is not particularly important to me. I figure when it is feasible Gitmo will be closed. The president realizes that it was a mistake to make that a priority and I don't see anyone disagreeing with him.

but I do want it closed and I want to see a restoration of universal habeas corpus. I don't just believe that all American citizens deserve a trial, but all human beings. Once we start saying that there is someone who doesn't get a trial, we leave it up to interpretation who does and doesn't deserve the rights, protections and responsibilities of the law. I also wanted to see an end to DHS and the military having the power to use extraordinary rendition, enhanced interrogation and the use of military tribunals for non-soldiers.
While all these were started by Bush, their continuation is one of the few points where I feel that fear of the government is justified. I have no idea if Obama has or would abuse this power, but its a power no government should possess over its people or any other.
On the other hand, since 99% of the detainees are likely terrorists, it's hard to fit it into my schedule. Also, not being the president, I don't have access to all the information. Still, at least for me, ideals are more important than survival, so regardless of the reasoning, I want them all set free, so we can try them and lock them back up.

Reps are going to make this happen for political reasons. They finally got the memo that the demographics are changing, but they're only doing it for the vote, no doubt.
But a promise from Obama and a feather in his cap when it happens!! :-)

Terrorists are housed in Gitmo. They should get a trial but not by American courts. While 99% of the terrorists are NOT citizens of the USA, they aren't privy to our laws and rules and they committed acts of terror AND war; so, they should be tried in military court or in a court like they had in WWII....and on second thought, by a neutral jury, none of Muslim Brotherhood or even all Muslim religion.

We have the right to hold that person indefinitely or commence a secret and therefore likely rigged military trial. You often post about your fear that Obama is an evil dictator, yet isn't saying "Well, they aren't us, so we can do whatever we want to them with no legal limitations," the very same position favored by most dictators? We have no mandate from heaven saying that as Americans we can do whatever we want to all human beings.
I can forgive these things being done in WWII to a certain extent because the entire world was broken and hundreds of legitimate governments had been toppled. The entire thing was a mess. That is not true today. We can't use the excuse that we didn't know better or couldn't handle it.
As for a neutral jury, whether or not there is an American Muslim on it doesn't change things. In the same way that when a Christian is on trial, I don't make them select an all non-Christian jury.
As for them being outside our laws, that's not true. America and the U.N. have specific guidelines about apprehending foreign criminals. As long as their crimes were on American soil, against Americans or in combat with American troops they can be apprehended and tried here. The same as if I went to a foreign country and committed a crime against them, they would have the right to hold me. Their governments can launch an official protest, but the official protests of countries like Yemen or Syria would mean nothing in regards to captured terrorists.
Do you honestly feel safe knowing the government can take you off the streets with no evidence or warrant or arrest order, hold you indefinitely, torture you the whole time and never even reveal to anyone what happened to you? Your family would never even know you were imprisoned.
The law is for everyone or for no one. Once you put people above the law or people below the law, the system is corrupt.

that is as eloquent, well thought-out, and as detailed as FH's. Even if it wasn't a point of view I subscribe to, it would be nice to read a conservative post that's not sprinkled with confrontational innuendo, that includes some kind of substance, and that is void of repetition from right-wing celebrities.
