Executive Order Makes Immigrants Eligible for Medicare, Social Security

The approximately 5 million undocumented immigrants [AKA illegal aliens] who are eligible for deferred deportation and work permits under the president’s recent executive action could also become eligible for Medicare and Social Security, the White House told a Washington Post reporter on Tuesday.

Obama wants to give them work permits but to legally work and pay taxes in this country, they'll need a TIN, ITIN, or SSN.

That's what the IRS and Social Security Administration states:

Yet the argument that ILLEGAL ALIENS pay taxes is null and void if they don't have these numbers because they can't work if the employers are legally checking and they can't file for a tax refund if they don't have one of these numbers, but they are still getting away with it.

From the IRS and SSA websites, are the rules in immigrants and I'm certain that ILLEGALs fall into that group:

They need to apply for a Taxpayer Identification Number (TIN), an identification number used by the Internal Revenue Service (IRS) in the administration of tax laws. It is issued either by the Social Security Administration (SSA) or by the IRS. A Social Security number (SSN) is issued by the SSA whereas all other TINs are issued by the IRS.


If you are not an immigrant or did not apply for a Social Security number on your immigrant visa application, you must have your papers from DHS showing your U.S. immigration status and authorization to work in the United States. Then you should apply for a Social Security number and card by visiting an office.

If you are not authorized by DHS to work in the United States, you can get a Social Security number only if you can prove you need it for a valid non-work reason. That might happen, for example, if a state or federal law requires you to have a Social Security number to obtain benefits to which you have already established.

If you need a number for tax purposes and you are not authorized to work in the United States, you can apply for an Individual Taxpayer Identification Number from the Internal Revenue Service (IRS).

They need to apply for an ITIN, or Individual Taxpayer Identification Number, which is a tax processing number only available for certain nonresident and resident aliens, their spouses, and dependents who cannot get a Social Security Number (SSN). It is a 9-digit number, beginning with the number "9", formatted like an SSN (NNN-NN-NNNN).

That was my message you replied to. Was not sure if I understood that correctly. Thanks for the research. I think in the midst of all this if they are going to do this then I may be putting in my application to receive my SS even though I'm not 65 yet. If they are going to pay people out of the fund to which they did not contribute, then I should be entitle to pay from a fund I did contribute my whole life to.

has been stating all along that the illegals could not get any benefits afforded to citizens of this country, but in reading article after article, he does say that BUT leaves out the 10-year rule. Gutierrez, in all his on-screen interviews never mentioned the 10-year claims, but he certainly did state that they were NOT eligible for any benefits even though they had to pay SS and other taxes.

Back in 1996, Congress defined the public benefits that undocumented immigrants couldn’t get. That law listed "Any retirement, welfare, health, disability, public or assisted housing, post-secondary education, food assistance, unemployment benefit, or any other similar benefit." Numerous agencies have interpreted this to mean Medicaid and Medicare, SNAP, energy assistance and so forth.

The Senate bill also expressly blocks immigrants with temporary status from receiving any health insurance premium subsidies under the Affordable Care Act.

However, individuals can use their own money to buy their insurance through the clearinghouses called exchanges.
The 1996 law built in some exceptions for immigrants without legal documents.

In addition to Medicaid paying for emergency medical treatment, young children are eligible for reduced school lunch programs and standard immunizations. The Women, Infant and Children program, WIC, can subsidize grocery bills for young families.

Regarding the 10 years Gutierrez mentioned, some immigrants under provisional status might be eligible for permanent resident status, a green card, sooner. If that happens, then they would gain access to public benefits in less than 10 years. However, both Social Security and Medicare require that a person or their spouse pay into the system for 10 years before they can claim any benefits. This applies to everyone, native born or not. And both programs are available only to citizens or permanent residents.

People with provisional status would have Social Security and Medicare taxes deducted from their paychecks but would be ineligible to use those programs for 10 years.

IMHO, what Obama is doing with his EO is giving ILLEGALS a way to achieve PERMANENT status.

Check this site for what his EO is going to do and note the numbered items, especially #2&3. Number 3, also in IHO, seems to invite more ILLEGALS here since they only have to have resided in the U.S. illegally for 180 days!

NONE of the actions Obama has taken are FAIR to those who STOOD IN LINE AND WAITED TO GET CITIZENSHIP LEGALLY.
