president, it would only go in effect if both president and VP couldn’t serve. There have been a few times when a VP has moved up to president that the VP slot was left unfilled. I haven’t researched thi,s but Truman replacing FDR comes to mind. I don’t think the VP slot was filled in this instance till the next election.
