Not only did he introduce a theory at opening arguments he KNEW he could not prove with evidence by testimony, he opened WAY too many doors for the prosecution.
All he had to do was to show that prosecution had no HARD evidence on many levels, which he could have done, had he not made rookie mistakes, or pushing the envelope. He forced the burden of proof on the defense. Had he not done that, he would have more than likely saved her from death sentence, which I think will happen anyhow since it's obvious Casey caused the death, but it has not been proven beyond a reasonable doubt she did it on purpose. (But please, this is not the point of my post, so I'm not inviting a debate on this.)
However, the other thing is... has anyone noticed how chummy and almost flirty Baez and Linda Burdick are? They even walked out of the court room together today. Saw them leaving in the hall (HLN feed). During certain courtroom feeds where the jury is not there, court not in recess, participants just milling around for whatever reason, the two gravitate and laugh and talk and flirt. I know opposing teams, when not in battle, do socialize, but IMO, this really goes too far.
At any rate, if I was Casey, I would definitely not appreciate them laughing and flirting right there in the court room. I would NOT want my lawyer fraternizing with the enemy in such a way at all. Maybe he is throwing the case? I doubt it, but Casey does seem oblivious to it... surprise, surprise.
And just to make it clear, I do think she is responsible for her child's death.
