My niece was arrested for DUI in KY last month

My niece was arrested for DUI in KY last month and had her court date Monday. She was fined $800 and was supposedly told she could never step foot in KY again. Also supposedly the judge told her he was sending her arrest record to Ohio and Ohio would probably take away her driver's license.

A) I don't see how someone can be prevented from driving through a state.

B) I don't see how Ohio could take away her driver's license for an offense committed in Kentucky.

If they took her driver's license away, then she can't drive in any state. Perhaps she is a repeat offender? Perhaps she is embelishing her story to you? Arrest records are "in the system" and can be accessed from any state. They also become public records, available to anyone.

From a personal point of view. ANYONE as far as I'm concerned who gets a DUI shold have their license permanently revoked and not allowed to drive on our streets, period.

I totally agree. I was hit by a car load of drunk teens. They all jumped and ran. Of course the driver didn't have insurance, wasn't even legal age to drive, and a law suit is still pending, 5 years later. He's still on the streets now, with a license even! I had (have) medical bills and will probably never be reimbursed for what he owes me.

Kentucky has some of the strictest DUI laws in the country. I have a feeling you aren't getting the full story. The fines for first offenses range from $200-500; second $500-1000, so her fine of $800 fits into the second offense maximums. They also have mandatory driving seminars you have to take. They probably waved her jail time in lieu of forbidding her to drive in the state since she does not live there, which they can do. If she is caught driving in the state, she will be arrested.

All DMV records are linked, so yes, she can lose her license in Ohio even if she comitted the offense in Kentucky. She will need to contact the DMV in Ohio to see what the status is. If she doesn't, and they have suspended her license and she gets stopped, she can be arrested - in any state. Sometimes they give a "hardship provision", meaning you can drive to and from work/school, but nowhere else, but that's up to the state. It will also be very, very hard and/or expensive to get insurance again.

If I were her, I would get an attorney to see what's what.

$200-$500 for a first offense is not so strict. I know that California and Washington both have much higher fines and jail time for first offenses, as well as DUI education classes and license suspensions. In California, once you pass your 3 months of suspension, you can only get a restricted license (for how long, I don't know) that allows you to drive to work, home and DUI class only.

A friend of mine got DUI in PA (first offense), barely over the limit but over she was, and about 1 mile from home, dropping a friend off after leaving the local bar and did an illegal U turn which cop saw and pulled her over for....Obviously suspected alcohol and she got nailed. She ended up out about $5K total (attorney, fines, classes) and her license was suspended for three months (might have been six, don't remember for sure, but three sticks in my head). Her parents had to drive her too and from work that whole time. She followed all the rules to the letter though, fines, community service, and classes she had to take. After it was all said and done she was allowed to have it purged from her record if she requested it, though she never did that, and has to mention in on job applications, etc. now. Luckily it did not prevent her from getting this job she really wanted at a school for austistic children, and it was a good wake up call for her too in more ways than one. We'd both done dumb things in the past but she was about 32 when this happened, way old enough to know better. --but hopefully your niece will learn a lesson and not be so stupid again, aldo yes she could lose her license and I hope she does for at least 3 months, preferrably more though. States have recipical agreements, not all, but most, especially with those bordering them.

$500 plus court costs and, of course, lawyer fees and lost his license for 30 days, plus 2 days in jail and 2 days home incarceration. My ex had his 2nd within a year, $1000 fine, court costs, lawyer fees, and lost his for 1-1/2 years, plus 4 days in jail and 30 days home incarceration. Also, the 1st DUI stays on your record for 5 years, so if you are arrested again for DUI in that 5 year span it is considered your 2nd. The third DUI, I believe, can be up to 60 to 90 days in jail and not sure how long you lose your license.

It's easy to be all self-righteous when someone else gets caught for DUI, but how many of us can say we NEVER, NEVER left a party, picnic or wedding after having a few drinks and probably shouldn't have been driving?

Getting caught once is a good wake-up call and I think it's probable that's it's up to her home state to deal with whether to suspend her license. But if she learned her lesson and never lets it happen again, it was probably her lucky day.

Our circle of friends ALWAYS designates a sober driver. Always. It's called being RESPONSIBLE.

I'm 48 and I don't drink at all. As a matter of fact, I can't remember when I ever even tried anything except maybe champagne at a wedding. Never had a desire. In fact, most of my friends are non-drinkers too.

Actually, I don't drink either. Haven't since I was in my early 20s. And even then I never drank more than one because I didn't care for it.

But MOST people DO drink and MOST would have to admit that somewhere along the line, they probably drove a car when they shouldn't have. I just don't understand the self-righteous indignation of those folks when they know in their heart that "There, but for the grace of God, go I"

My message is that simply, people need to take responsibility for themselves and I have and "know in my heart".

I am 23 years old! These are my "younger days" LOL! When my circle of friends began bringing alcohol into the mix, we as a group decided to always and forever have a DD.

I agree! and good for you and your friends for taking responsibility for each other. That's not only a great habit you've got into, but it shows that you love each other very much.

We pound that DD idea into our teenages, 'cause we know that sooner or later alcohol will also be introduced into the mix, AND we set the example of being responsible adults when we entertain.

A DUI is a DUI. No matter what state your license is from, you can still have it suspended/revoked for such negligent behavior as driving while under the influence.
