5/5/14: A federal judge said Thursday she’s inclined to split the difference between Congress and the White House in a lawsuit stemming from President Barack Obama’s decision to shield some Justice Department records from a House probe into the flawed gunrunning investigation known as Operation Fast and Furious.
Last year, the Obama administration asked Jackson to throw out the lawsuit, arguing that the dispute was not an appropriate one to be resolved by the courts. She ruled to the contrary, allowing the case to go forward.
The Justice Department asked to appeal that decision immediately, but the judge declined to authorize the appeal. The administration will be able to appeal once the judge makes a final ruling in the case.
