Just researched and found that while its possible that the presiding Justice CAN rule in a tie, they most likely will not. BUT unless there was a tie breaker vote, the NO'S will take a tie because it will be considered to have not passed (the motion).
So the vote will be:
Collins, Murkowski and Romney as yes votes, all others NO.
I still think they might try for 49/51 with only Romney and Collins voting yes, but I'm pretty sure they know they can count on Justice Roberts to stay silent.
Either way what I said before still holds: You don't refused KEY, first-hand witness testimony unless you are trying the hide the truth.
This may be a blessing in disguise, as the truth drips out fewer people will stay home from the polls in November.
