He can't be obstructing justice by performing executive tasks as laid out in the Constitution, like firing Comey or talking to Comey and telling him to lay off Flynn.

The DOJ already said they wouldn't be pursuing an obstruction charge.

But this is a political fight. Do you think Dems can win if they really believe it?
