Rep. Darrell Issa (R-CA), chairman of the House Oversight Committee, is preparing contempt of Congress charges against Attorney General Eric Holder for his failure to cooperate fully with the investigation into Operation Fast and Furious, the Obama Administration’s deadly gun-running program.  Warnings were issued, deadlines have passed, and it’s just about “go time.”

 

To this end, Issa has prepared an extensive staff briefing on the case, along with a draft of Holder’s contempt citation.  A press release from the House Oversight Committee says the briefing paper “explains what happened in Operation Fast and Furious, the hardships faced by the family of fallen Border Patrol Agent Brian Terry in getting truthful answers about his death, how agents who blew the whistle on the reckless operation have faced retaliation, and the carnage in Mexico that Fast and Furious has helped fuel.” 

 

Among the lowlights of this paper are the ATF’s discovery that two of the top ostensible “targets” for the operation that pumped thousands of American guns into the hands of Mexican cartel killers were actually FBI informants; Holder’s failure to provide documents in 12 of the 22 categories set forth in House subpoenas; the stone walls thrown before Agent Terry’s family as they investigate his death; an ATF whistleblower whose career was ruined on the pretext of punishing him for downloading $8 worth of applications to his smartphone; the appearance of Fast and Furious guns at crime scenes across Mexico, including the murder of a state Attorney General’s brother; and the dismaying decision of Patrick Cunningham, criminal division chief of the U.S. Attorney’s Office in Arizona, to take the Fifth instead of testifying before Issa’s committee.

 

At 44 pages in length, Issa’s briefing paper is one of the most comprehensive summaries of the Fast and Furious scandal you can read online. Issa appeared on Fox News this morning to discuss the case against Eric Holder, noting his reluctance to “say to the Administration that we’ve come to the end.”  He was very blunt about saying Holder’s Justice Department has lied to his committee.

 

In the middle of his appearance, the Justice Department released a statement – read to Issa while he was sitting in the studio – that said they’ve offered just about all the compliance they’re going to.  The Congressman did not seem terribly surprised to hear it.  Further stonewalling, he said, would be like Richard Nixon offering to release the Watergate tapes in fifty years, and the “drop dead date” for DOJ compliance with those House subpoenas is “immediately.”

In my personal opinion, it's not a joke.

Of course, the recommendation from the "experts" was to buy a lot of duct tape and plastic. There were many stupid, foolish things that the Republicans just ignored when those statements were made by our (s)elected President Bush.

However, given a choice of not caring about national security, an alternative statement would be to express the danger it really is. I wonder which the "enemy" would prefer.

Here's why. - It's simple.

There are already ongoing criminal Fast and Furious investigations and prosecutions being conducted by the inspector general. The documents in question contain law enforcement information, grand jury transcripts and other materials protected under the separation of powers provisions in the US Constitution and are not subject to Congressional subpoena for a variety of reasons.

Issa's 47-page rant isn't the first time he has exhibited hyperpartisan priorities that smack of GOP hypocrisy and politics of personal destruction. His unwillingness to allow testimony from Bush administration officials on how this program was conducted from its inception comes as no surprise, confirming his obvious reluctance to present the full picture and his underlying motives of targeting Eric Holder and the Obama Administration (AGAIN).

His failure to notify committee minority members of the pending citation is further evidence that this is more about keeping his vendetta front and center in the media rather than advancing the investigation in any meaningful way. His constant grandstanding on this in fact serves the purpose of undermining the Justice Department's own investigation. Issa is also being motivated by his underlying paranoid angst based on the conspiratorial notion that the Fast and Furious program is somehow being used by to expand government databases on gunowners to be used in some imaginary way to restrict 2nd Amendment rights.

Issa was born in the wrong place at the wrong time. He missed his calling as Dishonorable Grand Inquisitor for the Salem Witch Trials yet to this day is still attempting to assume his own 21st century version of that role. Transparent. Unimpressve. My question would be, if the Oversight Committee is so convinced they have a legitimate case, why not simply wait until the ongoing investigations and prosecutions by the inspector general are concluded before proceeding any futher? Oh, of course. That would mean sacrificing all that perceived partisan advantage of cultivating and nurturing Obama Administration scandals between now and the election. What was I thinking?

entitled the Respect for Marriage Act has passed a Senate Judiciary Committee vote by 10-8 in Nov 2011, clearing the way for it to be introduced on the Senate floor. However, like every other ill-fated measure stalled in the mountainous Senate backlog, it would probably be filibustered to death by GOP obstructionists, so it currently sits idle in committee.

Eric Holder and President Obama are not the only ones who deem DOMA unconstitutional. In 2009, US Court of Appeals for the Ninth Circuit Judge Stephen Reinhardt declared DOMA unconstitutional in an employment dispute resolution tribunal in 2009. A similar ruling that same year from Judge Alex Kozinski (9th circuit) was issued in another employment tribunal in favor of the employee (Karen Golinski), but the employer refused to comply with the court's order to allow her to purchase insurance for her wife. She then sued the employer in federal court and in the process the DOJ took up the constitutionality argument. On 02/22/12 Judge Jeffrey White ruled in her favor on the grounds that DOMA violates her 5th Amendment rights to equal protection under the law, stating that DOMA could not pass the "heightened scrutiny" requirement based on deliberate discrimination against gay and lesbian people by private and federal entities.

In July 2010, Judge Joseph Tauro ruled on two separate actions, one challenging the definition of marriage under DOMA and another complaint that Congress had overstepped in authority to undermine state's efforts to recognize same-sex marriages. In the first action,he found DOMA was in violation of th 5th Amendment Due Process Clause and in the second action, he found DOMA was in violation of the 10th Amendment.

Second Circuit judges issued similar opinions November 2010. There are at least six pending actions in states and federal courts, one of which the DOJ is actively arguing DOMA unconstitutionality.

IMO, Holder and the DOJ are doing precisely what they should be doing, by refusing to uphold a measure that has clearly been demonstrated to violate the Constitution on multiple levels.
