Eric Holder's firm, Covington & Burling, volunteered its services to at least 18 of America’s enemies in lawsuits they brought against the American people. During 2007 alone, Covington contributed more than 3,000 hours of free, top-flight legal assistance to our enemy detainees at Gitmo.

If this is so, (questionable source) it can be viewed in 2 very different ways. The first way is that it is a conspiracy - linked to Obama of course. The second way is to acknowledge that in our country's legal tradition all accused deserve adequate counsel. Also to show the world that the trial will be fair; they will be represented by some of the finest. You can take your pick.

The right to legal representation is given to anyone in this country who is accused of a crime. If they cannot afford an attorney, one will be appointed for them.

EXCEPT for people arrested under the Homeland Security Act, most of whom are interned at Gitmo. The Bush administration enacted law that allowed us to basically lock those people away and throw away the key. They have rarely been given access to legal counsel, they have never been tried and all of their rights have been violated.

Now, before you go on saying that "well, they're terrorists and they have no rights," keep in mind that none of them have been convicted. Heck, 98% of them haven't even been in any kind of trial at all. Innocent until proven guilty has never been allowed to apply in that situation.

So we have become the great land of "do as I say and not as I do." We spout on and on about human rights violations in other countrys and make a big deal about it when other regimes do it, but hey, it's okay when we want to do it.

If terrorists are suing Americans (and I agree with you regarding questionable sourcing), are they suing us for the torture they underwent at Gitmo that was against the law when Bush was president?

If so, that's basically a personal injury case, and it's common, if not universal, in America that the attorneys who bring forth these kinds of actions do NOT get paid until their clients do. (I'm sure you've all seen commercials on TV for attorneys who promise no fee until you're paid, etc.) That sounds like the kind of case it might be.

If these attorneys are defending the alleged terrorists in a criminal matter, then they usually do get paid up front OR they accept "pro bono" counsel for free.

If it's being alleged that "they sued Americans," then it sounds like a civil matter to me, and the attorneys, of course, wouldn't be paid until the trial is over, and then they would take a percentage of the award.
