Lois Lerner to Appear and Plead the Fifth

Really disgusting. Guess she's afraid she'll get in trouble with Holder or Obama if she tells the truth....and note the different sites to chose from...hopefully one will suit everyone.

 

Lois Lerner, director of the IRS’ Exempt Organizations Division at the heart of the scandal involving the targeting of conservative groups, has invoked her Fifth Amendment rights.

 

The House Oversight and Government Reform Committee on Tuesday said Lerner’s lawyer has informed the committee that she will refuse to answer questions from lawmakers at a hearing Wednesday. In the meantime, committee Chairman Darrell Issa, R-Calif., has issued a subpoena for her to appear at the hearing.

“Chairman Issa remains hopeful that she will ultimately decide to testify tomorrow about her knowledge of outrageous IRS targeting of Americans for their political beliefs,” said Ali Ahmad, a communications adviser in the committee. 

Lerner’s name has been in the media since May 10 when she publicly apologized for the agency’s wrongful targeting of conservatives groups. She explained that low-level employees in Cincinnati targeted nonprofits applying for tax-exempt status by inappropriately singling out those with the words “tea party” and patriots” in their names.

Why would she be in trouble with them if she did something wrong and did not testify because she was at fault and would incriminate ***herself*** by testifying? That is the purpose of the 5th.

My reply was to the disgust expressed in the OP over the choice an American citizen made to invoke 5th amendment rights and to the first reply addressing the preposterous notion that Lerner's choice was made somehow out of fear of Eric Holder and President Obama. My comment took direct aim at what I consider to be a casually arbitrary and patently hypocritical view of the use of Constitutional rights guaranteed to EVERY American not to be forced to self-incriminate. I find it especially offensive when partisans who claim to be staunch defenders of the Constitution suddenly morph into advancing selective applications of citizens' rights enshrined therein, particularly when that decision presents obstacles during a HEARING process (as opposed to a formal trial). I did not appreciate the very evident foregone conclusions implicit in the fear remarks and am sickened by the scandal mongering that has been ongoing.

I try my best to approach these proceedings with an open mind. Since the process is in its preliminary stages, I think further comment on it is premature. My preference is to reserve judgment until such time ALL evidence comes to light and both sides have had they chance to present their case.

Therefore, my most honest answer here is that I have not yet formed an opinion. I have mixed feelings about this issue. On the one hand, I believe that there are organizations on both sides of the aisle that not only have shown the potential to abuse the nonprofit tax exemptions, but have falsely claimed to be nonpolitical. In those cases, I think the IRS is justified in doing their jobs by setting standards by which they make those determinations. The IRS has weakened their own standards by supplanting the word "primarily" for the original "exclusively" context when applying those standards. That flaw obviously needs to be addressed but pronto.

On the other hand, if it turns out that agents have deliberately set out to single out and target ANY specific party, those found guilty should have consequences to pay....much the same way that, if in the event GOP congressional "aides" are found culpable in tampering with Benghazi emails for political gain, they should be held to account.

After all, she did answer questions the first time. At the hearing today, she verified the IG's Q&A papers Issa handed her.

So she did answer a question. When Issa asked 2 more questions, she answered in the 5th. So he asked her to reconsider her decision, which she then conferred with her "counsel" then stated she wouldn't and was dismissed SUBJECT TO RECALL after the committee consulted with their counsel over Gowdy said she waived her right to the 5th because she made an opeing statement and did answer a question (or 2) at first.

She is in fear of something or someone, that is known because she did answer questions before.

Democrats on the committee are as furious over this as the Republicans, so you can't call this a witch hunt. They really need to have an independent investigator get in on this so the accusations stop.

She could say something - like...

her orders to do this were given to her by the head of the treasury, the head of the DOJ, or name anyone in the administration - thereby telling the truth, but getting herself in trouble with the powers that be.

That is not what the 5th amendment says. It says this:

"The Fifth Amendment of the U.S. Constitution provides, "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

By taking the 5th, she is refusing to be a witness against herself, not anyone else.

out the orders given to her. She knew what was going on and she passed on the orders. If that's the case, she's still responsible for what she did, she would just be explaining why she did it.

Again, she would be a witness against herself and the 5th amendment gives her protection from incriminating herself.
