to the whole process before Harry Reid changed the rules in 2003 to stack the lower courts, and then again in 2013. There was never a filibuster in the Senate before that.

Actually, the framers of the Constitution specifically rejected the notion - of a "super-majority" anyway.

They specifically considered provisions that would have required 66 or 60 votes in the Senate to pass laws, confirm appointments, etc - and REJECTED THEM. This idea of a super-majority is now and always has been both ill-advised and unsupported by the Constitution.

The reasoning of the Framers was that a super-majority requirement would result in "the many being ruled by the few" - a distinctly un-democratic notion. The super-majority rule is a relatively modern ill-advised invention and has resulted in precisely the sort of stalemating and obstructionism that we've seen practiced now by both major parties.

Some Senators have lamented that eliminating the super-majority "changes the way the Senate works." Well, yes it does. It changes it BACK to the way it was always INTENDED to work - and it should be eliminated for EVERYTHING, including the passage of legislation.

The most fundamental concept of democracy is majority rule! Our legislature is the most perfect reflection of the electoral majority that we have, short of eliminating Congress entirely and submitting all votes directly to the citizenry.

The super-majority is not Constitutional, never has been, and has been the direct source of grave dysfunction in Congress. If you've wondered sometimes why Congress never gets anything done (whether something you like or not), now you know why.

appointed by their states. We don't even need 9 SC justices. FDR packed the court. Before that we didn't have 9. There is no constitutional law for 9 SC justices.

We are about 180 degrees away from the way things were intended.

At least the change in selection of senators was done by a proper - Constitutional amendment - 17th.

The concept of requiring a super-majority in order to get anything done is nothing but a stupid procedural RULE of the Senate and is a violation of democratic principles on its face.
