Rep. Chris Kapenga (R-Delafield) is one of the nine from Wisconsin who told the Campaign for Liberty he would back legislation to declare Obamacare illegal and allow police to arrest federal officials who take steps to implement it in Wisconsin. He said he believes the health care law is unconstitutional, despite the U.S. Supreme Court's ruling that it passes constitutional muster.

That's EXCELLENT that politicians are standing up for what is right for the people of their states. Hope more follow his lead. We need brave politicians who stand up to the tyranny and fight for what is right for the people they represents. Wished I lived in his state.

I foresee Rep. Kapenga being named one of the hero's in the near future (that would be the real world's future).

I guess Kapenga is not the only one who missed school when they talked about what the Supreme Court is and what it does. Neither Kapenga nor a state legislature nor the President of the United States may determine what is constitutional. That determination can only be made by the Supreme Court. The man is a political moron to suggest that a state law could possibly trump the highest court of the land. In what alternative universe does he live?

The supreme court would be independent. They would base their decisions on following the constitution. They would not be bought by party line. In a perfect world people would see the faults in their own party. Actually in a perfect world there would be no parties, there would be no payoffs, there would be fairness, but as we all know this is not a perfect world. The supreme court has been appointed by a liberal president. They are swayed by political party. This is not a perfect world.

Every citizen has the right (and duty) to determine what is constitutional. If you have people stating something is constitutional because it goes with their party line, or if they've received a payoff, when it is not constitutional according the the written constitution it is EVERYONE'S duty to speak up.

who lack proper "judicial temperament." I.e., legal principles take a back seat to their personal preferences. BUT, they are independent as hell and can do just as they like.

Given lengthened average lifespans with modern medicine, I think we should kick them all off after a couple of decades or so.

Let me repeat. The power to rule on what is constitutional in the United States of America is invested solely in the Supreme Court. Period. No ifs, ands, or buts. You or I may personally believe that a majority opinion of the court is biased by whatever, be it personal political views or the phases of the moon, but only SCOTUS determines what is constitutional under the law of our land. This is not a complex concept, it really isn't. I don't understand why it is so difficult for some to grasp. There is no appeal to a Supreme Court decision because there is no higher court. While Congress has the power to amend the Constitution itself, again it is the Supreme Court who will then determine if laws comply with the newly amended Constitution. The idea that a state legislature has the authority to trump the Constitution is ludicrous.
