Does anyone know if you can file bankruptcy on a judgement that has been taken out on you by a hospital? Working as an MT leaves NO money to be able to pay on a hospital bill and of course, $5.00 isn't an acceptable amount to send them. The "law firm" handling this (debt collection office bogus law firm) is a joke. Money from my county's property taxes goes to help support the hospital, but I make too much to qualify for their hospital authority assistance (but not enough to live on), so I don't qualify for help. I had no insurance at the time I was seen at the hospital...I fall through that crack, too. "You realize this judgement will stay against you for 10 years and then it will be renewed, so somewhere down the line you might want to clear it up." While the one talking sits in their cushy little office, making probably more than 5 times (or more) than I do, has good insurance and has a spouse/significant other who contributes to the home. GGGGGGRRRRRR!!!!! Not in a good mood today. Stayed on hold with my internet provider for tech help 2 hours and 18 minutes last night before hanging up. I work a day shift, so it didn't affect me last night, but it still burns me up. I pay for the next to the top internet service and my service is soooo slow and then to be on old that long and never get to speak to someone...... TGIF!!!! TYIA!!! I had an unexpected hospital stay in 2009. The hospital bill alone was $65k. Like you, I had no insurance at the time. I had a major life complication during that time and my finances fell apart. I'm getting ready to file for bankruptcy within the next 2-3 months.

BTW, I am guessing they have not gotten the judgment on you yet. Have you been to court? If not and they are calling you, as soon as you retain an attorney for bankruptcy, just give them the attorney's name and they have to stop their efforts to collect and deal with only the attorney.

I have already been to court and basically was forced into consent for judgement. If not, they then would be able to nose around in my bank account and tax returns, etc. I don't feel like that wannabe law firm had that right. They're just a debt collector. The "lawyer" present for those of us being sued by the hospital acted like a fish out of water and when it came to the amount listed on the paper, there was just 1 amount; nothing listing the original bill owed, court costs, lawyer costs, etc. Of course, when I got the "official" judgement, it listed extra costs. I don't feel they should be allowed to add anything to the total on the paper at the court. Oh well, they're the law...they can do what they want to.

I was told the judgement will allow them to collect by whatever means. I guess that means harassment, illegal means, too?! They can also hold their breath to collecting! Not that I'm proud to say, but I have another judgement (much smaller amount) and it has resulted in the same amount to them - ZERO!

"any means possible" would be garnishment of your wages, taking your income tax returns, including that of your spouse if you have one, and taking fund from your bank accounts. They have the right to any and all funds that you have available and do not care if you cannot afford to eat. If there is money in your bank account, they can take all of it, and it will not help to open a different bank account somewhere else. As soon as your SS# shows up, they have access to the account. Scrape up the money by any means possible to get a BK attorney to avoid these happenings... and they WILL happen, believe me! BTDT

That's why we need healthcare reform. We're - all one illness away from bankruptcy.

I researched the possibility of filing bankruptcy and even contacted a bankruptcy lawyer. Then, I was told I had to pay something like $2500 just to get them to start the process/file. What can one do if she/he does not have the funds to fund the bankruptcy? I mean, with the help of a lawyer, and not borrowing money from family or friends, not an option...There may be a way to file on my own, but I'd rather have the help of an expert for this..

It is extremely complicated as a form of law; you really need a pro at your side. Good luck to you.

If there is a judgment against you, you need to talk to a BK attorney ASAP. You don't want to wait until they attach your bank account and take your income.

I have an acquaintance whose medical bills and emergency transport costs were "forgiven" by a major medical center because she could demonstrate that she was "medically indigent." Knowing that she has a LOT of resources at her fingertips, I could feel my BP explode when she told me this. Why should HER bills be written off when MINE (and obviously YOURS) would never be? As someone else said, most of us are probably one illness away from poverty. If I become ill, I plan to just hand over my house and car keys and tell them to take everything up front.

Anyway, could this be an avenue for you to consider? I'm sure that there are legal requirements for this status, but perhaps it's possible. You wanna weigh in, Nick?

that the paperwork with a BK is enormous! But it is worth it if you are in dire straits. If is possible to file BK without an attorney. In fact, any American can file a lawsuit without an attorney in any court in this land if he or she wants to do it. However, I would not advise doing this, especially on a BK.
