According to CBS: The FBI confirmed that in Nov. 2016, Santiago-Ruiz walked into an FBI office in Anchorage and claimed his mind was being controlled by a U.S. intelligence agency and that he was being forced to watch videos for ISIS. He was sent to a psychiatric hospital after police were called, sources said. . . . ABC News noted that local law enforcement had “his mental health evaluated.” He may have also continued receiving psychological treatment after that. From Fox News: Relatives of the man accused of Friday’s shooting rampage at a Florida airport say he had a history of mental health problems and was receiving psychological treatment at his home in Alaska. . . . NBC News also reports that Santiago was “receiving psychological counseling in Anchorage.” The bottom line is despite all this psychological treatment apparently no mental health professional identified him as a danger to himself or others.;

the government to protect us, and the serious problem of unscreened areas of the airport where there are lots of people and no security.

Airports are not safe and this is an example. Two magazines emptied into people and not a single shot returned in defense or to stop the terrorist.

I am a member of the mental health community. Along with my transcription career, I am also a psychiatric evaluator for an emergency room. Unfortunately or fortunately, depending on your perspective, people are allowed to hear voices and be crazy. Psychiatric clinicians cannot legally lock someone up against their will unless there is substantial risk of danger to others. They need to have threatened someone or they need to be so ill that they cannot care for themselves. We can point out that we feel it would be best for them to go to the hospital. We can call their families in a crisis and let them know the person needs immediate treatment, but we cannot put them away unless their is immediate danger. And if we do hospitalize someone against their will, once the person is no longer an immediate threat, the psych hospital has to let them go. If I, or anyone else, were to lock someone up against their will just because they were hearing voices, we could lose our licenses for falsely imprisoning someone. Blame the damned laws, not the psych professionals.

What ever happened with the Baker Act? It used to be used extensively at the hospitals I did transcription. Holding someone involuntarily, even if only 72 hours, gives the psychiatrists plenty of time to evaluate and decide if they need more extensive treatment, which could be used as proof for a longer detention.

Was it repealed or don't health providers know about it? If they don't, then they need to start educating themselves.

I think I just emailed someone this info when I meant to post it. Sorry to the person I emailed.

In order to commit someone against their will for 72-hours, they have to meet criteria. They have to be an imminent threat to the community. The psych evaluator has to back up his or her opinion that the patient is 'dangerous to others' with facts. We are not allowed to commit someone for 72 hours just because they are talking about ISIS. Once a clinician does find the person in need of the 72-hour hold, the patient has the right to an attorney, who may or may not be able to get the hold rescinded. Some patients who are put in lockup for 72 hours are able to get it together enough to get released. And the person can leave a psych hospital after an extended stay, on lots of nice medications, with a referral to outpatient treaters. They can then go off the medications, get pissed off for some wacked out reason and shoot someone.

And insurance companies get in the middle of the whole evaluation process just to make things even tougher for an emergency evaluator.

There are no guarantees.

And this is why I only work at the emergency room when they throw lots and lots of cash my way. I'll stick to transcription!!!
