Absolutely Perfect Idea--Obama as Supreme

Posted: Mar 19, 2015

I saw it proposed as an idea today that when the next Democratic president is elected in 2016 that they should nominate Barack Obama as the next Supreme Court Justice.

He is well-educated, a constitutional lawyer, level-headed, hard to fluster, and writes flawlessly.

This is just a perfect idea!

I am confident in my conclusions and all of the name-calling and false rhetoric doesn't phase me. If any can find a real reason he should not be a Supreme Court Justice, it might be interesting.

I'll give you a reason. He is no longer a lawyer - Truthhurts

He and Michelle voluntarily retired their licenses. They can get them back but first, they have to decide where they're going to live after he leaves the White House. No matter where he lives, he must take the bar exam in that state. Some states have rules that inactive lawyers can only practice pro bono cases.

Lawyers on inactive status, despite being characterized in many jurisdictions as being “in good standing,” and lawyers on disability inactive status are not permitted to practice law. If the Obama's would want to update their licenses, they would have to pay their dues, have their malpractice insurance, and I'm sure they would have to be admitted to the bar of that state by taking an exam and catch up with the CLEs. I doubt either of them would really want to do that.

He couldn't just put his law license on active status and begin practicing law. Any lawyer on inactive status under paragraph H shall be reinstated without further order if the lawyer makes application within five years of the effective date of transfer to inactive status. Any lawyer who fails to make application for reinstatement within five years of the effective date of transfer to inactive status (which Obama's status are way more than that) may, in the discretion of the court, be required to petition for reinstatement under Rule 25.
as you mention, he can reactivate his status - sm

I don't agree that to update their licenses, to pay their dues, to have malpractice insurance, or to take the bar exam and catch up on CLEs would be a problem for either of the Obamas.
Maybe not a problem but could take a few years - Truthhurts

Can't do it all overnight. The exams are only done certain times of the year and who knows how many CLEs they need to catch up.

Another thing they would need to do if they move to either IL, NY, or Hawaii, they would be REQUIRED to work with a Certified Legal Services Program and required to have Direct Supervision in all but Hawaii.
Here's the actual truth. - sm

Four days after then Senator Obama announced that he would run for president in February 2007, he voluntarily elected to have his law license placed on "inactive" status. After he became President of the United States in January 2009, he then elected to change his status to "retired" in February 2009.

Why do you think he would have to take another bar exam to become a lawyer or take a lot of CLE courses? He would simply take his voluntary status out of "retired" and back to active by submitting a written or online notification stating that he intended to return to active status and pay the registration fee for each year that he was retired. Then he could practice law again. He wasn't put on disciplinary action; he himself voluntarily "retired," and he himself could voluntarily "un retire" without having to pass the bar again and without having to take a single CLE course whatsoever. He would notify and pay the money, and that's all there is to it.

Besides all of that, the Constitution makes no requirement for a Supreme Court Justice to be a practicing lawyer anyway or even to have a law degree. Fact.
also, rule 25 applies to lawyers who were suspended - or disbarred. sm

i.e., not applicable to the Obamas.

Well since we don't know that its going to be a democrat elected in 2016 - those are all assumptions

[ In Reply To ..]
The Supreme Court is supposed to be level headed that wouldn't work with him. Also, someone with some sense and intelligence. That excludes him.

I believe the democrats have messed things up in this country so bad, that the people are ready for a change in parties.

Thank you! - What I was going to say

Obama has obvious bias and is a radical with no respect for those who hold views different from his own. His administration has been even less transparent than the previous one. I never thought there would be a worse president than GW Bush, but I was wrong. Boy, was I wrong.

Oh, how liberals wish Obama were actually a radical. - sm

[ In Reply To ..]
Conservatives believe the lies they hear in right-wing media about Obama being a radical. It's about time the right wing dropped the radical talk since the election is over and Obama won it..... like the Ebola talk and freaking out their base, the Obama radical talk is useless at this point.

Liberals wish he were more radical in his earlier years in office rather than trying to work with the party of "no" whose primary goal was to say "no" to everything he wanted and make him a 1-term president. LOL. But at least he does seem to be finally figuring out the Con game and kicking up a little dust in their faces.

You go, Obama! Finally giving them exactly what they deserved all along from day 1.

Yep. The people are ready for transparency as well - nm

Justices have to be as close to impartial as possible - Radicals of the left or right do not fit the bill

[ In Reply To ..]
Yes, Obama is those things, but he might as well wipe his tush with the constitution. I thought W was the worst president of my lifetime (born in '77), but boy was I wrong.

Obama is hardly a radical - sm

And whether you regard him as one or not, Supreme Court Justices must be confirmed by the senate. I graduated from high school the year you were born. You will see that with time comes perspective.

This is what I think of when I hear the words Obama and - Supreme Court in the same sentence (sm)
