2nd degree murder is intentional murder with malice aforethought, though not planned in advance.
How will they prove that when the officers called paramedics for medical help at 8:22 pm. That's 3 minutes before Floyd appeared unresponsive. I could see it if they had not called paramedics, but they did. That's proves it's not malicious.
Another way to prove malice would be if he had sustained some kind of physical injury from Chauvin. One autopsy said there was no evidence of "traumatic asphyxiation." Was there any damage done to Floyd's neck?
While en route the ambulance carrying Floyd asked for assistance from the Fire Department because Floyd was going into cardiac arrest. Doesn't that mean he was still alive when the ambulance picked him up at 8:28 pm? If the family's autopsy is correct and Floyd died of mechanical obstruction, why didn't he start breathing when the obstruction on his neck and back were removed?
Does anyone know how long you have between passing out on fentanyl and going into cardiac arrest?
It's going to be like the Baltimore cops trial. Chauvin will walk. The prosecutor is being overzealous and won't be able to prove the case. More riots coming soon, assuming the current ones ever stop...
