No he is moving to "conspiring" to find out what Trump "was thinking"

We are headed to court (as Dershowitz has been saying) where Mueller can explain why the exercise of Constitutional powers by the president is somehow probable cause of a crime. He will also have to explain why this investigation was launched in the first place. The last thing Mueller wants to do is issue a subpoena because that will force him to take this all the way to the Supreme Court.

He might not like his legacy being one of causing a Crisis and starting a civil war.
