Discarded Palin contract sparks investigation

SACRAMENTO, Calif. – A document fished out of a California state university trash bin last week has prompted a state investigation into the university's foundation arm and its refusal to disclose details related to Sarah Palin's upcoming speech at the school.

On Tuesday, California Attorney General Jerry Brown said his office would look into the finances of the California State University, Stanislaus Foundation, as well as allegations that the nonprofit organization violated public disclosure laws by keeping details of Palin's contract secret.

Palin is scheduled to speak at a June 25 gala hosted by the foundation to mark the university's 50th anniversary.

Brown's investigation was prompted, in part, by a group of CSU Stanislaus students who retrieved five pages of the contract from a campus trash bin last Friday after hearing administrators were engaged in shredding documents.

The contract detailed the former Alaska governor's requirements for her visit, including first-class flights from Anchorage to California — if she flies commercial. If not, "the private aircraft MUST BE a Lear 60 or larger ...," the contract specifies.

Palin also must be provided with a suite and two single rooms in a deluxe hotel near the campus in Turlock in the Central Valley. During her speech, her lectern must be stocked with two water bottles and bendable straws.

The document, dated March 16, does not include compensation details for Palin, who commands speaking fees as high as $100,000. Her appearance at the university gala is expected to draw a large crowd, with tickets selling for $500 each.

"This is not about Sarah Palin," Brown said in a prepared statement Tuesday. "The issues are public disclosure and financial accountability in organizations embedded in state-run universities."

The foundation has previously denied requests by The Associated Press and state Sen. Leland Yee, D-San Francisco, to disclose Palin's compensation package under the California Public Records Act.

Foundation board president Matt Swanson did not immediately respond to requests for comment on Brown's investigation. He previously told the AP that the contract's strict nondisclosure clause prevented him from sharing it, and that university foundations and other auxiliary organizations were not subject to the same public records requirements as the university itself.

Swanson has said Palin's fee and accommodations will be covered entirely by private donations, not state funds.

Jason Recher, a spokesman for Palin, did not immediately return a call seeking comment.

The students who found the contract document said they acted on a tip that documents were being shredded at the campus administration building on a day when staff members were supposed to be on furlough.

Alicia Lewis, 26, was one of the students who went to investigate. The building was locked and gated, but the students were able to retrieve piles of paperwork, including the contract document, from a nearby trash bin, Lewis said.

Russell Giambelluca, the university's vice president of business and finance, said Tuesday that no one at the university was advised to destroy specific foundation documents, and staff members routinely shred and dispose of paperwork that is no longer needed.

Regarding the excerpt of Palin's contract, he said: "I find it interesting that among shredded documents you find one that's completely intact related to the contract."

Lewis and another student, Ashli Briggs, traveled to Sacramento Tuesday to give Brown office material they said had been thrown out, including two boxes of documents and two trash bags filled with shredded files.

"This is our little Watergate in the state of California," Yee said Tuesday.

No one is complaining about her either, despite her voracious appetite for fame and fortune and self-proclaimed divahood of late. More to the point is exposing her for the hypocrite she is every single time she reveals herself as such.

No one is trying to convince her worshipers of anything. Articles like this and folks inclined to post them are simply trying to answer the question, who is Sarah Palin? This contract clearly confirms the fact that she is nothing more than a money-grubbing diva and a cheap opportunist, that's all.

"CSU Stanislaus President Hamid Shirvani has issued the following information and statements in response to Attorney General Edmund G. Brown Jrâs announcement Tuesday evening that he has launched a broad investigation into the California State University, Stanislaus Foundation to include an examination of its finances and the alleged dumping of documents into a university dumpster.

âWe welcome the investigation and expect it will clarify how a foundation document could have ended up in a state senatorâs hands,â said CSU Stanislaus President Hamid Shirvani.

The addendum of the campusâs contract with Sarah Palin released yesterday at a press conference by state Senator Leland Yee was in a recycle bin in the office of CSU Stanislaus Foundation Executive Director Susana Gajic-Bruyea. After learning about the allegations made at the press conference, Gajic-Bruyea searched for the document in her private recycling bin and found only that document missing. Campus police are currently investigating the circumstances surrounding the document taken from the recycle bin.

In response to Tuesday morningâs press conference hosted by Yee, California State University, Stanislaus Foundation Board President Matt Swanson made the following statement:

âItâs a dark day when an entity thatâs sole purpose is to raise money for student services and university programs is falsely accused of wrong-doing. The foundation is a 501c3 that raises money for the university. Our sole aim is to raise money for university programs and student services. Given declining state support for higher education, private fundraisers are more vital than ever.â

In response to allegations that documents were destroyed, Russ Giambelluca, CSU Stanislaus Vice President of Business and Finance said, âNo one was instructed to destroy vital information, and no one did so.â

Since announcing the Gala event, CSU Stanislaus has faced a myriad of false accusations and implications from a variety of individuals and organizations.

âThe CSU Stanislaus Foundation is not interested in political theater or in being used as a political pawn. Its mission is to raise money to support the university, and it is doing just that by bringing a speaker to campus like Sarah Palin who is driving ticket sales to unprecedented levels,â said Shirvani.

Shirvani continued, âThe CSU Stanislaus Foundation responded to Public Records Act requests for a copy of the contract and speakers fee by stating that as a 501c3 foundation, it is not subject to the Public Records Act and for good reason. The Washington Speakers Bureau contract includes a confidentiality clause that the Foundation cannot breach even if it wanted to. The Foundation has clearly stated that it will be happy to provide the net costs and net revenue of the event, which would be sufficient for anyone whose true goal is transparency. The Foundation has made it clear that no public funds are being used to support the event. The Board President has also made it clear that no existing foundation funds are being used to support the event. Every dime used to pay for this gala is new, privately-raised money.

âThe June 25 Gala is expected to raise between $100,000 and $200,000, which will go toward enhancing studentsâ education. That is money that would otherwise not be available to support our students. The Foundation Board should be applauded for working hard to fulfill its mission by raising money to support CSU Stanislaus when state support for higher education continues to dwindle.

âSarah Palinâs speaking engagement will raise more money than any single fundraiser that CSU Stanislaus has had in the past, including from people who have never previously donated to the university or supported university events. Whether one agrees with her politically or not, the money raised from this event is a good thing for this university.â
