Alabama Immigration Law Signed By Governor Robert Bentley

Can you imagine a woman and a child walking down the highway in 100 degree temps and you are charged with a crime if you pick them up?

MONTGOMERY, Ala. — Alabama's governor on Thursday signed a tough new illegal immigration crackdown that contains provisions requiring public schools to determine students' immigration status and making it a crime to knowingly give an illegal immigrant a ride.

The bill also allows police to arrest anyone suspected of being an illegal immigrant if they're stopped for any other reason. Alabama employers also are now required to use a federal system called E-Verify to determine if new workers are in the country legally.

Gov. Robert Bentley said the law is the nation's toughest, and groups including the American Civil Liberties Union and the Montgomery-based Southern Poverty Law Center agree. The groups say they plan to challenge it.

The legal director for the Southern Poverty Law Center, Mary Bauer, said Thursday that she expects a lawsuit to be filed before the provisions of law are scheduled to take effect on Sept. 1.

"It is clearly unconstitutional. It's mean-spirited, racist and we think a court will enjoin it," Bauer said.

Bentley, who campaigned on passing the toughest anti-illegal immigration bill possible, said he believes the measure can withstand legal challenges.

The House sponsor, Republican Rep. Micky Hammon of Decatur, said the bill was written so that if any part of it is determined to be unconstitutional or violate federal law, the rest will stand.

Alabama's measure was modeled on a similar law passed in Arizona. A federal judge blocked the most controversial parts of Arizona's law last year after the Justice Department sued. A federal appeals court judge upheld the decision, and Arizona Gov. Jan Brewer has said she plans to appeal to the U.S. Supreme Court.

Neighboring Georgia also passed a law cracking down on immigration this year, and civil liberties groups have filed a lawsuit trying to block it.

Hopefully it will stick and more states will follow suit and crack down on illegal immigration. It's not racist to crack down on illegal aliens. If the civil liberties groups don't like it, then let them support all these aliens. It's not racist against the Hispanics, as what seems to always be mentioned, it is just that our country borders Mexico so most of the illegals are Mexican. DUH!

I for one am tired of illegals coming here and getting all the freebies and people in our own country who are legal can't get any help. Good for all the states cracking down on it.

I don't pick up hitchhikers, so I don't see this being a problem for me. Can you imagine people sneaking into this country illegally and the gov't ignoring it?

It's easy for all immigration laws to be labeled as racist - they're immigrants for gosh sake! Good for Georgia and Alabama.

none of these punitive measures address the root causes of illegal migration, which are primarily economic. As an example (one of many), poverty in countries of origin (which leads to billions in remittances every year) and willingness of US employers to exploit cheap labor (depressing overall salary and wage structures) are major factors. Mexico ranks third in remittance amounts behind India and China, yet these laws will undoubtedly target Mexicans in inordinate proportions to other groups of undocumented immigrants.

Because of the racial profiling aspects local law enforcement (who are not trained in immigration law) assuming the jobs of immigration officers (who are) 25% of all illegals (Non-Hispanics) will be virtually overlooked. Racial profiling cannot be strictly confined to illegals. The result will be arrests of legal residents and citizens as well. My son, born and raised in Texas and whose dad is Middle Eastern, has been racially profiled 5 times in the past 2 months, stopped and harassed WHILE RIDING A BICYCLE. He is having REAL problems with this. It is a bad idea.

In my state, recent attempts to pass similar measures brought law enforcement groups from all over the state to the capitol. The overwhelming majority of them argued against the proposals, citing concerns over stretching already limited recources too thin, trust problems they anticipate would arise in minority communities and many other reasons they believe such laws would drastically reduce their ability to do their jobs effectively.

Missing from this picture is the less punitive approach of expanding avenues to legal status. Finally, it is impossible to have this discussion without mentioning two more words: Trade treaties.

There are many places in Alabama where illegal immigrants are known to reside and people go to those locations to pick up day laborers. The Hispanics depend on the person picking them up for transportation. This is common life for them. Sometimes they go out with someone who refuses to return them to their neighborhood, or they quit the job early and have return transportation refused by the person hiring them for the day.

I can tell you that this is a situation where it is not infringing upon any legal status resident's ability to work. If a legal resident wants to go to a location known for the congregation of day laborers to find a day job, they can do that. In fact, I also know where good ole Americans congregate for the same purpose.

I also have a BIL who hired a day laborer and due to his own negligence, the day laborer was out on the side of a road, was struck by a tractor-trailer truck and killed.

The bill is not meant to be racist against a group of people. It is to force people breaking the law and placing human beings in danger to comply with the law.

Before you blow that racist whistle, you should take the time to found out why a bill was written.

Employers are required to get I-9s on employees. There were several very large employers around here who were raided with lots of undocumented workers. You know this is blatant disregard of the law, but they do it all the time. Why?

•For employers who knowingly hire or knowingly continue to employ unauthorized workers, civil penalties range from $250 to $11,000 per violation.

So, they can probably still hire for less than the fine costs? I am not sure if this has changed or is changing, please enlighten me if you know.

I think this needs to be a CRIMINAL OFFENSE WITH MANDATORY JAIL for the CEO and CFOs.

It seems like these laws just try to hurt the people who are already here. It is like the drug problem--I think leave the addicts alone and go after the dealers, as in my example the CEOs.

While we are at it, how about raising the amount of fines? Take those thousands of dollars in fines and set up a fund of some kind to aid immigrants. They could pay for private school to learn English or help with finding employment with a legitimate employer or help them find a place to stay until they become settled.

It would be nice to see the money collected for the fines to help the actual victims (exploited immigrants) for a change.

It's a matter of not being able to be represented by our laws out of fear for deportation. To answer your question, an illegal immigrant can be a victim of any employer if the work conditions are poor, pay is below minimum wage (if pay is given at all... day laborers get stiffed all the time), injuries occur, abuse/harassment occurs, etc. An undocumented worker is less likely to report violations of our laws, and employers can and do take advantage of that.

and they have the right (duty!) to remove themselves from that situation. It isn't like a victim of robbery or rape who was abiding the laws when someone offended their legal rights. These people come here knowing the risks, accepting the risks, living with the risks and then want to claim to be a victim. Why do we even need to have these laws? Because people are coming illegally into our country, creating the problems and we need to protect legal citizens first and foremost.

That whether or not a person is here legally, they are still a person... a human being who deserves to be treated like one. I'm not disagreeing with you that if someone comes here illegally that they are committing a crime; however, what does it say about us if we take that as license to treat another human being poorly and violate the law in the process... all in the name of cheap labor?

Abuse comes in all forms. Immigrants illegal or otherwise want to jump on the human rights band wagon to take advantage of someone willing to treat them right.

Two months ago I moved and used Hispanic day laborers. Just a 2 bedroom apt, was willing to pay 2 workers $10/hour, feed them, pick them up and take them home. My son did the picking up and 3 got in the car and refused to get out. He brought them to my place. When I saw 3 instead of 2, I explained they would need to work at a fast pace if everyone wanted to get paid a decent wage. I gave them the option of staying or leaving. They decided to stay, worked one hour and then quit. They didn't want to work as hard as I explained (no, I wasn't wielding a whip, yes I offered cold drinks). They were just lazy and I got stuck with THEIR issues. They threatened to call a lawyer if I didn't pay them $15 an hour each AND transport them home (in the middle of my move).

I gave them the option of keeping the deal as is, paying them $10 an hour each, feed them and take them home when the job was over. They refused and stuck to their demands. I called the sherriff to come out. I made the officer witness my handing over the money to them. At this point, I'm a single mother and I don't know what they would do next, so the officer stayed until they left the property.

Abuse comes in all forms. Two days later I was able to get Hispanics who were willing to work, happy with the pay and conditions and basically saved me from a lot of hardships the first workers put me in.

My point being: If illegals find themselves in a situation they feel is abusive, they have the right (which I fully support) of LEAVING.

I'm not saying that every immigrant who comes here is an angel being abused at the hands of American citizens. You asked an original question of how people can be (and are) victimized, and I answered it. The point is, it happens, and the fact that they don't have proper documentation does not give anyone the right to treat another person poorly and break the law in the process.

I'm sorry if you had a bad experience with your move, but I have to ask the question... were the "Hispanic day laborers" legal? If so, the story doesn't really relate to the conversation since my point is regarding employers taking advantage of the undocumented workers.

I'm not one who agrees with amnesty for illegals and I'm all for enforcing immigration laws. That being said, there are some horrible things that people endure to come to our country and no human deserves that treatment. Stories of truckloads of immigrants loaded like cattle and who die in the heat of the trailer should make anyone angry enough to begin to question how the immigration system is set up. We can do better.

If you read the news feeds about the Alabama law, it mentions the trafficking issue as a problem. I'm not talking about any sort of rights violation that harms a person's body, but immigration abuse problems (paying not paying them, etc.) has been around since B.C. As long as we are not whacking 'em with whips, using their backs instead of mule or mechanical power, these are issues they need to deal with. I'm NOT saying it is okay to treat anyone this way. I am saying it happens and they accepted these risks upon entering the country illegally.

and Alabama was not one of the few states that tried adopting their own immigration laws. 150 years ago, they were too busy trying to preserve their plantation systems, gain control over their illegal immigrants (45% of the population were abducted Africans brought there in chains on slave ships) so they could KEEP them, not send them back.

It's easy to be legal when there are no laws.
