What is the type of attorney called when they are specifically

hired for a child's rights? I am trying to find someone who will actually fight FOR my son (and me) and not against us. I just paid this creep $3000 to basically tell me my ex (all the horrible crap he has done) is okay and I am not. Long story, but suffice it to say my son will not get help. I cannot understand the "system."

A guardian ad litem is usually in the case of a disabled or incapacitated adult or senior, or legal guardian in the event of death for a minor child. This sounds more like a family law/child custody, etc. situation. If you feel you have been swindled by your attorney or received inadequate representation, you should contact the state bar in your state and get the information to file a formal complaint against the attorney so that this can be properly investigated. If your attorney filed legal representation of you and/or your son, then he/she is duty bound to advocate for you and not your ex. Get all your documentation together and contact your state bar association. Have your attorney provide you the documentation (the actual work done as well as the actual bill for that work) for every minute you were billed against the $3000. Get your contract that you signed for the services out and review it in detail. Find out if complaints by other clients have been filed against this attorney. If your attorney is part of a law firm, send a letter to the CEO, COO or controlling partners of the firm; if not, then at least to your attorney, and mail it certified mail with return receipt. If you have not done a certified mailing before, then in addition to the actual certified slip with the green return receipt card, you need to make sure that the letter you mail has "SENT VIA CERTIFIED MAIL/RETURN RECEIPT #____" on a reference line before your greeting. So you will need to get the certified slip from the post office before you finish your letter, so that all who are sent the letter have the certified number on them. You may want to make a trip to the post office to get more information about doing a certified mailing, or maybe you can get the info on their website. The letter should state the details of what your attorney said they could do at the meeting in which you signed the contract, and the details of the inadequate representation and how you felt that he/she was advocating for your ex. Do some internet research on family court advocates in your area and how they can help.

True, a guardian ad litem is typically assigned to represent someone who cannot speak for themselves for whatever reason be it mental, medical, or just not old enough to legally represent themselves. Sometimes, it's a temporary arrangement until someone more permanent can be selected. Sometimes, this person will see their client throughout the case. I'm not sure why this case requires a guardian. If a good lawyer represents the mother and she's the one with custody, the child is represented as well. If custody has not been assigned and war between the parents can't be easily resolved, then perhaps separate representation for the child would be required. Could also call local social services office to see what they can do. A social worker could be assigned to evaluate the situation and help be a voice for what's best for the child. Best if both parents can work together on this. I've seen things like this turn into a Pandora's Box which created all kinds of unexpected problems once opened.

There are a lot of pros and cons to social services involvement and other avenues such as parent/child advocates outside of state/local social services and mediation deserve exploration before involving social services, unless there is abuse or neglect regarding the minor child.
