More on the foreign workers doing jobs

Posted: Aug 1, 2017

These workers are hired on B1/B2 visas and told what to say to immigration officials when arriving to this country and given letters to give to immigration officials.  Apparently, this type of visa allows you to work in the USA in a supervisory capacity, but they are not.

Mercedes-Benzi states that it "contractually requires all of its contractors to comply with all applicable laws, including those laws and regulations related to immigration, safety, wages and hours."

Of note, Mercedes-Benz has fired one of it's subcontractors that were not following these laws.  This has apparently been going on for quite some time in companies like Volkswagon, Mitzubishi and other foreign car factories in this country.

It remains to be seen if the actual companies knew about it, but it sounds like they need to keep better in-tuned with the subcontractors they are hiring and what they are doing.  Although 1000's of American jobs were lost over this, hopefully this abuse of visas will end.

A few points stood out to me.

* It started 3 or 4 years ago.
* The car companies hired contractors who hired contractors. Not unlike the situation in MT where a hospital hires a US company who then subcontracts all over the world.
* The subcontracting companies took advantage of unenforced immigration laws. As you mention the B1/B2 visa program. They also claimed their workers were more specialized than they were.
* The foreign contractors often worked 7 days a week 12 hours a day for $10 to $11 an hour. US contractors would make $40 to $50 an hour.
* One excuse offered by the subcontracting companies was that these workers knew how to build plants to European standards. Not sure how accurate that is. The CBS reporter asked a foreign steelworker who's now an American citizen how accurate that is. The steelworker scoffed, saying "what European standards? America is the best."

It seems to me that this is a sin of convenience. The car companies wanted their factories built as quickly and cheaply as possible. US-based companies had workers available. The US companies then contracted out to foreign companies and imported foreign workers.

They got away with it because of lax immigration enforcement.

CBS didn't give specific dates, but they did show trade shows and the resulting cars produced by the foreign-worker factories. They also interviewed people in Croatia/Serbia (I don't remember exactly) who worked on the finished plants mentioned: Mercedes Benz in Alabama, BMW in South Carolina, Tesla in California. These facts -- workers back in their home country, factories rolling out new cars -- would imply that their examples and investigation happened in the past, but it may be an ongoing situation with other auto factories.

Whether the new administration do better at clamping down on this kind of stuff remains to be seen. This was a fairly good example of abusing legal immigration laws and no one in the government following through or even using simple logic to sniff out something fishy. No one bothered to think, "Why does this construction project have hundreds of supervisors and no workers?"

All in all, very interesting. Thank you for posting. I'm glad I learned about that. :)
