The Zervos lawsuit is a civil lawsuit, much like Bill Clinton vs. Paula Jones, etc.
It's not a criminal prosecution. Trump, while President, is immune from criminal prosecution. He has to be impeached first (or finish his term) and then he can be prosecuted for wrongdoing in a criminal court.
You might get to see how all that shakes out with Obama...
(I know Obama isn't the President. That's the point. If he broke the law while he was President, he can be prosecuted. Because no one is above the law.)
