VA Supreme Courot strikes down McAuliffe's

Posted: Jul 23, 2016

The Supreme Court of Virginia on Friday struck down Gov. Terry McAuliffe’s executive order restoring voting rights to 206,000 felons, dealing a severe blow to what the governor has touted as one of his proudest achievements in office. In a 4-3 ruling, the court declared McAuliffe’s order unconstitutional, saying it amounts to a unilateral rewrite and suspension of the state’s policy... The court majority found that McAuliffe did indeed overstep his authority. “Never before have any of the prior 71 Virginia governors issued a clemency order of any kind — including pardons, reprieves, commutations, and restoration orders — to a class of unnamed felons without regard for the nature of the crimes or any other individual circumstances relevant to the request,” Chief Justice Donald W. Lemons wrote in the majority opinion. “To be sure, no governor of this commonwealth, until now, has even suggested that such a power exists. And the only governors who have seriously considered the question concluded that no such power exists.” ;

This decision might have helpd to push the decision - by Hillary to pick someone from VA.

The fact that the vote was 4 to 3 is scary. Thank goodness this idiotic and illegal power grab has been thwarted, FOR NOW.

Stroke of the pen, law of the land....

Federal Court Strikes Down Texas Voter ID LawAug 30, 2012
It was the state's second major loss in court in three days, coming after a separate federal panel ruled Tuesday that Texas' Republican-dominated Legislature failed to avoid "discriminatory purposes" when drawing new maps for congressional districts and both houses of the state Legislature to reflect the Texas' booming population. A report by the Brennan Center for Justice, a nonpartisan legal think tank in New York, determined that new voting restrictions could suppress the vote ...

Libyan state television showed footage from an unidentified hospital of what it called victims of the "colonial enemy." Ten bodies were wrapped up in white and blue bed sheets, and several people were wounded, one of them badly, the television said. Western intervention, after weeks of diplomatic wrangling, was welcomed with a mix of apprehension and relief in Benghazi, where the main hospital was filled with men, women and children wounded in Saturday's assault on the city by Gaddafi' ...

Appeals Court Strikes Down Obama Recess AppointmentsJan 25, 2013
Really? You mean the courts are finally going to start doing their job? A federal appeals court said Friday that President Obama overstepped his authority with a series of recess appointments to the National Labor Relations Board. The case may wind up in the Supreme Court and determine how far the president can go in appointing people whose nominations would be filibustered in the Senate. The result could affect the standing of other Obama appointees, such as the head of the president's ...

Do You Trust The Supreme CourtMar 26, 2012
Before the decision even comes down from the Supreme Court on Obama's health care law I have to admit I have no confidence in them. It's all political. President Obama is not stupid. But he thinks you are. He knows the Obamacare heal ...

Nationwide, more than 4 million people living in 37 states would be in situations like these. Most would have no way to pay the higher bills, forcing them to drop insurance covera ...

How The Supreme Court Can Resolve The Debt Ceiling CrisisOct 14, 2013
Adam H. Rosenzweig from the Washington University School of Law proposes a different approach to ending the debt ceiling crisis: Let the Supreme Court resolve it as a Constitutional matter. What should happen when Congress and the President find themselves in a fiscal policy showdown resulting in a Constitutional violation? This question has risen to the fore in light of the recent political showdowns over the so-called “debt ceiling” crisis. Some scholars have argued that there ar ...
