Well, seems obvious that they did exercise their judgment to avoid - "collateral damage" from an arrest.sm

At least I'd be surprised if they hadn't in this case, when an election might well be influenced by mischief-makers (their "Congress and media").

It does happen all the time at all levels of law enforcement, from officers on the streets making judgment calls that take into account more factors than just the technical legal issues right on up to Washington.

When a teenage girl crashed into my car, then sped off (all of 2 blocks on the same street, where she was easily found at a friend's house), I was interested to see the police "talk me out of" having them arrest her for a hit-and-run. Not that I had the slightest intention of pressing felony charges against a stupid 16-year-old, but some people wouldn't consider count the consequences to her in pursuing "justice" without that sort of massaging of the situation by the officers.

(Since I was a mom, BTW, I did ask them to tell her that I was VERY upset that she had driven away like a criminal and that they had a hard time talking me out of sending her to jail. :)

Face it truthfully. Their "reasoning" of "exercising judgement" had nothing to do with anything EXCEPT that the Senator was up for re-election and would have been damaged if his intern would have been arrested and deported prior to the election.

Truth of the matter is, the Senator KNEW his intern was not legal. He had to know if he went through the proper channels.

He wanted to win that re-election at all costs and did everything he could to make sure of it. Another not-so-truthful-politician-who-cares-only-for-himself-not-the-people-he-supposedly-represents.
