As with most of these incidents, it always seems to come out after the fact that people - whether coworkers, acquaintances, etc. - were aware of something suspicious but were afraid to say anything, for a variety of reasons - but one of the main reasons is LEGAL LIABILITY, especially with respect to workplace situations.
The United States is the most litigious society in the world, with far more lawyers per 1000 population than any other. These lawyers, for the most part, are just waiting and hoping for opportunities to sue someone for something - and real fault of any kind is the LAST thing that a lawsuit requires. It only requires the ASSERTION of blame of one sort or another, and the lawyers often prosper because the defendants will settle rather than incur costly legal fees to defend themselves. Even when they have done nothing wrong, THEY LOSE merely by the cost of defending themselves and the adverse publicity that the scumbag media give to the case.
A company can be sued for merely INVESTIGATING allegations - no matter whether it involves terrorism or not. Obviously, this has a very chilling effect on the whole "see something, say something" idea.
What we need to do is for each state to pass SPECIFIC LEGISLATION that IMMUNIZES both individuals and businesses from any liability whatsoever, whether for reporting OR investigating situations in which individuals are revealing evidence of their propensity to commit these kinds of acts - even if it amounts to nothing more than expression of their SUPPORT for others who have done so.
They must also be immunized from liability for sharing their investigative findings and/or suspicions with federal agencies!
There must be complete freedom of dialog - without fear of legal reprisal - when it comes matters of national security!
This is by no means the only situation in which the excessive numbers of lawyers in our litigious society have had an extremely negative impact on our nation (how many ads have you seen for frivolous drug lawsuits recently?) , but certainly this is one that needs to be addressed immediately. When it comes to acts of mass mayhem, whether it's related to terrorism or not, there MUST BE ABSOLUTE IMMUNITY FOR TAKING PRECAUTIONARY OR PREVENTIVE ACTIONS, PERIOD!!
Whether it's someone who suspects that a Muslim intends to commit mayhem or a secretary for a Catholic church who suspects the priest of molesting children - there MUST BE ABSOLUTE LEGAL IMMUNIZATION FROM ANY AND ALL LIABILITY WHATSOEVER TO INDIVIDUALS OR ORGANIZATIONS for reporting their suspicions to the appropriate authorities. Each and every state must immediately pass legislation to this effect, and every governor must sign it into law. They should also be permitted to sue the media for adverse publicity, with the presumption going to the plaintiff - meaning that the media would have to PROVE that they had good reason for their behavior, or suffer the consequences.
