Obamacare to Penalize Native Americans?

I felt this article was important enough to post the whole thing since it was short. I put a question mark in the subject line because I haven't refreshed myself on Obamacare in over a year and at the rate they keep changing it and/or adding regulations, I don't think I want to try to read it again.

When Liz DeRouen needs any kind of health care services, from diabetes counseling to a dental cleaning, she checks into a government-funded clinic in Northern California’s wine country that covers all her medical needs.

Her care and the medical services for her children and grandchildren are paid for as part of the government’s treaty obligations to American Indian tribes dating back nearly a century. But under President Barack Obama’s health care overhaul, DeRouen and tens of thousands of others who identify as Native American will face a new reality.

They will have to buy their own health insurance policies or pay a $695 fine from the Internal Revenue Service unless they can prove that they are “Indian enough” to claim one of the few exemptions allowed under the Affordable Care Act’s mandate that all Americans carry insurance.

“I’m no less Indian than I was yesterday, and just because the definition of who is Indian got changed in the law doesn’t mean that it’s fair for people to be penalized,” said DeRouen, a former tribal administrator for the Dry Creek Rancheria Band of Pomo Indians who lost her membership amid a leadership dispute in 2009. “If I suddenly have to pay for my own health insurance to avoid the fine, I won’t be able to afford it.”

The Affordable Care Act takes a narrow view of who is considered American Indian and can avoid the tax penalty, which will reach a minimum of $695 when fully phased in. It limits the definition to those who can document their membership in one of about 560 tribes recognized by the U.S. Bureau of Indian Affairs.

ME, not Congress or Sebilius. I haven't read the law lately to see if changes were made. Everyone knows that they were/are tweaking the law every so often and making changes since they passed it.

At risk of being reprimanded for changing the subject, the statement was made by you that preventive testing/mastectomies were not covered under the ACA and since you haven't read the law lately, that statement may not have been true.

But okay, i misunderstood your reply to my post. I post articles and I post my opinions once in a while, but mostly, I post articles.

As for reporting you for using the word "you",you can't just stop using the word "you" meaning general people. Some posters will report someone for no good reason, just because they don't like the poster or because they just want to make trouble.

Since I've been a member of this board since 2007, I've reported a poster about 8 times for really nasty things. So, watch it...it's almost time again. LOL (just kidding).

Actually even before the boards were split, but I'm not sure of the year, definitely pre-Obama.

That aside, my point was that people shouldn't throw statements around in one post about what is and what is not covered under ACA, then admitting in another post that ACA may have included a certain scenario since a personal review in the last year.

do I detect a sudden shift in beliefs that defend the rights of certain select cultural groups (in this case, Native Americans) to become permanently ensconced in a moocher/taker underclass on taxpayer dime? When did these partisans do their 180 and decide to advocate for resisting assimilation into the greater whole of American society?

A couple of things. First, the decision to add the question mark to the article's title was well advised, especially considering the tenuous nature of its entire premise as evidenced by the use of the subjunctive mood verbs, like:

DeRouen's statement: "IF I suddenly have to pay for insurance..." (the implication being that eventuality is yet to be determined).

Children under the age of 18 "MIGHT not be considered..."

This "COULD lead some tribal citizens to face penalties..."

As the article unfolds we see it contains a number of caveats to its own main supposition. It would appear there is a legal precedent that ultimately will favor the disposition of Native American identity definitions, namely the legal precedent established by their being qualified to receive IHS medical care despite their belonging to tribes previously disbanded by the feds. The article states the entire groups as a whole may ultimately qualify for enrollment in Medicaid. Then we have Rep Tom Cole who has stated his intent to insure that Native Americans who receive care under IHS will continue to do so under Obamacare.

Under current law, the 28% of the 6.2 uninsured Native Americans who live in poverty (1,736,000 of them) will be exempted from penalties since they already qualify for Medicaid. Other exemptions that apply to this group include those whose incomes fall below the filing threshold, those who cannot afford state exchange plans at any given time during the year, and those who fall into the coverage gap created by states' Medicaid opt-out provisions. I also find it interesting that "some" tribal elders actually advocate for tighter restrictions on tribal membership enrollment.

Since there are so many variables inherent in these different circumstances, it would appear prudent to simply wait and see what comes out of the May 29th public hearing and allow the situation to evolve at its own pace, rather than trying to draw rash conclusions in an effort to gin up yet another hypothetical scandal.
