.

Why should illegals have the right to become automatically citizens, only because they managed to get over the border.

Also, although it is put down in the Constitution, is it really justifiable that everyone who is born in the US is a US citizen? Anchor babies?

If one tries to become a US citizen the legal way, it is a very complicated and lengthy issue.

Hey yeah... and while we're at it, lets demand that the Statue of Liberty be altered! Lets take down the torch and replace it with a hand giving the finger instead! And, lets also put a blindfold over her eyes and replace the tablet that she holds and put a gun in her arms instead. and then, lets build a huge fence all around the island that she stands on, just like that hidious metal one that runs along the once beautiful sand dunes and desert in my back yard.

I personally do not and will not begrudge another human being for trying to make a better life for themself or for their family. If you cannot or will not understand what it is that compels a person to get up and give up whatever kind of life they have to flee to another country out of shear poverty, fear, or knowing that your countrie's government will never be on your side, then you shouldn't stand on the principles of "our constitution".
Do you honestly believe - sm
[ In Reply To ..]
that those of use who are for the AZ bill are against immigration? Not at all. You people need to open your eyes and see that we do not begrudge anyone who desires to seek a better life in our country. With that being said, it needs to be done legally. I have family who came from Germany and Hungary. They came to this country legally. They weren't smuggled into the country. They were not kidnapping people. They were not dealing drugs. They came to America in search of a better life and once they got here, they worked hard and earned their own way.

I'm all for immigration...as long as it is done legally. Those of you who stand behind those who commit a crime by coming here illegally amaze me. It is a crime. They do not deserve amnesty. If anyone should receive a get into the country as a citizen pass should be those currently trying to get into our country legally. We should not reward those who refuse to follow our laws. I just do not see how you people do not understand that.

As for the border fence you claim to hate...I'm sure you would hate it more if you were shot on your own property by an illegal like that rancher in AZ was...and he was sympathetic to illegals.
I totally agree with your comment. - NO to illegals

Trans-passing is a crime!

The American soil does not belong to illegal transpassers.

Either it is done by legal way, or NOT AT ALL. Sent them back where they came from.

Same applies to overstaying one's visa, remaining in the country for years and years "in hiding." and when caught, insisting having built a NEW LIFE, here in the US, and refusing to go back.

Legal is sometimes a luxury some cannot afford. My MIL and FIL are from occupied WWII countries and when an opportunity presented itself, they fled with nothing more than the clothes on their backs. They lived in fear of deportation for years until the "legal process" was done. Don't you understand? Not all of the "illegals" are drug smugglers or violent. There are people that are really and truely afraid for their lives. How long does the "legal process" take? In Juarez, Mexico the violence is so rampant that there is a mass exodus! What would you do if a frightened family showed up on your streets, hungry, frightened, with no where to go, no food, no shelter? Tell them to go back?

after WWII different circumstances, we all know that. - see message

A legal immigration into the US 5 years takes appr. 10-11 years.

First one has to have a legal sponsor to get a work visa, after 5 years one can apply for the green card. If approved, after 5 years one is eligible for the US citizenship and has to go through an interview consisting of a thorough background check, testing of English language skills and civic and history exam.

It is a rather extensive and time consuming process, it takes 11 years.

Is it fair that ILLEGALS swindle their way around this???

NO, it is NOT.

I would never harbor illegals, this might be a cause to lose one's US citizenship, equally when harboring a terrorist.

LAWS HAVE TO BE RESPECTED, otherwise chaos emerges. Like now!

You are expected a compassionate response - from people who have none

A lot of that here, and it is sad, but there is a serious lack of compassion and equally serious inability to see beyond "how will it affect me" and "I can not deviate from my parties' talking points or view." Very sad to see. I rarely post here anymore because of this and the lack of reasonable discourse. I guess it is a sorry testament to what this country has become. I am sorry that so many seem to be determined to keep that going.

How can you say we are not compassionate? - sm

You people don't listen to anything except for...I'm for the AZ bill and then you immediately brand us as heartless, etc.

Once again, I'm not against immigration...as long as they do it legally. We should secure our border merely to try and stop the drug trafficking, etc. that goes on. If some illegals weren't doing such horrible things in our country, this wouldn't even be an issue. So stop blaming US citizens for wanting protection against the illegals who are doing bad things in our country. Blame them for doing those things. Not those who try and stop it. That doesn't make me not compassionate. That makes me care about my fellow American citizens and want them...as well as my family....protected.

You talk about us merely repeating our party's talking points. Well I hate to burst your bubble but I don't align myself with any party. This is my opinion. If some illegals weren't doing such horrible crimes, there would be no need for the AZ bill or a need to secure our border.

Do you not feel compassion for those American citizens who go through he!! because their identity was stolen by an illegal? Do you not feel compassion for that family whose child was kidnapped from their home by an illegal?

So stop giving me this BS about us not caring and not being compassionate. This is merely us trying to protect American citizens.
It is easy. Many here are NOT compassionate - and I am not just talking

keeping people dependent on gov't assistance is helping anyone? There are those who abuse the system merely to get a free hand out. That abuse should be weeded out. That would save our country LOTS of money right there. There are others who truly try to do for themselves but as soon as they get a job, they lose any help from the gov't and find it easier to just keep getting that gov't check instead of working. If we truly want to help people better themselves and their situation, why is our system set up to hold them back? This is the problem I have with gov't assistance. You call me heartless. Well...I say that the program is heartless because it actually keeps a lot of people dependent on gov't when they shouldn't be. This doesn't help anyone. It costs our country more and more every year and a program to help people but actually keeps them down....what good does that do?

You so called bleeding hearts need to wake up here. You want to help someone...teach them to do for themself. When a program makes it better for some to not work and get a gov't check than to go out and get a job of their own....THAT IS A PROBLEM!!! Not a solution. Wise up!

need help. I was on Welfare while I was in school and raising my son and living in my parents living room for about a year. It did what Welfare is supposed to do. I hated being on it but it got both me and my son through a bad time. So, yes, I stand by my post. Now my 20-yo disabled son is on Medicaid and desperately wants to get out on his own but because of his disability is extremely limited in what he can do or train to do, or even live on his own. I am now faced with making sure he is taken care of when I am gone. He can not even begin to manage money. He can take care of himself only at a very minimal level. How would he survive if not for Medicaid and foodstamps and such. Welfare is there to help people when they need help. How do you go to work if 2/3 of what you can make has to go to daycare? How do you go to school assuming you can get financial aid (which Bush made more difficult) AND pay for daycare? My dad was dying of cancer so I was not going to have my mom who was already stressed to the max between taking care of him and having us in our living room! You're the one that needs to wise up! And yes, your attitude is heartless and totally lacking in compassion! Sorry but that is the way I feel and what most cons sound like when they start the party line garbage about welfare-"it just means you just want a handout" or "it just means you are too lazy to get a job" or some such garbage. And that is what it is-verbal trash and garbage and has all the earmarks of a selfish person who cares about their fellow man to the extent that they are willing to continue to fight and flounder but not get help, even if a child is involved. It is wrong, pure and simple.
I apologize for the angry tone of that post. - I just get really, really

tired of people with this response and having been in the position where I needed it, I find the attitude very offensive. Truly, sometimes people just NEED help. Does not make them lazy, or stupid. Just means thing have not gone well and they are trying to do what they have to do to get by until they no longer need it.

everything I said, the only thing you heard was that I called SOME of them lazy. I don't consider all people on welfare and/or disability lazy. That is something some of you cannot comprehend though and no matter what I say, all you hear is me calling some of them lazy. Well...some of them are lazy. I never said to not help people. Please quote me where I said we shouldn't help people....go ahead.

The problem I have with welfare and disability that there are people abusing the system and costing us unnecessary money. That doesn't mean all of them receiving that are. The other problem I have is when welfare drops a person when they get a job and that person ends up right back where they were struggling to make ends meet because welfare dropped them. So some of them decided it is better to stay on welfare than take the job and lose welfare. That is MY problem with the system. It does keep some people dependent on gov't instead of allowing them to to rely on themself.

So stopping f'ing calling me heartless. I never said we shouldn't help anyone. However, I think welfare and disability need to be redone to get rid of some of the waste and make it better to actually help some people instead of dropping them when they get a second job, etc.

Don't tell me to wise up. I'm smart enough to see the big picture. I understand there are some people like you who truly needed the help and I'm glad you go that. But you need to look and see how many this system is keeping in the gutters and how many are just mooching.

I don't care if you take this personal. I was simply discussing things when you personally attacked me which is totally uncalled for. I'm far from a heartless person. I'm just tired of the waste and if you can't understand that, you know where you can go.
I'll tell you what. I won't tell you to wise up if - agree not to say it to me

again! I just spent a year and a half trying to get help for my son hundreds of pages of proof, records from a multitude of teachers, doctors, psychologist, vocational counselors, psychiatrists, psych tests, etc all saying my son was in need and he still was denied 4-count em-4 TIMES before he was approved just before his hearing, so do not insult me. For all the "waste" I can tell you first hand that there are many out here who need the help desparately and can't get it. I know of at least one person on this board who is clearly, CLEARLY disabled and has been denied multiple times and is still waiting for a hearing. Meanwhile, she is trying to deal with a number of medical problems, no medical insurance, unable to work, and the system is denying her. I think the system should be reworked, I do NOT believe that most people getting it are getting it because they do not have a choice and if you can not understand that, you know where YOU can go!

I have to take my son to a Dr appt. I have nothing more to say to people like you. I advise you to ignore me as well if all we can manage are posts like the one I am responding to. Have a good day.
There is no point arguing with you. - sm

You obviously cannot open your mind to see the big picture.

I know people aren't getting help that need it. I also know that people are getting help who shouldn't be getting it. What don't you get about that?

As for your situation, I don't need you to tell me over and over and over again your personal situation. I get it...you needed help and you got it. Good for you.

Some of you seriously only hear and see what you want to hear and see.

What don't you get when I say we need to get rid of the waste, i.e. moochers. What don't you understand when I say that there are people who cannot get a job because if they do they will lose welfare and be in worse shape than if they just continued to receive welfare? That isn't helping anyone. That is keeping them dependent on govt when we should be helping them to succeed financially on their own.

You obviously don't get it and I won't tell you to wise up but I will tell you to get a clue. I'm done talking to you.

"trying to make a better life" - while that is true of many, we all know just as many or more cross the border for criminal activity, drugs, human trafficking, or to use the US system to their benefit and our detriment. No one is above the law - regardless how pitiful their plight.

It makes no sense to add millions to an already non-existent job market and/or sub-par wages, or adding more needy and dependent to inefficient social programs, infrastructure, etc.

There is nothing compassionate about Americans who are willing to use people of a slightly different skin color for a political purpose - and the illegal immigration issue is purely ideological hegemony - based on marxism.

I have no doubt that if 10-20 million Blacks were entering the country illegally (creating the same divisiveness and burden) we would not translate everything into Swahili, or press 1 for Botswana - there would be mass outrage and border closings.

Evidently, thats not all you dont understand. - sm

You have overlooked a couple of 2-ton elephants in the room: The US Constitution and the protection it extends to ALL parties potentially affected by this law. HELLO. That would include legal residents, naturalized and native Hispanic (and those mistaken for Hispanic) citizens who are inevitably subjected to racial profiling. That is why constitutionality is an issue, which makes it very much the business of the federal government.

This particular law requires close scrutiny for the potential of violations of 5th amendment due process, 6th amendment rights to fair and speedy trial, notice of accusations, confrontation of the accuser, subpoena and counsel, 8th amendment cruel and unusual punishment (forced removal) and potential 9th amendment issues of presumption of innocence and burden of proof.

One more thing. Please not presume to speak on behalf of liberals and their motives. This is not an issue of getting votes. Maybe your beliefs give you license to ignore the above issues in your haste to condemn and cleanse the homeland of illegals, but the rest of us take our Constitution and those pesky civil liberties VERY seriously.

I am married to a non-Hispanic foreign national whose physical features can easily be mistaken for Hispanic by bigots and racial purists unable to discern ethnic distinctions. His legal residence spans 30 years, 10 years as a refugee and 20 by marriage. He and I have every right to expect protection from forced removal and its underlying "get out of town by sunset" mentality.

the fear mongering rhetoric from the left. So let me explain this to you. Obama was wrong when he said a man could be asked for ID when taking his kids to get ice cream. Absolutely false and an outright lie. People can only be asked for ID and/or papers if they are stopped for a traffic violation and/or do something suspicious.

If your husband is pulled over for a traffic violation and is asked for license and registration, that is nothing more than a normal traffic violation stop and obviously if he produces his driver's license he is obviously an American citizen and NOT an illegal.

The AZ bill is a lot nicer than the federal law. The only difference is that AZ will be enforcing their bill when our federal government does not.

Any person who is an American citizen and is harrassed by a cop can bring a lawsuit. If you are legal, you have nothing to worry about so stop b!tching. I just do not understand you people crying and whining over people who are committing a crime by BEING HERE ILLEGALLY!!!!!

If anything, ya'll should be ticked at illegals since they are the reason for this law in the first place. If there wasn't people smuggling, drug smuggling, and kidnappings going on by illegals...this wouldn't even be an issue. If you are gonna point the finger, point it at them for committing a crime. Don't point it at people who want to stop the crime.

Same thing goes for the AZ bill. It is truly there to try and stop crime by illegals to help protect American citizens no matter what color you are or where your family originated from. If you are an American citizen, the AZ bill is to help protect you.

The sooner people grasp that concept, the better it will be for everyone.

I received this in an email today. This is exactly how I feel:

(below is copied from my email)

My great grandfather watched as his friends died in the Civil War, my father watched as his friends died in WW II, and I watched as my friends died in Vietnam. None of them died for the Mexican Flag. Everyone died for the U.S. flag.

Just this week, here in Texas, a student raised a Mexican flag on a school flag pole; another student took it down. Guess who was expelled...the kid who took it down.

Kids in high school in California were sent home this week on Cinco de Mayo because they wore T-shirts with the American flag printed on them. Enough is enough.

The below e-mail message needs to be viewed by every American; and every American needs to stand up for America. We've bent over to appease the America-haters long enough. I'm taking a stand. I'm standing up because the hundreds of thousands who died fighting in wars for this country, and for the U.S. flag can't stand up. If you agree, stand up with me. If you disagree, please let me know. I will gladly remove you from my e-mail list.

And shame on anyone who tries to make this a racist message.

Then YOU'RE PART OF THE PROBLEM!

When will AMERICANS STOP giving away THEIR RIGHTS???
We've gone so far the other way...
bent over backwards not to offend anyone. But it seems no one cares about the AMERICAN CITIZEN that's being offended!

John Oliver's last chance to live out his days with his son in New Jersey might have been to sneak across the U.S. border, but the ailing, 89-year-old World War II Royal Air Force veteran didn't want to break the law. Instead, Oliver -- who lives in the Bailiwick of Jersey, the largest of England's Channel Islands -- and his son, an American citizen, went about it the honest way, filing all the tedious paperwork and paying the required fees to secure him a green card. All seemed ...

Illegal ImmigrationNov 14, 2015
What makes illegals think that it is okay to exploit our healthcare and services.  We have a American Citizens that cannot get the help they need or are waiting due to illegals getting services that should only be allowed for US CITIZENS.  In our next election we cannot vote someone in who is soft on immigration.  We have to take back our borders.  In other countries you are shot, fined or imprisoned but not in ours this is REDICULOUS and what about terrorism, right now Obama ...

Immigration Reform Off The AgendaApr 30, 2010
I especially love the line about not doing something just for the sake of politics - who is he kidding?  The whole reason it's not on the agenda anymore is because of politics!  And you can blame the republicans or the democrats - they're both just as guilty of doing what's right for themselves instead of what's right for the country!  A politician doesn't do anything that isn't for the sake of politics! http://news.yahoo.com/s/ap/20100430/ ...

Obama's Moment On ImmigrationNov 07, 2014
"President Obama said on Wednesday that he would act on his own by the end of the year to “improve” the immigration system, presumably by giving many — perhaps millions — of the country’s unauthorized immigrants temporary protection from deportation and permission to work. He has said this before, only to back off in deference to election-year politics." It will be interesting to see how "immigration reform" will play out.  The majority of Americans do not des ...

Immigration Reform — Not AmnestyNov 12, 2014
"We have all heard it said many times that America is a land of immigrants, some voluntary and some involuntary, but immigrants nevertheless. We have plenty of space in our country, but insufficient resources to support everyone who wants to come here. When we see innocent children used as political pawns, it still tugs at our heartstrings, which is the desired intent. The real question is, What are we going to do about it? Immigration reform has been a very tough issue, as well as a p ...

Immigration Of Children From GuatemalaNov 23, 2014
This is a complicated issue.  Previously the government in Guatemala leased land to the small farmers who were able to support their families on the leased land.  Then Cargill and other mega corporations leased the land from the government displacing thousands of small farmers.  Not enough jobs on those mega plantations for all, not to mention cutting down the forests and displacing the people there.  On top of that, there is a drought.  So, people in desperation send th ...

Jeb Bush--immigration/SantorumJan 25, 2015
"Immigrants are an engine of economic vitality.  There is no way they are going to be deported.  No one is suggesting an organized effort do that."  Santorum--wants to build the unskilled labor pool in U.S. by excluding immigrants because they are taking American jobs. I suppose there is hope for us, once we all lose our jobs--according to Santorum.  Okay, show of hands, how many want to go pick stawberries?  Or, if that isn't going to be our job, how about your k ...

Food For Thought On The Immigration BanMar 17, 2017
Did anyone read it? i did. Liberals and Trump haters are saying it's a Muslim ban. IT IS NOT.  The word Muslim was never mentioned in the EO i read. It explained the reasons very well for why the government wanted the ban on those countries. Don't forget Obama also did a similar thing in 2011. The difference between Obama's EO and Trump's EO is Obama didn't say anything about it. It was a secret. Trump spoke out about it. That's the ONLY difference.&n ...

Mayor Bloomberg On Immigration ReformJul 02, 2010
While I agree with some things said, I totally disagree with giving all illegals a "pathway to citizenship." http://abcnews.go.com/GMA/video/york-mayor-bloomberg-immigration-jobs-lebron-james-11071170 But, as I delve into more and more of this information, I found this problem with the current system with those applying legally to come to this country. Obama On Comprehensive Immigration ReformMay 12, 2011
President Barack Obama renewed his push for comprehensive immigration reform Tuesday, citing America's legacy as a nation of immigrants and saying that finding a solution for millions of undocumented workers is critical to the country's common future. "We define ourselves as a nation of immigrants -- a nation that welcomes those willing to embrace America's precepts," Obama said during a visit to El Paso, Texas. "It doesn't matter where you come from. What matters is that y ...

A Memo From The U.S. Citizenship And Immigration ServicesAug 03, 2010
This is an original undated (and unedited by me)memo to Alejandro Mayorkas. I cannot post it here. Arizona Immigration Law - In A Sense, It's Like There's Some Incentive ToMay 18, 2010
Trespassing law may turn more illegal immigrants into citizens By Jim Small - jim.small@azcapitoltimes.com   Published: May 17, 2010 at 7:02 am Arizona’s new immigration law may have been aimed at deporting as many illegal immigrants as possible, but an ironic side effect will allow more undocumented residents to apply for temporary work visas and permanent U.S. citizenship, according to research b ...

Judge Hears Arguments Over Az Immigration LawJul 24, 2010
I think this is a ridiculous argument on behalf of the Justice Department that the quote against the law will "trample on the rights of the hundreds of thousands of illegal immigrants." Since when do illegals have rights in this country? Another quote is "would burden the federal agency that responds to immigration status inquiries." Well, isn't it the job of the federal agency to respond to these inquiries?   Hopefully, the Judge will dismiss the lawsuit.   J ...

Gang Of Eight's Immigration Reform Is VERY FlawedApr 27, 2013
ICE Officer and President of the National ICE Council testified at a hearing on the immigration bill that the Gang of Eight are trying to push through Congress - again, without anyone being able to read it. Sound familiar? Will they have to pass it to find out what's in it? I am so disgusted with these Senators, a couple that I had high respect for...and now this. There are so many loopholes that it will be another fiasco. Back when the amnesty was passed, we only had how many illegals in ...

Immigration Reform S. 744 Passes SenateJun 27, 2013
Don't think it will pass the House. Border security is NOT first in this bill and Janet Napolitano is the one who will make the decision on whether the border is secure or not...and we all know she thinks it is secure...that's why they never finished the fence. Yet the border agents are saying it's not secure and....well, if it WAS secure, how did 11 Million illegal immigrants cross it? This bill also sets limits on ag workers, lower than what it is now.  BTW, vote was 68-3 ...
