Just had to post this after my ranting and raving

God giving us too much to handle. I took my ex to court to get more child support. I found out today he is going to (supposed to) pay over double what I was getting. this will help sooo much!!! Not sure what will happen if he does not pay, but the papers said something about contempt.

You need to contact the Division of Child Support Enforcement in your area. This money can be taken out of his paycheck, or you may request that it be made directly to them by him. If he is 30 days late, a summons for failure to pay child support is issued by them immediately, and you do not even have to get involved. You do not need a lawyer, and you do not even have to go to court. They handle everything.

Do not make agreements with him or handle this on your own. You do not need the stress or the legalities of it. Men do not get off scott-free or paying half the time like they used to. They use his social security number if he leaves the state. If he has no job, they withhold money from his tax returns. They do catch up to them, and pretty quickly nowadays.

because of the protective order, I did not have to be in court. He, however, WAS supposed to be there (they are garnishing his check now I do believe) and was not. The way things work sometimes....I wonder if he believes in karma now?

Just let the DCSE handle it. 20-25 years ago, my ex was ordered to pay $150 per week. I received my checks directly from the DCSE. It was taken out of his check or he paid it directly to them, I forget which. Anyway, over a period of a year or so, he would skip a week here and there, thinking they would not realize it. When the amount was behind by 4 weeks, they issued a summons for him for failure to pay child support. He called me and asked me why I was taking him to court. I had no clue what he was talking about. The DCSE did not notify me at all. They set a court date for him. I was not even invited to appear. They DO NOT MESS AROUND!!

My nephew also paid child support through them, deducted from his paycheck. He moved from job to job a lot. They used his social security number if he left one job, and just picked right up withdrawing at his next job even if he did not notify them. They also deducted 37% more if he was behind because of changing jobs. You cannot escape those people, even if you leave the state. If you use your social security number, they find you pretty quick.

As you have a protective order against your ex, it would be best that you not have to deal with him as far as child support payments go. He should answer directly to them. If he is behind, they withhold the amount ordered, plus 37% on any amount behind until it is caught up. This would save you much grief and legal expenses. Not to mention the fact that women should not have to beg the father of their children to support them. People who handle this on their own always get into disagreements on what should and should not be considered child support, or it gets behind, and they end up spending a lot of money on lawyers when they end up in court.

When my ex went to court, he had already caught up on the amount he was behind. The judge told him, "This is your one and only warning. If you are in here again, you will do some time."

when we first separated, he was ALWAYS saying what a hard time he was having financially. As this was the 2nd order I had to get against him, I am no longer communicating with him at all. If he needs to tell me something, he can text my daughter. She can tell me. I refuse to ever communicate with him again. I am glad to know he could do time if he falls behind again.

I was the only one cooperating with the court system to try and collect outstanding CS. Never saw one red cent in 6 years. I kept getting notices to appear. I would go and they would say because they could not get him served, they could not force a court appearance or issue an arrest warrant. go figure.

Does ex have a "real" job, making legal bucks? My idiot BIL got away w/ paying just over $100/month for his physically handicapped kid because the court based it on his previous x # of months' income, and during that time, he was on low earnings (because he works seasonal work), but when he works, he makes killer $. I def agree with going through the legal route as if, like in BIL's situation, his income increases by a certain %, they will automatically take it to a judge to get it increased. Good luck.
