If you haven't heard that Hillary Clinton is constitutionally ineligible to be president, be ready.

That claim has nothing to do with her birth certificate but rather with contributions to the Clinton Foundation by foreign governments.

According to conservative bloggers, those contributions violate the Emoluments Clause of the Constitution (Article I, Section 9), which generally forbids American officials from accepting "any present, Emolument, Office, or Title" from another nation. Because the foundation accepted payments from foreign governments while she held government positions, Clinton supposedly violated the Emoluments Clause and is disqualified from serving as our chief executive.

This is a dubious argument. First, it is not clear that the Emoluments Clause applies. The gifts went to the foundation, not to Hillary Clinton personally.

Critics dismiss this as word play and argue that the gifts in substance went to her. They claim that Clinton benefited from those contributions because the foundation subsidizes her luxurious lifestyle.

The Constitution forbids officials from accepting gifts from other nations, but it does not say what happens if someone breaches that rule. We should not infer the drastic penalty of disqualification when the Emoluments Clause explicitly allows Congress to permit officials to receive such gifts.

There is another constitutional provision that refers to emoluments, and it supports this point. Article I, Section 6 forbids a member of Congress from being appointed to any federal position "the Emoluments whereof shall have been encreased [sic]" during the member's term of office. As it happens, this Ineligibility Clause became an issue when Hillary Clinton was nominated as secretary of state. The salaries of all cabinet officers, including the secretary of state, got raised twice after she began her second Senate term.

The Emoluments Clause explicitly allows Congress to permit officials to receive such gifts.



Still, she was not disqualified from holding that post. Instead, before the Senate confirmed her appointment, Congress reduced the secretary of state's salary to what it had been before Clinton's second term.

There are entities out there just hoping to pounce and convince some unsuspecting or uninformed individual of something sinister and hoping to keep Trump out. That is not going to happen.

If people would open their minds and stop reading the hype and fake news from the left, they may actually enjoy life and feel invigorated for a change (after the last 8 years).
